DULY NOTICED PUBLIC HEARING TO CONSIDER ZONE CHANGE 20-03 AMENDING TITLE 18 ("ZONING") OF THE LA HABRA MUNICIPAL CODE (LHMC) BY ADDING CHAPTER 18.82 (“INCLUSIONARY HOUSING UNITS”) That the City Council: APPROVE FIRST READING OF ORDINANCE NO. ______ ENTITLED: AN ORDINANCE OF THE CITY OF LA HABRA APPROVING ZONE CHANGE 20-03 AMENDING TITLE 18 ("ZONING") OF THE LA HABRA MUNICIPAL CODE (LHMC) BY ADDING CHAPTER 18.82 ("INCLUSIONARY HOUSING UNITS") AS PER EXHIBIT “A” CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): The proposed amendments are exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA guidelines. On January 21, 2014, the City Council certified Environmental Impact Report 13-01 associated with the La Habra General Plan 2035, the 2014-2021 Housing Element Update, and the La Habra Climate Action Plan (CAP). The proposed action fulfills one of the stated goals of the La Habra General Plan 2035. The goals and policies discussed within this report were analyzed as part of the approved EIR and therefore no additional CEQA review is required. Any future improvement of potential development sites, subject to this proposal, will be required to be reviewed pursuant to the CEQA requirements at such time as development is considered.]

SO CAN YOU MOVE, UM, WE ARE PRESENTING TO YOU IN A PROPOSAL FOR A ZONE CHANGE 20 DASH ZERO THREE, WHICH WILL AMEND TITLE 18 TO CREATE A NEW SECTION, WHICH IS ENTITLED INCLUSIONARY HOUSING UNITS IN, UH, JANUARY OF 2014, THE CITY ADOPTED THE NEW GENERAL PLAN, UH, WITHIN THE GENERIC LAND CONTAINS POLICY GOALS, WHICH, UH, CONTROL THE DEVELOPMENT OF THE CITY.

AND SPECIFICALLY WITHIN THE GENERAL PLAN AND THE HOUSING IT PROGRAM WERE SPECIFIED THERE CALLED THE REQUIREMENTS THAT ANY INCLUSIONARY HOUSING ORDINANCE BE CONSIDERED BY THE, UM, BY THE CITY FOR A DOCTOR IN 1988, LEGISLATION REQUIRES THAT ASSOCIATIONS OR GOVERNMENTS FORECAST HOW THE NEEDS WITHIN THEIR RESPECTIVE AREAS.

THIS IS ALSO KNOWN AS A REGIONAL HOUSING NEEDS ASSESSMENT, WHICH WE CALL RENA FOR SHORT, NEW CYCLE BEGINS THIS YEAR IN PSYCHOPHYSICS.

AND OUR NUMBER FOR THAT RENA IS 800 FOR UNITS.

AND AS YOU CAN SEE ON THE CHART BELOW, IT'S BROKEN OUT BY AFFORDABILITY LEVELS AND BY NUMBER OF UNITS.

SO WE HAVE ABOVE MODERATE, MODERATE, LOW, AND VERY LOW, WELL, MANY CALIFORNIA CITIES HAVE TROUBLE.

THESE ARENAS, THERE ARE SOME PENALTIES FOR CITIES THAT DO NOT ATTEMPT TO MEET THOSE NUMBERS.

AND THERE'S SOME EXAMPLES LISTED ABOVE THE, FOR INSTANCE, THE CITY OF PLEASANTON AND THE CITY OF HUNTINGTON BEACH FOR BOTH SUED BY THE STATE OF CALIFORNIA FOR NOT ATTEMPTING TO BRING IN NUMBERS.

AND ANOTHER PENALTY THAT'S POSSIBLE IS WITHHOLDING OF GRANT MONEY.

SO IN THE PAST, THE CITY HAS TAKEN, UH, DIFFERENT, UH, PROCESSES FOR PROCESS, UH, TO, UM, PROCESS VERY CALVIN PROJECT.

AND THERE'S NOT BEEN A SET STANDARD FOR DOING THAT.

SO FOR INSTANCE, WE HAVE LISTED THREE PROJECTS HERE.

WE HAVE THE REAL PROJECT, WHICH WAS CONSTRUCTED TO THE SOUTH OF CITY HALL AND A CONDITION OF APPROVAL WAS, UM, PLACED IN THE PROJECT WHERE THERE'S A $2.3 MILLION IN LUCY.

ANOTHER PROJECT ON WALNUT STREET ALSO HAVING HIM AT $880,000.

AND THE THIRD LISTED PROJECT IS VALENCIA.

THIS IS AN APARTMENT PROJECT.

THERE WAS NO HOUSING FEE ASSESSED TO THIS PRODUCT.

HOWEVER, THE CITY THAT NEGOTIATED FOR $2 MILLION PARKED CONTRIBUTION SAY I CONDUCTED THE SURVEYS AND WE REACHED OUT TO THE VERTICES AND MORE ASTOUNDING.

AND AS YOU CAN SEE BY THE MAP SHOWN ABOVE EIGHT CITIES OUT OF A TOTAL OF 13 CITIES IN THE COUNTY OF HORNER'S UNCERTAIN 30 CITIES IN THE COUNTY

OF ORANGE, UM, HOW INCLUSIONARY HOUSING ORDINANCES.

SO THIS IS A VERY LOW NUMBER.

UM, I APOLOGIZE THAT COULD BE ALSO REACH OUT AND TALK TO THE BUILDING INDUSTRY ASSOCIATIONS AND THEIR DISCUSSIONS ABOUT THIS PROPOSED INCLUSIONARY HOUSING ORDINANCE VIA STATED THEIR OPPOSITION TO THE ORDINANCE.

AND THE REASON THEY FAILED IS BECAUSE WE BELIEVE IT'S AN UNFAIR BURDEN PLACED ON THE PRIVATE INDUSTRY AND THAT IT WOULD BE A DETERRENT TO BUILDING A HOME.

OKAY, WELL, IT'S, THE ORDINANCE IS SUCH, IT WOULD BE EFFECTIVE FOR PROJECTS THAT OPINIONS ARE HIGHER AND ORDINANCE THAT ARE PART OF IT.

50% OF UNITS BE MADE AFFORDABLE AND THERE'S , UM, FOR SALE WOULD BE A HUNDRED PERCENT, 110% OF THE MEETING.

AND IF IT'S A RENTAL PROJECT, THERE'S A BREAKDOWN OF 9% OF THE UNITS WOULD BE, UH, FOR MODERATE INCOME FAMILIES.

AND 6% OF THOSE UNITS WOULD BE FOR LOW OR VERY LOW INCOME.

UM, THERE'S A REQUIREMENT THAT YOU CAN PROVIDE AN ON OR OFF SITE, AND THERE'S AN AFFORDABILITY THAT'S REQUIRED THE PLACE PLACED ON THOSE PROJECTS AND THE, THE, UH, THE TIMING FOR THIS AND ABOUT 55 YEARS FOR THE REQUIREMENTS THAT THESE ARE BEING AFFORDABLE, THERE IS HOWEVER, AN OPTION TO DO AN INDOOR THEME.

THE THEME WOULD BE PAID TO THE CITY AND BANK BY THEIR HOUSING AUTHORITY FOR FUTURE USE.

AND YOU MOVE A FEE WOULD BE BASED OFF THE COST OF CONSTRUCTING AN ACTUAL UNIT IN THE PAST.

WE DO NOT HAVE THIS REQUIREMENT TO THE FEES AND THE, ON THE LOW SIDE, AND THIS WOULD ACTUALLY CODIFY IT AND MAKE IT MORE STANDARDIZED.

SO YOU COULDN'T PUT IT IN, UM, THE CONCLUSIONARY, HOW, HOW THE ORDERING FOR PROVIDERS, COULD YOU A NEW TOOL TO TRY TO, YOU KNOW, RENA NUMBERS AND INTERNALLY MEET THOSE DIFFERENT BREAKDOWNS OF THE FOUR BUILDING THAT'S REQUIRED.

IT ALSO STANDARDIZES THE A AND P WHICH WE HAVEN'T HAD IN THE PAST.

UM, SOUTH RECOMMENDED APPROVAL OF THEM CHANGE 20 DEATHS.

THERE ARE THREE STOUTS HAS HAD THEM, UM, INCLUDING HOW THE MORNING REVIEWED BY A CITY ATTORNEY WHO APPROVED THE LANGUAGE AND SEQUENCED THAT PRESENTATION.

UM, ON, UM, HAVE WE HEARD THOSE EIGHT CITIES THAT HAVE ADOPTED THIS? UH, HAVE WE GOT ANY FEEDBACK ON IF THERE'S BEEN ANY ADVERSE EFFECTS TO DEVELOP THOSE THINGS OR ANY CONCERNS THAT COME UP FROM THOSE EIGHT CITIES IN ORANGE COUNTY? YES, SIR.

SO FOR INSTANCE, STAFF AVAILABLE TO TALK TO THE CITY OF BREDA, BRIAN HAD NO ISSUES.

HOWEVER, THE CITY OF SANTA ANA, UM, THEY SENT IT TO US THAT THEY HAD, WHEN HE IMPLEMENTED THE PUSH IN HOUSING OWNERS, IT ACTUALLY STOPPED THE APPLICATION OF NEW HOUSING PERMITS.

UH, AND THEY, THE CITY COUNCIL HAS TO ADJUST THE AMOUNT THAT HE WOULD BE, WHICH, UM, WAS IN PLACE FOR A COUPLE OF YEARS.

AND WE DIDN'T NEED TO CHANGE ANY COMMUNITY PERMIT PAYMENTS.

WE ADOPT A HOUSING ELEMENT THAT COMPLIES WITH THE OTHER SIDE TO RENA WITHOUT INCLUSIONARY ZONING.

UH, YES, IT'S AN OPTION IT'S NOT REQUIRED TO BE APPROVED BY CITY COUNCIL IS TO SIMPLY STATE AND SEE A GENERAL PLAN THAT THE CITY COUNCIL CONSIDER ADOPTING.

THERE'S NO REQUIREMENT THAT THE CITY COUNCIL ADOPTED.

UM, I DO WANT TO ADD LANGUAGE INCLUDING HOW THEY WANTED THAT BE ADOPTED AT THIS TIME.

THERE'S THE ABILITY TO LOOK AT IT IN THREE YEARS FROM NOW, THERE'S A BUILT-IN MECHANISM THAT THE COUNCIL REVIEW THE, THE APPROPRIATENESS OF THE PUSHING OUT INTO HOUSING HOLDINGS EVERY THREE YEARS.

AND IF IT'S NECESSARY TO ADJUST IT OR, OR REMOVE IT, OR WHAT HAPPENED OVER WELL, LET'S SAY HYPOTHETICALLY, THERE'S A BUILDER RIGHT NOW IN DISCUSSIONS WITH THE PROPERTY OWNER TO PURCHASE PROPERTY, UM, TO DO SOME BUILDING.

AND A LOT OF TIMES THE CITY IN THE MIDDLE OF THE BOTTOM OF THE NIGHT CITY, WE ADOPT INCLUSIONARY ZONING, WHICH OBVIOUSLY SHOVES DOWN THE PRICE OF THE 2% OF THEIR UNITS.

WE'VE JUST OBVIOUSLY BLOWN UP THE, UP THE ECONOMICS OF THEIR DEALS.

SO WHAT IS THE TIMING OF IF WE WERE TO ADOPT THIS? I MEAN, I'M, I'M CONCERNED ABOUT RUINING THINGS THAT ARE KIND OF IN PROCESS RIGHT NOW UP THERE.

UH, HOW WILL THIS, WHAT WILL BE THE TIMING OF IT GOING INTO EFFECT AND HOW ARE WE SURE.

WE'RE NOT DESTROYING PEOPLE'S PROJECTS THAT ARE KIND OF ALREADY IN NEGOTIATION.

I HAVE A COUPLE OF .

ONE THING YOU HAVE SOME APPLICATIONS IN, AND THOSE WOULD NOT BE AFFECTED BY THIS CHANGE.

ALSO, IF THEY WERE TO SUBMIT VSP PRETTY 30, THAT WOULD LOCK THEM INTO CURRENT THE CURRENT REGULATION.

UM, ANOTHER OPTION WOULD BE TO CRANE FEATURE HATE WHEN ITS ABILITY TO AFFECT, IF YOU THOUGHT THAT WOULD BE APPROPRIATE.

UM, SO IT'S REALLY AT THE DISCRETION OF CITY COUNCIL, BUT APPLICATIONS WE HAVE IN PROCESS RIGHT NOW WILL NOT BE AFFECTED BY THIS CHANGE.

SHOULD THE COUNCIL ADOPT THIS INCLUSIONARY HOUSING? AND YOU'RE TALKING ABOUT PROJECTS THAT HAVE BEEN SAID ABOUT THE COUNTER, BUT I I'M TALKING ABOUT THE, MAYBE HAVEN'T REACHED THE CITY YET, BUT IT'S BETWEEN THE BUILDER AND THE PROPERTY OWNER.

THEY MAYBE BEEN TALKING ABOUT THEIR TERMS AND, AND WE'RE ABOUT TO SORT OF REACH OUT TO THEM ON THAT.

UM, SO I HAVE A CONCERN ABOUT THAT.

YES, SIR.

I UNDERSTAND.

UM, SO THERE IS A RISK THAT AS CHRIS INDICATED, UM, YOU KNOW, WHAT OPTION FOR COUNCIL B IF COUNCIL BE INTERESTED IN AN INCLUSIONARY HOUSING ORDINANCE THAT WE'RE BRINGING FORWARD TONIGHT IS, UH, ADDRESS SOME OF THOSE CONCERNS ALSO COULD MAKE THE ORDINANCE EFFECTIVE A CERTAIN FUTURE DATE, FOR INSTANCE, JULY 1ST OF THIS YEAR, JANUARY 1ST OF NEXT YEAR, WHICH SHOULD PROVIDE SUFFICIENT TIME.

THEN FOR SOME OF THE TRANSACTIONS THAT MIGHT BE IN NEGOTIATIONS TO GET APPLICATIONS INTO THE CITY, ONCE THOSE APPLICATIONS ARE FILED, THEN THERE, UH, YOU HAVE TO ABIDE BY THE RULES IN EFFECT AT THAT TIME.

AND THIS WOULDN'T BE IN EFFECT UNTIL WHATEVER DATE THE COUNCIL WOULD SET.
