SO THE SUBJECT TENANT SUITE IT'S LOCATED WITHIN THE LAHABRA MARKETPLACE, UM, IT'S PROPOSED TO OPERATE WITHIN THE FORMER PIZZA REV SUITE, UH, PIZZA REV CEASE OPERATION IN DECEMBER OF 2017.

THE PROPERTY OWNER DID FILE A TIME EXTENSION TO KEEP THE CUP FOR THE RESTAURANT AND THE CUP FOR Y'ALL CALL SALES ACTIVE.

UM, BUT IT ENDED UP EXPIRING IN 2019 DUE TO NON-USE THE APPLICANT'S REQUESTING THEORY, ENTITLE THE SUITE TO ALLOW FOR THE RESTAURANT WHERE WITH BEER AND WINE SALES, THE PROPOSAL INCLUDES THE OPERATION OF A BARBECUE STYLE RESTAURANT.

THAT'LL PROVIDE PREMIUM QUALITY, BARBECUE WITH A TYPE 41 ON SALE BEER AND WINE LICENSE FOR ONSITE CONSUMPTION.

UH, THE RESTAURANT WILL OPERATE FROM 10:00 AM TO 10:00 PM DAILY WITH 15 EMPLOYEES.

THE PLAN INCLUDES A TENANT IMPROVEMENT TO THE 2,236 SQUARE FOOT SUITE.

THAT INCLUDES A 584 SQUARE FOOT OUTDOOR SEATING AREA OR PATIO AREA, UH, LOCATED ALONG THE WESTERLY SIDE OF THE BUILDING.

UM, THE IS ALSO REQUESTING TO PLACE A LIFE SIZE BULL STATUE WITHIN THE GATED OR THE ENCLOSED OUTDOOR SEATING AREA.

IT'S SHOWN HERE AT THE BOTTOM LEFT-HAND CORNER OF THE BUILDING.

IT'S GOING TO HAVE A WOOD BACKGROUND, UM, TO ACT AS A PHOTOGRAPH OPPORTUNITY FOR RESTAURANT GUESTS.

MOVING ON THE, UH, PREVIOUS RESTAURANT OPERATOR PIZZA REV DID OPERATE WITH A TIGHT 41 BEER AND WINE LICENSE.

UH, THE PROPERTY IS LOCATED WITHIN SIX IS TRACK 13.01 THAT WILL ASK FOR A TOTAL OF SEVEN ON SALE LICENSES BEFORE A LEVEL OF UNDUE CONCENTRATION IS REACHED.

AND THIS IS DETERMINED BY THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL.

UM, THERE ARE CURRENTLY SEVEN ACTIVE LICENSES, FIVE ARE OPERATING WITHIN THE SUBJECT CENTER.

THE REQUESTED CP WILL MAKE IT THE EIGHTH ON-SELL LICENSE PROVIDING FOR A LEVEL OF UNDUE CONCENTRATION.

THE APPLICANT WILL BE REQUIRED TO PROVIDE, UH, THE DEPARTMENT OF ALCOHOL, ALCOHOL BEVERAGE CONTROL WITH DATA TO SUPPORT A FINDING OF PUBLIC CONVENIENCE AND NECESSITY BEFORE THE TYPE 41

UM, THIS IS THE SAME PROCESS THAT THE FORMER OPERATOR HAD TO GO THROUGH.

UM, FOR PIZZA REV, THE PROPOSED PROJECT WILL INCLUDE THE SAME CONDITIONS OF APPROVAL THAT HAVE BEEN IMPOSED ON OTHER RESTAURANTS OPERATING WITHIN THE CITY.

AND, UH, ITEM TO NOTE IS THAT THE SUITE IS LOCATED WITHIN A 30 FOOT, OR IT'S LOCATED NEAR A 30 FOOT WIDE PERMANENT EASEMENT RIGHT AWAY OWNED BY THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA OR MWD, UH, IT'S LOCATED NEAR THE SUITES, UM, NORTHWESTERLY BUILDING CORNER.

UM, AND WD HAS REQUESTED THAT ANY IMPROVEMENTS LOCATED NEAR THE EASEMENT BE DESIGNED TO BE REMOVABLE SHOULD AND WD NEED TO GAIN ACCESS TO THAT EASEMENT.

UM, UH, CONDITION HAS BEEN INCLUDED ON THE RESTAURANTS DUP TO COMPLY WITH, UH, THE METROPOLITAN WATER DISTRICT'S REQUIREMENTS.

UM, FINALLY, THE APPLICANT HAS PROVIDED AN ADDENDUM TO THE APPROVED PARKING STUDY, UH, FOR THE CENTER AND IT CONCLUDES THAT THERE IS SUFFICIENT ONSITE PARKING TO SUPPORT THE OPERATION OF THE RESTAURANT.

UM, ALL THE REQUIRED FINDINGS CAN BE MADE IN SUPPORT OF THE PROJECT.

IT IS THEREFORE RECOMMENDED THAT THE PLANNING COMMISSION APPROVE CONDITIONS PERMIT 20 DASH 13 AND CONDITIONING'S PERMIT 20 DASH 14.

THE APPLICANT HAS REQUESTED TO OPERATE THE BUSINESS EVERY DAY AND FROM 8:00 AM TO 9:00 PM, CALIFORNIA GOVERNMENT CODE SECTION SIX EIGHT FIVE SIX FIVE EIGHT SIX FOUR THROUGH SIX FIVE EIGHT, SIX, NINE 25 ALLOWS CITIES TO ENTER INTO CONTRACTS OR AGREEMENTS WITH DEVELOPERS, WHICH LAYS OUT DEAL POINTS AND COMMITS THE DEVELOPER OR BUSINESS OWNER TO SPECIFIC REQUIREMENTS.
