I WERE SHOP LAHABRA A LITTLE BIT EARLY AND WE'LL ADD A LITTLE BIT LATER.

UM, SO IT'LL RUN FROM, UH, NOVEMBER 9TH, WHICH WAS LAST MONDAY THROUGH DECEMBER 18TH.

AND WE WERE JUST THINKING ABOUT THE PEOPLE AND NOT HAVING LARGE GROUPS SHOPPING AND DOING, COMING INTO THE OFFICE AND SO FORTH.

SO WE'VE EXTENDED THE TIME, BUT WE'LL CONTINUE WITH THE PROGRAM WE NORMALLY DO WHERE IT'S, WHERE YOU'LL, WE WILL RECEIVE A, UM, RAFFLE TICKET OR OPPORTUNITY FOR EVERY $25 SPENT IN LAHABRA.

AND, UM, AND WE CAN SEE THE RECEIPTS IN ANY MANNER WE CAN DO, UM, DIRECT MESSAGING ON FACEBOOK OR, UM, EMAIL OR WHATEVER PEOPLE ARE FEELING COMFORTABLE WITH.

CONSIDER REINSTATEMENT OF LA HABRA MUNICIPAL CODE 10.20.180 That the City Council approve to reinstate La Habra Municipal Code (LHMC) Section 10.20.180 to allow for enforcement of overnight parking violations beginning January 3, 2021, and waive overnight parking permit renewal fees for any parking permit holder who purchased an overnight parking permit for calendar year 2020. ]

TO CONSIDERATION ITEMS. ANY MEMBER OF THE AUDIENCE MAY REQUEST TO ADDRESS THE LOBBY CITY COUNCIL ON ANY CONSIDERATION ITEM PRIOR TO THE HARBOR CITY COUNCIL, TAKING A FINAL VOTE ON THE ITEM.

FIRST ITEM HERE IS CONSIDERED REINSTATEMENT OF LAHABRA MUNICIPAL CODE 10.2 0.180 STAFF REPORT.

GOOD EVENING, MAYOR CITY COUNCIL.

AS YOU KNOW, IN MARCH OF THIS YEAR, THE COVID 19 PANDEMIC SWEPT THROUGH CALIFORNIA CAUSING A STATE OF EMERGENCY AND A DECLARATION OF LOCAL EMERGENCY HERE IN LA HABRA.

IN EARLY APRIL, YOU APPROVED THE TEMPORARY SUSPENSION OF OVERNIGHT PARKING PERMIT ENFORCEMENT DUE TO THE GOVERNOR'S STAY AT HOME ORDER.

OVER THE LAST FEW MONTHS, THE STATE AND COUNTY HAVE LIFTED MANY OF THE RESTRICTIONS ALLOWING COMMUNITIES TO ENGAGE IN ROUTINE ACTIVITIES LIKE WORK IN SCHOOL, THUS MINIMIZING THE NEED TO STAY AT HOME.

STAFF IS AWARE OF THE RECENT REGRESSION IN THE COUNTY, AS IT RELATES TO THE STATE COVID 19 PARAMETERS.

HOWEVER, WE DO NOT ANTICIPATE ANOTHER LOCKDOWN OR

A MORE RESTRICTIVE STATE AT THIS TIME.

STAFF IS RECOMMENDING THAT CITY COUNCIL APPROVE REINSTATEMENT OF OVERNIGHT PARKING PERMIT ENFORCEMENT AND TO WAVE OVERNIGHT PARKING PERMIT, RENEWAL FEES FOR ANY PARKING PERMIT HOLDERS WHO PURCHASED DURING CALENDAR YEAR 2020 COUNCIL QUESTIONS, THE STAFF.

YEAH.

UM, TODAY WE WENT INTO PURPLE MODE.

UM, HOW, HOW DO WE ANTICIPATE, UH, YOU KNOW, UH, ADDRESSING THAT ISSUE AS WE GO FORWARD AND CAN WE PIVOT BACK, UM, IF WE NEED TO BE GOING FORWARD.

SO STAFF IS AWARE THAT WE JUST RECENTLY MOVED TO PURPLE AND WE'RE WORKING WITH DAVID TO UNDERSTAND EXACTLY HOW THOSE, I'M SORRY, HOW THOSE RESTRICTIONS WILL AFFECT US.

AT THIS TIME, WE DON'T FEEL THAT WE WILL GO INTO, UM, ANY TYPE OF RESTRICTION WHERE A STAY AT HOME ORDER WILL BE GIVEN.

UM, AND A LOT OF THE BUSINESSES WILL STILL BE ABLE TO MODERATELY BE OPEN MORE PRUDENT TO CONTINUE THIS ITEM INTO THE DECEMBER 7TH MEETING, TO SEE KIND OF WHAT HAPPENS.

IT'S CONSIDERING WHAT THEY'RE GOING TO TAKE ACTION ON, UH, JANUARY 3RD.

UM, AND JUST KIND OF SEE HOW THINGS GO IN THE NEXT COUPLE OF WEEKS BEFORE TAKING THIS ACTION.

LET ME ASK A QUESTION BEFORE YOU ANSWER JIM, UM, UNDER THE CITY MANAGER'S EMERGENCY AUTHORIZATION, YOU CAN REINSTATE THIS AND THEN COME BACK TO US.

RIGHT? SO IN OTHER WORDS, IF ON JANUARY 3RD, THINGS ARE NOT ACCEPTABLE TO REINSTATE YOU CAN UNREINFORCED DATA, CORRECT.

AND COME BACK TO COUNCIL.

AND ONE OF THE THINGS THAT WE'RE TRYING TO ACCOMPLISH IS WE'RE TRYING TO GET THE WORD OUT AS SOON AS POSSIBLE, UH, FOR THAT JANUARY 3RD DEADLINE, UH, WE'RE GOING TO HAVE, UH, MAILERS IN THE WATER BILL.

SO THAT'S THE INTENT OF COMING THIS EARLY, BUT IF WE NEEDED TO, UH, RETRACT THAT IF WE NEEDED TO CHANGE IT, WE COULD.

SO I UNDERSTAND THE CONTINUE PART, JEN, BUT THAT'S WHY I ASKED CAUSE JEN CITY MANAGER SANDRO CAN REINSTATE THE LITERATURE HAVE BEEN PRINTED YET.

SO A COUPLE OF, COUPLE OF POINTS.

UM, SO FIRST OFF, THIS WOULDN'T TAKE EFFECT UNTIL JANUARY ANYWAY, SO WE CAN KIND OF MONITOR HOW THE STAY AT HOME ORDER, IF THERE'S A STAY AT HOME ORDER THAT IS ISSUED BY THE STATE.

UM, AND UNDER THE EMERGENCY PROVISIONS THAT I HAVE A CITY MANAGER UNDER THE DECLARATION OF EMERGENCY, WE ROLLED BACK BACK IN MARCH, THESE OVERNIGHT PARKING RESTRICTIONS, THEN ON MY AUTHORITY.

AND THEN I CAME TO COUNCIL, THE FOLLOWING MEETING TO ASK THAT COUNCIL RATIFY THAT.

SO IT'D BE VERY SIMPLE FOR US TO MONITOR THE SITUATION.

IF WE GET CLOSE TO JANUARY AND WE SEE THAT THERE IS A LOCKDOWN OR A SHUTDOWN AND PEOPLE ARE STAYING HOME, I CAN SIMPLY MAKE THAT DECISION AT THAT POINT WITH THE POLICE DEPARTMENT TO NOT ENFORCE.

AND THEN WE'D COME TO COUNCIL TO RATIFY THAT ARBITRARY ANTICIPATED IN SPENDING ON FLYERS THAT WILL BE INSERTED IN THE WATERVILLE.

UM, GENERALLY WHAT ABOUT FOUR OR $5,000 AT MOST? MEL 2,500 IS ABOUT $2,500 JUST TO PRINT AND THEY GO INTO THE WATER BILLS AS IT IS MR. CITY MANAGER.

YOU DON'T THINK IT'S PRUDENT JUST TO WAIT UNTIL THE NEXT MEETING, JUST TO SEE WHAT, HOW THINGS PLAY OFF THE NEXT WEEK OR SO? WELL, THIS WON'T, IF THE COUNCIL TAKES ACTION TONIGHT, IT WON'T TAKE EFFECT TILL JANUARY.

SO THE ONLY ISSUE FOR US IS TO GET IT INTO THE BILLING CYCLE SO THAT WE CAN MAKE SURE WE NOTIFY EVERYBODY IN THE CITY.

IF WE WAIT TILL THE NEXT MEETING, WE PROBABLY WON'T BE ABLE TO NOTIFY EVERYBODY IN THE CITY PRIOR TO EITHER LATE JANUARY OR FEBRUARY WOULD BE THE IMPLEMENTATION DATE.

AND IF THAT'S THE COUNCIL'S DIRECTION TO DO THAT AND WAIT ANOTHER MONTH, THAT'S FINE.

IT'S IT'S FROM A LEGAL STANDPOINT, WHAT KIND OF NOTIFICATION OR ARE WE REQUIRED TO GIVE TO THE RESIDENTS? UH, BUT WE'D GO OUT OF OUR WAY TO MAKE SURE WE DO NOTIFY THE PUBLIC.

IN FACT, WE RECENTLY NOTIFIED THE PUBLIC ON REINSTATING STREET, SWEEPING ENFORCEMENT, AND EVEN WITH ALL THOSE NOTICES, THE POLICE DEPARTMENT GAVE WARNINGS THE FIRST WEEK OF ENFORCEMENT TO EVERYBODY.

SO THEY DIDN'T EVEN TAKE IT THE FIRST WEEK THEY COULD HAVE.

THEY GAVE WARNINGS TO GIVE EVERYBODY AN OPPORTUNITY TO REMEMBER THAT STREET SWEEPERS ARE OUT AND WE WOULD PROBABLY FOLLOW A SIMILAR TACT ON THIS.

IT'S NOT OUR INTENTION TO BE PUNITIVE, BUT WE DO GET A POINT WHERE WE GET IN SO MANY PEOPLE PARKING NOW IN AREAS OF THE TOWN WITHOUT OVERNIGHT PARKING PERMITS, WE GET COMPLAINTS AS SOME OF YOU HAVE GOTTEN COMPLAINTS.

SO WE'RE LOOKING TO REINSTATE TO KIND OF BRING SOME SEMBLANCE OF NORMALITY TO HOW WE USED TO PROCESS THESE.

SO I'M SORRY.

THE PROPOSED ORDINANCE ADDS CHAPTER 2.58 TO THE LABA MUNICIPAL CODE AND CODIFIES THE CAMPAIGN CONTRIBUTION LIMIT IMPOSED BY STATE LAW.

ALL OF US HAVE BEEN INVOLVED OVER THE YEARS, BUT CANDIDATES, YOU DON'T NEED THE A HUNDRED THOUSAND DOLLARS TO RUN FOR CITY COUNCIL.

YOU JUST NEED TO BE INVOLVED IN THE COMMUNITY, BE SUPPORTIVE OF THE COMMUNITY.

AND IF YOU REALLY WANT TO GET ON COUNCIL, THAT YOUR TIME MIGHT BE NEXT DOWN THE ROAD SOMEWHERE.

SO ANYWAY, JIM, UH, CONGRATULATIONS TO TIM AND STEVE, UH, HOPEFULLY 20, 21 WILL BE A LOT DIFFERENT.

UH, HOPEFULLY WE'LL HAVE, UH, MORE OPPORTUNITIES, UH, TO OPEN UP AND GET OUT THERE MORE WITH THE PUBLIC IS THROUGH THE CIRCUMSTANCES.
