MR. CHAIRMAN MEMBERS OF THE COMMISSION, THE STAFF REPORT THIS EVENING WILL BE PRESENTED BY ASSOCIATE PLANNER, DAVID LOPEZ, HONORABLE CHAIR AND COMMISSIONERS.

THIS EVENING.

WE HAVE A REQUEST THAT INVOLVES THE OPERATION OF AN AUTOMOBILE REPAIR FACILITY.

THE SUBJECT PROPERTY IS LOCATED AT THE NORTHEAST CORNER OF LA HOPPER BOULEVARD IN CYPRUS STREET.

IT IS LOCATED WITHIN THE LA HARBOR BOULEVARD SPECIFIC PLAN OR THE SP ONE ZONE.

IT'S A CORNER LOT IMPROVED WITH A 3060 SQUARE FOOT COMMERCIAL BUILDING WITH TWO BAY DOORS FACING THE HARBOR BOULEVARD AND A 640 SQUARE FOOT OFFICE BUILDING ON A 9,173 SQUARE FOOT LOT.

THERE'S A 17 AND A HALF FOOT WIDE ALLEY ALONG THE NORTHERN PROPERTY LINE THAT SEPARATES THE SUBJECT PROPERTY FROM THE ADJACENT RESIDENTIAL NEIGHBORHOOD.

THE OPERATION OF THE AUTOMOTIVE REPAIR FACILITY WAS ORIGINALLY ESTABLISHED IN 1963.

THE PROPERTY WAS FORMERLY UTILIZED BY FRANK'S X-RAY GARAGE, WHICH OPERATED FROM 1981 TO AUGUST OF 2020 FRANK'S X-RAY GARAGE CLOSED IN AUGUST OF 2020.

THEY HAD BEEN OPERATING AT THE SITE WITHOUT A CONDITIONAL USE PERMIT.

A NEW OPERATOR IS REQUESTING TO OPERATE A AUTOMOBILE OR AUTOMOTIVE REPAIR FACILITY FROM THE SUBJECT LOCATION THAT WILL INVOLVE GENERAL AUTOMOTIVE REPAIR SERVICES, INCLUDING, BUT NOT LIMITED TO OIL CHANGES.

TUNE-UPS TRANSMISSION REPAIRS.

THE FACILITY WILL HAVE TWO EMPLOYEES AND IT'S PROPOSED TO OPERATE MONDAY THROUGH SATURDAY FROM 9:00 AM TO 5:00 PM.

THE PROPOSED PROJECT IS BEFORE THE PLANNING COMMISSION PURSUANT TO TWO MUNICIPAL CODE SECTIONS.

THIS IS SECTION 18.0 6.0408 AND 1844 ZERO FIVE ZERO D ONE BOTH REQUIRE THE APPROVAL OF A CONDITIONAL USE PERMIT FOR ALL AUTOMOTIVE REPAIR USES WITHIN THE S ONE ZONE.

ALSO THE HARBOR BOULEVARD SPECIFIC PLAN HAS LANGUAGE THAT REQUIRES ALL EXISTING VEHICLE REPAIR USES WITHIN 10 YEARS.

AND THIS IS BEGINNING FROM DECEMBER SIX OF 1999.

WE'RE REQUIRED TO COMPLY WITH A SPECIFIC PLAN THAT SPECIFIES A CUP IS NEEDED FOR REPAIR USES.

SO THAT DATE WOULD HAVE BEEN DECEMBER SIX OF 2009.

STAFF HAS CONSULTED WITH THE CITY ATTORNEY'S OFFICE, WHICH CONCURS THAT THE MUNICIPAL CODE STANDARD THAT REQUIRES ALL EXISTING AUTOMOTIVE REPAIR FACILITIES TO OBTAIN A CUP IS STILL VALID AND ENFORCEABLE FOR THE INTERIOR OF THE BUILDING OR REMAIN AS IS NO ALTERATIONS ARE PROPOSED IN RESEARCHING THE PROPERTY RECORDS BETWEEN THE YEARS, 2000 TO THE 2017.

THERE ARE FIVE CODE ENFORCEMENT CASES FROM THE PREVIOUS USER, WHICH INCLUDED WINDOW ADVERTISEMENT, OVERGROWN VEGETATION, INADEQUATE LANDSCAPING, AND INOPERATIVE VEHICLES.

THE VIOLATIONS WERE ABATED AND THE OPERATION OF THE AUTOMOTIVE REPAIR FACILITY CONTINUED.

THERE IS A POSSIBILITY THAT THERE WERE OTHER VIOLATIONS, BUT THERE'S NO DIGITAL RECORDS FROM THE YEAR 2000 PRIOR.

AND IT SHOULD BE NOTED THAT THE UNPERMITTED VEHICLES THAT WERE ON THE SUBJECT PROPERTY HAVE BEEN REMOVED.

THE ONLY EXTERIOR MODIFICATIONS INVOLVE THE ADDITION OF POTTED PLANTS AND THE INSTALLATION OF WALL MOUNTED TRELLISES ON THE WEST-FACING WALL.

AND AS NOTED EARLIER, A CUP WAS NEVER PROCESSED OR OBTAINED FROM THE PREVIOUS BUSINESS OPERATOR.

THE LIBERAL ARTS SPECIFIC PLANS DIRECTION RELATED TO AUTOMOTIVE REPAIR FACILITIES IS TO PROTECT THE PUBLIC WELFARE,

NOT IMPAIR THE CHARACTER OF THE AREA AND FIND SUITABLE LOCATIONS FOR THEIR OPERATION.

THE SUBJECT PROPERTY IS UNIQUE AS IT BEGAN AS AN AUTOMOTIVE REPAIR FACILITY SINCE 1963 AND HAS BEEN USED EVER SINCE THE SUBJECT PROPERTY WILL BE IMPROVED WITH LANDSCAPING ALONG THE HARBOR BOULEVARD.

AND LET ME FIND MY, AND THAT WILL BEAUTIFY THE AREA AND THE CP INCLUDES CONDITIONS OF APPROVAL TO PROTECT THE PUBLIC WELFARE.

UH, THE CONDITIONS ACT AS A GUIDE FOR THE BUSINESS OPERATIONS AND AS A TOOL TO OBTAIN COMPLIANCE WITH NEEDED.

SOME OF THE CONDITIONS INCLUDE REQUIRING ALL AUTOMOTIVE REPAIR FACILITIES TO BE CONDUCTED WITHIN AN ENCLOSED BUILDING.

STORAGE OF INOPERATIVE VEHICLES ARE PROHIBITED.

THE DISPLAY MERCHANDISE OUTSIDE IS ALSO PROHIBITED.

AND THE HOURS OF OPERATION OF THE FACILITY ARE LIMITED BY THE SPECIFIC PLAN FROM 7:00 AM TO 7:00 PM.

ALL CONDITIONS ARE IDENTIFIED IN THE ATTACHED RESOLUTION WITH THE CUP AND THE ATTIC CONDITIONS.

STAFF HAS THE ABILITY TO MONITOR THE SITE AND KEEP A TRACK RECORD FOR COMPLIANCE VIOLATIONS OF THE CONDITIONS WILL BE GROUNDS FOR A POSSIBLE REHEARING WITH THE ATTIC CONDITIONS.

STAFF IS RECOMMENDING THE APPROVAL OF THE CONDITIONAL USE PERMIT.

I, WHEN I LOOKED AT THE LOCATION OVER MANY YEARS, BY LOOKING AT IT TODAY, WHEN, AND, AND LOOK AT THE, UH, THE SITE ITSELF AND NOTICE THE VEHICLES ARE GONE, THAT IT SEEMED LIKE THEY'D BEEN THERE FOR AS LONG AS I CAN REMEMBER.

THEY PARKED OUTSIDE AND PARKED ALL AROUND, BUT I NOTICED THAT THE BUILDING IS FULL OF CARS NOW WHERE THEY MOVE FROM THE OUTSIDE AND NOW THEY'RE BEING STORED INSIDE.

SO IT APPEARS THAT THAT WAS THE WAY TO RESOLVE REMOVING THE VEHICLES FROM THE OUTSIDE OF THE PROPERTY.

AND ARE THOSE WHO KNOWS, WHO DO THOSE VEHICLES, ARE THOSE CUSTOMER VEHICLES PRIOR CUSTOMER VEHICLES, OR I DON'T KNOW THE ANSWER TO WHO, WHO THE VEHICLES BELONG TO.

YEAH.

UM, THE, THE CODE ENFORCEMENT ISSUES, DID YOU INDICATE THERE THE CODE ENFORCEMENT ISSUES ARE STILL SUBJECT TO SOME SORT OF ADJUDICATION? ARE THEY, OR IS IT JUST LIKE WE, WE START FRESH NOW OR WHAT? YEAH.

I JUST WANTED TO PROVIDE A HISTORY OF FROM THE YEAR 2000 TO 2017 FOR THE PREVIOUS OPERATOR, THERE WERE ONLY FIVE CASES ON FILE.

UM, BUT THERE'S ALSO A POSSIBILITY THAT PRIOR TO 2000 THERE WERE OTHER CASES, BUT THEY WERE NEVER INCLUDED IN DIGITAL RECORDS.

UM, SINCE THIS IS A BRAND NEW OPERATOR, WE ARE STARTING FRESH AND WE WILL CONTINUE TO MONITOR THE SITE IN THE EVENT THAT EXCESSIVE VIOLATIONS ARE INCURRED OR CALLS FOR COMPLAINTS.

WE ARE KEEPING A LOG OF ALL THESE COMPLAINTS, AND WE HAVE THE ABILITY TO RECALL THE CUP AS A REHEARING, IF, IF ISSUES ARISE FROM THE OPERATION OF THE FACILITY.

SO IS WHO, WHO WHO'S OPERATING THIS WHO'S THE NEW PERSON, IS THAT, IS THAT THE SAME PEOPLE AGAIN? NO, THERE THERE'S A DIFFERENCE BETWEEN THE PROPERTY OWNER RECORD AND THE PROPOSE OPERATOR OR BUSINESS OPERATOR IT'S COMPLETELY DIFFERENT, COMPLETELY DIFFERENT, AND NO RELATIONSHIP TO THE, IN THE, UH, ON THE PRIOR OWNERS, MARSHALL FAMILY TRUSTS ARE THE ONES THAT ARE GOING TO BE OPERATING.

IT THEY'RE THE PROPERTY OWNERS AND THE OPERATOR IS A LOCAL OR AN EXISTING AUTOMOTIVE REPAIR FACILITY ON THE HARBOR BOULEVARD.

THEY'RE RELOCATING.

AND THAT'S WHO THAT'S, WHO'S LISTED ON THAT NOTARIZED STATEMENT THAT NO, THE NOTARIZE APPLICATION IS SPECIFICALLY JUST THE PROPERTY OWNER.

AND CAUSE LIKE MY COLLEAGUE SAID THEY WERE THERE NOW.
