ALL RIGHT.

AND LET ME JUST REITERATE THAT, THAT THIS PARTICULAR FORM OF PUBLIC COMMENT IS ONLY FOR MATTERS THAT HAVE NOTHING TO DO WITH WHAT'S ON THE AGENDA TONIGHT.

SO IF I SEE FOLKS IN THE AUDIENCE, IF YOU WANT TO TALK ABOUT WHAT'S ON THE AGENDA, THAT'S DURING THE PUBLIC HEARING PORTION OF THE MEETING THAT WOULDN'T BE NOW, THIS IS THE TIME TO TALK ABOUT ANYTHING ELSE.

THIS IS REPUBLIC COMMENTS, NOT ON THE AGENDA.

SO, BUT DURING THE PUBLIC HEARING, THAT'S WHEN YOU CAN SPEAK TO THAT, ALL RIGHT.

SEEING NOBODY ELSE WISHING TO SPEAK AT THIS TIME, WE'LL CLOSE THE PUBLIC COMMENTS, MOVE ON TO THE CONSENT CALENDAR.

ALL MATTERS ON A CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE AND WILL BE ENACTED BY ONE MOTION.

UNLESS THE COMMISSIONER CITY STAFF MEMBER, OR A MEMBER OF THE AUDIENCE REQUESTS, SEPARATE ACTION OR REMOVAL OF AN ITEM ROAD ITEMS WILL BE CONSIDERED FOLLOWING THE CONSENT CALENDAR PORTION OF THIS AGENDA.

DO ANY OF THE COMMISSIONERS WISH TO REMOVE AN ITEM? NO.

NO.

MICHELLE? YES, NO, NO.

THANK YOU.

UH, IS THERE ANYONE IN THE AUDIENCE WHO WISHES TO HAVE AN ITEM REMOVED? SEEING NAMI? I HAVE A MOTION, MR. CHAIR, WITHOUT OBJECTION.

I WOULD MOVE APPROVAL OF ITEMS ONE AND TWO.

I HAVE A QUESTION WITH RESPECT TO ITEM ONE.

UH, ANDREW, WE SEE THIS ALL THE TIME ON IT.

AND CAN YOU JUST FOR MY EDIFICATION, THIS IS SOMETHING MORE COUNCIL RELATED THAN OURS.

YEAH.

IT'S TYPICALLY A PLACEHOLDER AND WE'LL, WE'LL REACH OUT TO THE CITY CLERK'S OFFICE TO SEE IF WE CAN REMOVE THAT TEMPLATE FROM THE, UH, AGENDA ITEMS FOR PLANNING COMMISSION.

SO, SO REALLY IT'S UH, IT'S ITEM TWO THAT WE'RE MOVING FORWARD.

IS THAT CORRECT? CORRECT.

OKAY, GREAT.

WITHOUT OBJECTION, I WOULD MOVE APPROVAL OF ITEM TWO.

THANK YOU VERY MUCH.

IS THERE A SECOND? THIS IS VICE CHAIR.

MANLY A SECOND.

OKAY.

AND THEN THE COMMISSION WILL HEAR FROM THOSE IN OPPOSITION.

AFTER ALL IS SPOKEN, THE PUBLIC HEARING WILL BE CLOSED AND THE COMMISSION WILL DISCUSS THE MATTER AND TAKE ANY ACTION.

IT DEEMS APPROPRIATE.

COMMENTS MUST BE KEPT BRIEF NON-REPETITIVE AND PROFESSIONAL IN NATURE.

AND SO THE FIRST AND ONLY ITEM ON THE AGENDA TONIGHT IS CONSIDERATION OF A REQUEST FOR CONDITIONAL USE PERMIT TWO ZERO DASH TWO ONE TO OPERATE AN AUTOMOBILE REPAIR FACILITY AT FOUR ZERO ONE EAST LA HARBOR BOULEVARD.

MAY WE HAVE A STAFF REPORT PLEASE? YES.

MR. CHAIRMAN MEMBERS OF THE COMMISSION, THE STAFF REPORT THIS EVENING WILL BE PRESENTED BY ASSOCIATE PLANNER, DAVID LOPEZ, HONORABLE CHAIR AND COMMISSIONERS.

THIS EVENING.

WE HAVE A REQUEST THAT INVOLVES THE OPERATION OF AN AUTOMOBILE REPAIR FACILITY.

THE SUBJECT PROPERTY IS LOCATED AT THE NORTHEAST CORNER OF LA HOPPER BOULEVARD IN CYPRUS STREET.

IT IS LOCATED WITHIN THE LA HARBOR BOULEVARD SPECIFIC PLAN OR THE SP ONE ZONE.

IT'S A CORNER LOT IMPROVED WITH A 3060 SQUARE FOOT COMMERCIAL BUILDING WITH TWO BAY DOORS FACING THE HARBOR BOULEVARD AND A 640 SQUARE FOOT OFFICE BUILDING ON A 9,173 SQUARE FOOT LOT.

THERE'S A 17 AND A HALF FOOT WIDE ALLEY ALONG THE NORTHERN PROPERTY LINE THAT SEPARATES THE SUBJECT PROPERTY FROM THE ADJACENT RESIDENTIAL NEIGHBORHOOD.

THE OPERATION OF THE AUTOMOTIVE REPAIR FACILITY WAS ORIGINALLY ESTABLISHED IN 1963.

THE PROPERTY WAS FORMERLY UTILIZED BY FRANK'S X-RAY GARAGE, WHICH OPERATED FROM 1981 TO AUGUST OF 2020 FRANK'S X-RAY GARAGE CLOSED IN AUGUST OF 2020.

THEY HAD BEEN OPERATING AT THE SITE WITHOUT A CONDITIONAL USE PERMIT.

A NEW OPERATOR IS REQUESTING TO OPERATE A AUTOMOBILE OR AUTOMOTIVE REPAIR FACILITY FROM THE SUBJECT LOCATION THAT WILL INVOLVE GENERAL AUTOMOTIVE REPAIR SERVICES, INCLUDING, BUT NOT LIMITED TO OIL CHANGES.

TUNE-UPS TRANSMISSION REPAIRS.

THE FACILITY WILL HAVE TWO EMPLOYEES AND IT'S PROPOSED TO OPERATE MONDAY THROUGH SATURDAY FROM 9:00 AM TO 5:00 PM.

THE PROPOSED PROJECT IS BEFORE THE PLANNING COMMISSION PURSUANT TO TWO MUNICIPAL CODE SECTIONS.

THIS IS SECTION 18.0 6.0408 AND 1844 ZERO FIVE ZERO D ONE BOTH REQUIRE THE APPROVAL OF A CONDITIONAL USE PERMIT FOR ALL AUTOMOTIVE REPAIR USES WITHIN THE S ONE ZONE.

ALSO THE HARBOR BOULEVARD SPECIFIC PLAN HAS LANGUAGE THAT REQUIRES ALL EXISTING VEHICLE REPAIR USES WITHIN 10 YEARS.

AND THIS IS BEGINNING FROM DECEMBER SIX OF 1999.

WE'RE REQUIRED TO COMPLY WITH A SPECIFIC PLAN THAT SPECIFIES A CUP IS NEEDED FOR REPAIR USES.

SO THAT DATE WOULD HAVE BEEN DECEMBER SIX OF 2009.

STAFF HAS CONSULTED WITH THE CITY ATTORNEY'S OFFICE, WHICH CONCURS THAT THE MUNICIPAL CODE STANDARD THAT REQUIRES ALL EXISTING AUTOMOTIVE REPAIR FACILITIES TO OBTAIN A CUP IS STILL VALID AND ENFORCEABLE FOR THE INTERIOR OF THE BUILDING OR REMAIN AS IS NO ALTERATIONS ARE PROPOSED IN RESEARCHING THE PROPERTY RECORDS BETWEEN THE YEARS, 2000 TO THE 2017.

THERE ARE FIVE CODE ENFORCEMENT CASES FROM THE PREVIOUS USER, WHICH INCLUDED WINDOW ADVERTISEMENT, OVERGROWN VEGETATION, INADEQUATE LANDSCAPING, AND INOPERATIVE VEHICLES.

THE VIOLATIONS WERE ABATED AND THE OPERATION OF THE AUTOMOTIVE REPAIR FACILITY CONTINUED.

THERE IS A POSSIBILITY THAT THERE WERE OTHER VIOLATIONS, BUT THERE'S NO DIGITAL RECORDS FROM THE YEAR 2000 PRIOR.

AND IT SHOULD BE NOTED THAT THE UNPERMITTED VEHICLES THAT WERE ON THE SUBJECT PROPERTY HAVE BEEN REMOVED.

THE ONLY EXTERIOR MODIFICATIONS INVOLVE THE ADDITION OF POTTED PLANTS AND THE INSTALLATION OF WALL MOUNTED TRELLISES ON THE WEST-FACING WALL.

AND AS NOTED EARLIER, A CUP WAS NEVER PROCESSED OR OBTAINED FROM THE PREVIOUS BUSINESS OPERATOR.

THE LIBERAL ARTS SPECIFIC PLANS DIRECTION RELATED TO AUTOMOTIVE REPAIR FACILITIES IS TO PROTECT THE PUBLIC WELFARE,

[00:10:01]

NOT IMPAIR THE CHARACTER OF THE AREA AND FIND SUITABLE LOCATIONS FOR THEIR OPERATION.

THE SUBJECT PROPERTY IS UNIQUE AS IT BEGAN AS AN AUTOMOTIVE REPAIR FACILITY SINCE 1963 AND HAS BEEN USED EVER SINCE THE SUBJECT PROPERTY WILL BE IMPROVED WITH LANDSCAPING ALONG THE HARBOR BOULEVARD.

AND LET ME FIND MY, AND THAT WILL BEAUTIFY THE AREA AND THE CP INCLUDES CONDITIONS OF APPROVAL TO PROTECT THE PUBLIC WELFARE.

UH, THE CONDITIONS ACT AS A GUIDE FOR THE BUSINESS OPERATIONS AND AS A TOOL TO OBTAIN COMPLIANCE WITH NEEDED.

SOME OF THE CONDITIONS INCLUDE REQUIRING ALL AUTOMOTIVE REPAIR FACILITIES TO BE CONDUCTED WITHIN AN ENCLOSED BUILDING.

STORAGE OF INOPERATIVE VEHICLES ARE PROHIBITED.

THE DISPLAY MERCHANDISE OUTSIDE IS ALSO PROHIBITED.

AND THE HOURS OF OPERATION OF THE FACILITY ARE LIMITED BY THE SPECIFIC PLAN FROM 7:00 AM TO 7:00 PM.

ALL CONDITIONS ARE IDENTIFIED IN THE ATTACHED RESOLUTION WITH THE CUP AND THE ATTIC CONDITIONS.

STAFF HAS THE ABILITY TO MONITOR THE SITE AND KEEP A TRACK RECORD FOR COMPLIANCE VIOLATIONS OF THE CONDITIONS WILL BE GROUNDS FOR A POSSIBLE REHEARING WITH THE ATTIC CONDITIONS.

STAFF IS RECOMMENDING THE APPROVAL OF THE CONDITIONAL USE PERMIT.

THIS CONCLUDES MY PRESENTATION, AND I'LL BE HAPPY TO ANSWER ANY QUESTIONS.

THANK YOU VERY MUCH, DAVID.

UH, DO EITHER OF MY COLLEAGUES TO LEFT OR RIGHT.

HAVE ANY QUESTIONS OR STAFF? GO AHEAD HERE.

THANKS, DAVID.

THANKS FOR THE REPORTER.

I JUST HAVE A COUPLE OF QUESTION.

I, WHEN I LOOKED AT THE LOCATION OVER MANY YEARS, BY LOOKING AT IT TODAY, WHEN, AND, AND LOOK AT THE, UH, THE SITE ITSELF AND NOTICE THE VEHICLES ARE GONE, THAT IT SEEMED LIKE THEY'D BEEN THERE FOR AS LONG AS I CAN REMEMBER.

THEY PARKED OUTSIDE AND PARKED ALL AROUND, BUT I NOTICED THAT THE BUILDING IS FULL OF CARS NOW WHERE THEY MOVE FROM THE OUTSIDE AND NOW THEY'RE BEING STORED INSIDE.

SO IT APPEARS THAT THAT WAS THE WAY TO RESOLVE REMOVING THE VEHICLES FROM THE OUTSIDE OF THE PROPERTY.

AND ARE THOSE WHO KNOWS, WHO DO THOSE VEHICLES, ARE THOSE CUSTOMER VEHICLES PRIOR CUSTOMER VEHICLES, OR I DON'T KNOW THE ANSWER TO WHO, WHO THE VEHICLES BELONG TO.

YEAH.

UM, THE, THE CODE ENFORCEMENT ISSUES, DID YOU INDICATE THERE THE CODE ENFORCEMENT ISSUES ARE STILL SUBJECT TO SOME SORT OF ADJUDICATION? ARE THEY, OR IS IT JUST LIKE WE, WE START FRESH NOW OR WHAT? YEAH.

I JUST WANTED TO PROVIDE A HISTORY OF FROM THE YEAR 2000 TO 2017 FOR THE PREVIOUS OPERATOR, THERE WERE ONLY FIVE CASES ON FILE.

UM, BUT THERE'S ALSO A POSSIBILITY THAT PRIOR TO 2000 THERE WERE OTHER CASES, BUT THEY WERE NEVER INCLUDED IN DIGITAL RECORDS.

UM, SINCE THIS IS A BRAND NEW OPERATOR, WE ARE STARTING FRESH AND WE WILL CONTINUE TO MONITOR THE SITE IN THE EVENT THAT EXCESSIVE VIOLATIONS ARE INCURRED OR CALLS FOR COMPLAINTS.

WE ARE KEEPING A LOG OF ALL THESE COMPLAINTS, AND WE HAVE THE ABILITY TO RECALL THE CUP AS A REHEARING, IF, IF ISSUES ARISE FROM THE OPERATION OF THE FACILITY.

OKAY, GREAT.

I WAS OKAY.

I JUST, UH, ONE OTHER COUPLE OF QUESTIONS.

THE APPLICANT IS THE MARSHALL FAMILY TRUST.

SO, SO THE OWNER AND, AND LOOKING AT THE, UH, THE APPLICATION, THE NOTARIZED APPLICATION, THERE'S ONE NAME THERE, AND THEN THERE'S THE MARSHALL FAMILY TRUST.

AND THEN THERE'S A NEW OWNER, WHICH IS DIFFERENT THAN THE MARSHALL.

SO IS WHO, WHO WHO'S OPERATING THIS WHO'S THE NEW PERSON, IS THAT, IS THAT THE SAME PEOPLE AGAIN? NO, THERE THERE'S A DIFFERENCE BETWEEN THE PROPERTY OWNER RECORD AND THE PROPOSE OPERATOR OR BUSINESS OPERATOR IT'S COMPLETELY DIFFERENT, COMPLETELY DIFFERENT, AND NO RELATIONSHIP TO THE, IN THE, UH, ON THE PRIOR OWNERS, MARSHALL FAMILY TRUSTS ARE THE ONES THAT ARE GOING TO BE OPERATING.

IT THEY'RE THE PROPERTY OWNERS AND THE OPERATOR IS A LOCAL OR AN EXISTING AUTOMOTIVE REPAIR FACILITY ON THE HARBOR BOULEVARD.

THEY'RE RELOCATING.

AND THAT'S WHO THAT'S, WHO'S LISTED ON THAT NOTARIZED STATEMENT THAT NO, THE NOTARIZE APPLICATION IS SPECIFICALLY JUST THE PROPERTY OWNER.

THERE WAS A PROPERTY OWNER JUST APPLYING TO HAVE.

OKAY.

GOT IT.

OKAY, GOOD.

GOOD.

THANK YOU, MR CHAIR.

THANK YOU.

THANK YOU, MR. VICE CHAIR.

THANK YOU, COMMISSIONER.

BERNAY DO YOU HAVE ANY QUESTIONS STAFF? NO.

I HAD BASICALLY HAD THE SAME QUESTIONS.

JERRY DID.

SO THANK YOU FOR ASKING THIS YEAR.

I APPRECIATE IT.

VERY GOOD.

I HAVE NO QUESTIONS.

[00:15:01]

UH, WE WILL NOW OPEN THE PUBLIC HEARING BEFORE WE HEAR FROM SPEAKERS.

DO WE HAVE ANY EMAILS TO BE READ INTO THE RECORD, VERONICA? WE DO NOT.

THANK YOU.

WELL NOW HEAR FROM THOSE WHO WISH TO SPEAK IN FAVOR OF THE PROPOSED PROJECT.

IF YOU WISH TO SPEAK IN FAVOR, PLEASE COME TO THE PODIUM NOW AND ADDRESS THE COMING GOOD EVENING.

MY NAME IS CLIPPER DOBSON, D O B S O N.

AND I AM THE I'M THE HUSBAND OR THE TRUSTEE OF THE MARSHALL FAMILY TRUST.

I'M SORRY TO INTERRUPT, BUT ARE YOU, OR DO YOU LIVE IN THE HUB OR GET AN, CAN WE GET AN ADDRESS FROM YOU REAL QUICK? 96, 40 NIGHTINGALE.

AND I G H T I N G A L E AVENUE IN FOUNTAIN VALLEY, CALIFORNIA NINE TWO SEVEN OH EIGHT.

THANK YOU.

OKAY.

UM, THE PROPERTY HAS BEEN OWNED BY THE MARSHALL FAMILY TRUST IN EXCESS OF 50 YEARS.

UM, AGAIN, THE TENANT WAS FRANK'S X-RAY GARAGE, WHICH I THINK MOST OF YOU ARE FAMILIAR WITH THEM.

UH, THEY CEASED OPERATING THE BUSINESS ON SEPTEMBER 30TH OF 2020 BASED BOTH ON COVID AND ON HEALTH REASONS FROM FAINT FRANK AND HIS SON, DONALD, UM, SUBSEQUENT, OR EVEN PRIOR TO THAT, I HAD SECURED THE MELENDEZ FAMILY THAT CURRENTLY OPERATES A AUTO REPAIR FACILITY IN THE CITY OF LA HOPPER.

THIS WILL BE AN EXPANSION OF THEIR BUSINESS TO THAT LOCATION.

UM, AS DAVID HAS MENTIONED IS PRETTY MUCH 70 CONTINUOUS YEARS THAT THAT BUILDING HAS BEEN IN OPERATION.

UM, WE'RE ASKING NO CHANGES IN THE FOOTPRINT OF THE BUILDING.

WE WERE JUST ASKING THAT YOU ALLOW, WE WILL DO THE CORRECTIONS OR THE IMPROVEMENTS THAT STAFF HAS IDENTIFIED.

AND WE'RE JUST ASKING THAT YOU THEN ALLOW THE MELENDEZ TO GET A BUSINESS LICENSE FOR THIS OPERATION, WHICH HAS BEEN THE STUMBLING BLOCK.

THAT IS, YOU KNOW, WHY WE'RE HERE IS THEY HAVE BEEN UNABLE TO GET A BUSINESS LICENSE IN.

WE GUARDS TO THAT.

I WOULD ALSO ASK, I THINK THIS IS APPROPRIATE TIME.

WE'LL THROW IT ON THE AD ON THE TABLE IS THAT, UM, I'M COMMITTED TO MAKING THE IMPROVEMENTS.

I'VE WORKED EXTENSIVELY WITH DAVID FOR THE LAST SIX MONTHS ON GETTING TO THIS POINT.

WHAT I WOULD ASK THE COMMISSION IS UPON APPROVAL OF THE CUP IS THAT YOU DIRECT STAFF TO ALLOW THE MELENDEZ TO START OPERATING THE BUSINESS ON APRIL 1ST, BECAUSE THE IMPROVEMENTS CAN BE MADE SIMULTANEOUSLY WITH THE OPERATION OF THE BUSINESS.

WE DON'T FORESEE ANY ISSUES WITH THAT.

AGAIN, THE BUILDING HAS BEEN NO OPERATION FOR NOW SIX MONTHS AT THAT SITE, I'M HERE TO REALLY, I'M HERE TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.

THANK YOU VERY MUCH, MR. DOBSON, EITHER OF YOU GENTLEMEN, HAVE ANY QUESTIONS OF THE APPLICANT? I DO.

GO AHEAD.

THANK YOU.

UH, WHO DO THE CARS BELONG TO? THEY'RE ALL STORED IN THERE.

I'M UH, I, I, THE MELENDEZ FAMILY.

THEY'RE THE SO THIS IS FROM THEIR OTHER BUSINESS THEY'VE BEEN OPERATING.

THEY'VE MOVED THEM IN THERE, OR THIS IS, I WOULD ASSUME THAT, YEAH.

OKAY.

KRISHA BERNAY.

DID YOU HAVE ANY QUESTIONS OF THE SPEAKER? NO, NOT AT THIS TIME.

ALL RIGHT.

THANK YOU VERY MUCH, MR. DOBSON, WE APPRECIATE YOUR TIME.

IS THERE ANYONE ELSE WOULD LIKE TO SPEAK IN FAVOR OF THE PROPOSED PROJECT, PLEASE? STEP FORWARD TO THE PODIUM? NO.

SEEING ON.

IS THERE ANYBODY WHO'D LIKE TO SPEAK IN OPPOSITION TO THE PROPOSED PROJECT, PLEASE STEP UP, SIR.

AND REMEMBER IF YOU WOULD NAME AND ADDRESS.

MY FIRST NAME IS T H E R W A T.

THE LAST NAME IS B O K T O R.

I'M MOVED INTO LAHABRA.

WE LIVE IN ONE 22 NORTH CYPRESS STREET.

I AM THE PROPERTY.

IF YOU LOOK AT THE PICTURE PASSING THE ALLEYWAYS, IT IS IS THE, UM, DOUBLEX ONE MORE PROPERTY AFTER THAT.

AND THEN WE ARE THE HOUSE RIGHT AFTER THE VERY NORTH TRAVERTINE PASSING ONE TO THE THIRD PROPERTY, PASSING THE SHOP.

THAT'S OUR HOUSE.

AND WE'VE BEEN THERE SINCE MARCH OF THE YEAR, 2000.

SO IT'S ALMOST LIKE 20 YEARS OR MORE.

RIGHT NOW I HAVE SUFFERED GREATLY FROM MR. FRANK X-RAY GARAGE FOR ALL HIS JUNK CARS,

[00:20:01]

SITTING ON THE SHEETS TO BEGIN WITH ALL THE STUFF SITS.

AND THEN IN THE PARKING LOT OVERNIGHT, THAT AXIOM RELATES SO MUCH TRASH.

AND, UM, HOW DO YOU CALL, UM, ASK ALL THOSE HOMELESS PEOPLE TO COME AROUND, LOOK IN BETWEEN THE PARKING LOT BETWEEN THE LIQUOR STORE AND FOR MR. FRANK X-RAY GARAGE.

YOU SEE A LOT OF THINGS HAPPENING BY NIGHT.

AND I SEE THAT BECAUSE MOST OF THE TIME I GOT THIS LIQUOR STORE ACROSS THE STREET AND THIS LIQUOR STORE TOO, TO BUY SOME STUFF.

THIS IS NOT THE MAIN ISSUE.

THE MAIN ISSUE RIGHT HERE IS THEN USING, THAT'S BEEN CREATED BY THIS AUTOMOBILE SHOP FOR MANY, MANY YEARS, Z OCCUPIED THE PARKING STREETS WAS THEIR CARS AND ARE ALL THESE HOODS OPEN, NOT TO MENTION ALL THIS JUNK CLUNKER SITTING ALL AROUND.

NOT ONLY THAT I KNOW MR. MELINDA'S HIMSELF ALREADY, HE HAS ANOTHER SHOP RIGHT ACROSS FROM ACE HARDWARE, RIGHT AT THE CORNER OF, I BELIEVE THERE'S ANOTHER FACILITY THERE.

AND THERE IS A, LIKE A TIRE SHOP IS USED TO BE CALLED MEXICALI TOWERS.

AND THEN WHAT'S CALLED RIGHT NOW.

AND I WENT PERSONALLY THERE.

I HAVE MANY TIMES INCIDENT THAT I TRIED TO GET IN THIS LITTLE PARKING LOT TO GO TO THIS STORE, THE 99 CENT STORE FOR THIS KOREAN PEOPLE.

THERE IS NO WAY.

AND THE PARKING LOT IS A NIGHTMARE.

A NIGHTMARE, NOT TO MENTION THAT IF YOU GO TO HIS SHOP THERE SERIOUSLY, THERE IS NO FIT FOR THIS KIND OF MECHANIC SHOP IN THIS CITY.

WE'RE TRYING TO IMPROVE THE WHOLE ENTIRE COMMUNITY.

AND HE'S BRINGING ALL HIS JUNK STUFF TO THE CITY.

I DON'T, I REALLY DID TOTALLY DON'T SEE ANY PLACE FOR THIS MECHANIC SHOP IN THIS CITY HERE.

NOW THAT HINDERS THE INTEGRITY OF THE WHOLE COMMUNITY.

OKAY.

BEING A RESIDENTIAL COMMUNITY THE WHOLE ENTIRE SUMMER SEASON IS ESSENTIAL.

THE ONLY THING IN THE CORNER RIGHT THERE, THE FRANK X-RAY GARAGE, AND AT THE VERY END AT WHAT YEAR WAS THIS CALLED? PERFECT ORDER.

THAT'S ANOTHER NUISANCE.

BUT ANYWAY, NOW JUNK AUTOMOBILES THAT STAYS THERE ALL THE TIME, INVITING ALL THESE HOMELESS PEOPLE TO COME AROUND AND DO WHAT THEY NEED TO DO.

AND ONCE THE OLD, THE OLD, THIS PERSONAL, I HAVE SOME PICTURE TODAY, SHOW YOU, I GOT TODAY.

SOMEONE JUST GIVING LIKE A JUMPSTART TO A CAR FACING THE TRAFFIC.

HOW GOOD IS THAT FOR THE WHOLE THING? LET ALONE THIS SECTION OF CYPRESS STREET AND LAHABRA, AND ALL OF US KNOWS WHAT A DISASTER THAT WOULD HAPPEN ALL THE TIME.

THANK GOD FOR THE LITTLE LEFT LANE THAT BEEN CREATED LIKE A COUPLE OF YEARS AGO, WHEN THE ALLOW FOR US TO TURN LEFT SAFELY TO CYPRESS STREET, IMAGINE THAT YOU HAVE SO MUCH CARS AND ALL THESE CARS ARE GOING TO JAM AND HERE COMES SOMEONE JUST HITS YOU MANY TIMES, CHECK THIS CORNER, SIR, IF YOU DON'T BELIEVE ME, CHECK THIS CORNER, YOU KNOW, THIS THE MOST IMPORTANT THING FOR THE WHOLE ENTIRE THING, THIS MECHANIC SHOP WILL BRING OUR REAL ESTATE VALUE OF OUR HOMES DOWN.

NOT UP.

I'M NOT GONNA ALLOW THIS TO HAPPEN.

I'VE BEEN THERE FOR 20 SOME YEARS.

I INVESTED HUNDREDS OF THOUSANDS OF DOLLARS TO IMPROVE MY HOUSE.

I DON'T WANT TO SEE ENVIRONMENTAL HAZARDS AROUND MY HOUSE.

I REMEMBER THIS PLACE VERY WELL.

IS THERE IS NO PLACE FOR THIS MECHANIC SHOP IN THIS CITY, SIR, THE BEST LIST FOR HIM REALLY SERIOUSLY, SOMEWHERE IN TIJUANA FROM ALLOW ME TO SAY THAT.

I'M REALLY SORRY TO SAY THAT, BUT THAT'S EXACTLY WHAT IT IS.

YOU GIVE HIM A PERMIT YOU'RE ASKING FOR MORE TROUBLES.

THANK YOU FOR THIS.

ALL RIGHT, MR. BACH, TARA, THANK YOU VERY MUCH FOR TAKING THE TIME.

GENTLEMEN, ANY OTHER QUESTIONS OF HIM BEFORE CHRISTIAN? BERNIE? DID YOU HAVE ANYTHING YOU WANTED TO SAY TO THE SPEAKER? NO, BUT THANK YOU FOR BRINGING THAT TO OUR ATTENTION.

ALL RIGHT.

VERY GOOD.

UH, DO I SEE ANYONE ELSE WISHING TO SPEAK IN OPPOSITION? I DO NOT.

SO ON THAT BASIS, WE WILL NOW CLOSE THE PUBLIC HEARING AND I'LL CALL ON THE COMMISSIONERS TO DISCUSS THE PROJECT, OFFER ANY COMMENTS WHEN YOU WANT TO GO FIRST, ANYBODY I'M ALWAYS STARTING HERE.

I HAVE SOME QUESTIONS, DAVID, WITH RESPECT TO, UH, THE HISTORICAL BACKGROUND THERE, THERE ACTUALLY WERE CODE ENFORCEMENT ISSUES REASONABLY ASSOCIATED WITH THIS GENTLEMAN'S COMPLAINTS.

IS THAT AN ACCURATE REPRESENTATION AS OF 2017? THAT WAS THE LAST RECORDED, ACCORDING TO FORCING THE CASE ON THE PROPERTY.

AND THAT WAS FOR THE PREVIOUS, UH, BUSINESS OPERATOR AND, AND IN READING THE CONDITIONS THAT ARE ASSOCIATED, ONE, I, I HAVE TO DO MY COLLEAGUES.

I WOULD BE OPPOSED TO WAIVING ANY OF THE SUBJECT IMPROVEMENTS UNTIL THEY WERE COMPLETED AS PER THE, UH, THE APPLICATION OF THE, AS PER THE STAFF REPORT THAT, UH, DAVID LOPEZ HAS SUPPLIED US.

UM, THE, THE LONG AS I CAN BEAR, I'VE BEEN HERE SINCE 1966.

[00:25:02]

AND SOON AFTER THAT OPENED UP, I REMEMBER LOTS OF CARS OVER, OVER THE LAST 10 YEARS, FOR SURE.

BEING PARKED AT THAT LOCATION IN DIFFERENT PLACES, WHICH TENDS TO COOPERATE WITH THIS GENTLEMAN IS SAYING IN TERMS OF, OF, OF OPERATING THAT, DO YOU FEEL CONFIDENT THAT THE CONDITIONS THAT YOU HAVE ESTABLISHED IN, IN TERMS OF THE UPKEEP, IN TERMS OF THE USE OF ONLY INSIDE, THEY CAN STILL STORE THE VEHICLES THAT ARE UNDER REPAIR IN THE OPEN LOT? I WOULD ASSUME, RIGHT? YES.

THE, THE CONDITION WOULD ALLOW A VEHICLE TO REMAIN ONSITE WHILE IT'S BEING REPAIRED.

ONCE IT'S REPAIRED THE CONDITION STATES, NO VEHICLES CAN BE STORED OUTSIDE.

SO WE'VE INCLUDED IT AS MANY AS CONDITIONS TO TRY TO PROTECT THAT NEIGHBORHOOD, THE BUDDING NEIGHBORHOOD, THE APPEARANCE OF THE PROPERTY.

WE WERE WELL AWARE OF THE ISSUES OF THE PRIESTS OPERATORS.

SO WE WANT TO MAKE SURE WE GET IT RIGHT THIS TIME AND INCLUDE THE, UH, ACCURATE CONDITIONS ON THE PROPERTY.

OKAY.

WHAT ABOUT, WHAT ABOUT THE, THE PARKING OF THE, UH, VEHICLES THAT ARE UNDER REPAIR OR BEING STORED, UH, TAKING UP PARKING PLACES EITHER ON CYPRUS WILL CYPRESS PRIMARILY THE PARKING OFFSITE.

THERE ARE ACTUALLY NO CONDITIONS ASSOCIATED WITH PROHIBITING AN OPERATOR FROM PARKING OFFSITE THAT THE CONDITIONS PERMIT IS TIED TO THE LAND.

SO ALL CONDITIONS ARE TIED TO THE PROPERTY ONSITE.

RIGHT.

BUT, BUT THAT IS THE ASSUMPTION THAT WE'RE LOOKING AT WHEN I READ THIS, IS THAT ALL OF THEIR VEHICLES HAVE TO BE PARKED ON THEIR SITE.

THEY CAN'T BE USING THE THEORETICAL, THE NEIGHBORHOOD TO PARK ALL THEIR CARS.

THAT'S CORRECT.

YES.

AND, AND ALSO IF THERE'S OTHER SALES, THIS IS STRICTLY A CUP THAT SPEAKS TO THE ISSUE OF AUTOMOTIVE REPAIR.

IT'S NOT A DOLLAR STORE, IT'S NOT FOOD SALES, ALL OF THAT WOULD BE IN VIOLATION OF THE CUP SUBJECT TO RELOCATION THE CUP.

IS THAT CORRECT? AND BUSINESS? YEAH.

IF THERE'S ANY USE OR FUNCTION, THAT'S, THAT'S NOT WITHIN THE REALMS OF THIS UPP OR DESCRIBED IN THE CDP THAT CAN BE CONSIDERED AS A VIOLATION.

AND AS I READ IT, WE'RE, WE'RE TALKING ABOUT AUTOMOBILE REPAIR PARTS.

TUNE-UPS FIXING THE CAR AND STORING THE VEHICLE ONLY ON THE SITE.

THAT'S CORRECT, RIGHT? YES.

OKAY, GREAT.

THANK YOU.

UH, MR. CHAIR, SIR, DON'T SPEAK TO HIM.

OKAY.

MR. CHAIRMAN MEMBERS OF, UH, CUSHION AND MICHELLE WHO WERE AWAY, UH, I CAN SUPPORT THIS MYSELF, BUT I CANNOT SUPPORT A WAIVER OF NOT A COMPLIANT EXACTLY.

WITH A STAFF REPORT IN TERMS OF THEY'VE GOT TO COMPLY WITH EVERYTHING, UH, BEFORE THEY CAN START BUSINESS, IF THAT'S APRIL 1ST OR IF THAT'S APRIL 15TH OR IF THAT'S DOWN THE LINE.

UH, I WOULDN'T BE, I MEAN, WELL, UNLESS SOMEONE MAKES SENSE, UNLESS SOMEONE MAKES AN AMENDED MOTION THAT WOULDN'T BE CONSIDERED AT ANY RATE.

MR. VICE-CHAIR, ANY COMMENTS? THANK YOU, DAVID.

I'M CURIOUS LIKE WHAT THE, THE LEVEL OF ENFORCEABILITY THAT THE CITY WOULD HAVE IN REGARDS TO THE VEHICLES BEING STORED OUTSIDE, UM, AND, AND WHETHER THEY ARE, OR THEY ARE NOT, UM, COMPLETED REPAIRS.

I MEAN, THAT, THAT SEEMS REALLY GRAY.

WE, WE GET, WE COULD GET TO THE POINT TO ASK THE OPERATORS FOR INVOICES, ANYTHING THAT SHOWS WHETHER THERE'S A PENDING PART OR A PENDING REPAIR TO THAT LEVEL OF DETAIL.

SO WE CAN VERIFY WHICH VEHICLES ARE REALLY PENDING A REPAIR OR WHICH VEHICLES ARE BEING STORED.

SO WE CAN GET TO THAT LEVEL OF DETAIL IF NEEDED, AS FAR AS STREET PARKING GOES, UM, NEIGHBORHOOD PARKING, WHATEVER WE WANT TO CALL IT.

UM, IF I UNDERSTAND CORRECTLY, THE ENTIRE CITY IS SUBJECT TO THE OVERNIGHT PARKING REQUIREMENT, PERMIT REQUIREMENT, CORRECT? THAT'S CORRECT.

YES.

AND SO THIS AREA WOULD NOT BE, UH, IMMUNE FROM THAT THAT'S CORRECT.

MOST STREETS DO HAVE SIGNS THAT IDENTIFY STREET STREET SWEEPERS.

SO WHICH HOURS OF VEHICLE CAN'T EVEN BE PARKED ON THE STREET, EVEN WITH A EIGHT OVERNIGHT PARKING PERMIT.

SO THERE ARE THOSE LIMITATIONS.

OKAY.

TRYING TO, TRYING TO FORMULATE MY NEXT QUESTION,

[00:30:01]

BUT I CAN YIELD TO MICHELLE FOR THE TIME BEING IF THAT'S OKAY.

OKAY.

COMMISSIONER BERNAY ANY COMMENTS? UM, I WOULD AGREE WITH, UH, JERRY, I DON'T THINK THAT WE, UH, GO AHEAD WITH, UH, APRIL 1ST.

I THINK IT'S, LET'S GET EVERYTHING TAKEN CARE OF.

FIRST IS MY FEELING.

AND I'M ALSO CONCERNED ABOUT THOSE CARS THAT THEY JUST MOVED INTO THE BUILDING.

WHAT IF THEY JUST MOVED THEM OUT AGAIN AND, YOU KNOW, OCCUPY THE BUILDING, BUT THE NEW OWNERS AND WE STILL HAVE THIS PROBLEM WITH THESE CARS.

OKAY.

UM, DO YOU WANT TO ASK STAFF ANY QUESTIONS ABOUT THAT, MICHELLE OR, YEAH.

ANDREW, WHAT DO WE DO THAT? WHAT DO WE DO WITH THAT? UM, THERE'S A COUPLE OF OPTIONS THAT WE CAN PURSUE TONIGHT.

UH, ONE OPTION THAT THE COMMISSION MAY HAVE WOULD BE TO, UH, ASK THE APPLICANT TO COME UP, TO ADDRESS THE, THE VEHICLE SITUATION AND SEE IF HE WOULD VOLUNTARILY REMOVE THE VEHICLES PRIOR TO STARTING.

UH, THE OTHER OPTION THAT WE CAN PURSUE HIS STAFF COULD, UH, IF THE PROJECT IS, IS APPROVED OR NOT APPROVED TONIGHT, STAFF CAN MAKE CONTACT WITH THE PROPERTY OWNER AND OPERATOR, UH, TOMORROW AND OPEN A CODE ENFORCEMENT CASE TO ASK THEM TO REMOVE THE VEHICLES UNTIL THE SITE IS READY TO OPEN.

I LIKE THAT ONE.

I'D BE HAPPY WITH THAT ONE.

CAUSE I'M CONCERNED.

I'M REALLY LISTENING TO THE GENTLEMAN THAT CAME UP AS A RESIDENT AND WE DON'T WANT TO CONTINUE A PROBLEM THAT'S ALREADY BEEN, AND YES, IT IS A NEW OWNER, BUT I'M CONCERNED THAT WE'RE GOING TO HAVE THE SAME PROBLEM AGAIN.

SO I, I THINK I LIKED YOUR SECOND OPTION.

UH, CAN I SHARE RENEE IF YOU LIKE, WHAT WE CAN DO REAL QUICK IS BEFORE, UM, VICE-CHAIR FINISHES, WE CAN ASK EITHER MR. DOBSON OR ONE OF THE MELENDEZ BROTHERS TO STEP UP BRIEFLY, OF COURSE, AND ADDRESS THE POINTS THAT YOU'RE HEARING FROM THE OTHER COMMISSIONERS.

WOULD ONE OF YOU GENTLEMEN, LIKE TO, TO, TO STEP TO THE PODIUM AND TALK ABOUT THOSE CARS? WELL, WHOEVER'S, WHOEVER'S THE BEST SPEAKER AND GIVE US YOUR NAME TOO, PLEASE ADDRESS.

UM, MY NAME IS ANGEL MELENDEZ AND G O MELENDEZ, M E L E N D Z.

I LIVE AT 1750 WEST LAMBERT ROAD IN THE HARBOR.

THANK YOU.

AND IF YOU WOULD JUST KINDA ADDRESS THIS ISSUE THAT THE COMMISSIONERS ARE BRINGING UP WITH REGARD TO THE CARS AND THE PARKING AND THE INSIDE, OUTSIDE THAT SORT OF STUFF.

YEAH.

UM, MY DAD, MY FATHER HAS BEEN HERE LIKE 21, MR. CHAIRMAN.

HE NEEDS TO SPEAK INTO THE SCREEN A LITTLE CLOSER, BUT MY FATHER HAS BEEN HERE FOR 21 YEARS OLD AT A SHOP OR HERE DOWN BY THE STORE.

AND I RESPECT HER DECISION AND I RESPECT YOU GUYS' DECISION TOO, YOU KNOW, WHATEVER YOU GUYS PLAN TO DO.

UM, WHAT DO YOU GUYS, YOU KNOW, I'M 21 YEARS OLD AND MY DAD'S TRYING TO GROW OUR BUSINESS.

YOU KNOW, I'M TRYING TO SUCCEED IN LIFE.

I'M A YOUNG KID, YOU KNOW, AND I, IF, IF YOU GUYS GIVE ME AN OPPORTUNITY, YOU KNOW, I'M TRYING TO SHOW YOU GUYS, YOU KNOW, I THINK, AND I DON'T WANT TO CUT YOU OFF NECESSARILY, BUT I THINK WHAT SOME OF THE COMMISSIONERS ARE LOOKING FOR IS A PLEDGE FROM YOU TO ABIDE BY THE CONDITIONS OF THE USE PERMIT WITH REGARD TO THE PARKING OF THE CARS, NOT BEING OUTSIDE, BEING PARKED INSIDE THIS SORT OF THING.

AND MY COLLEAGUES CAN, CAN FLESH THAT OUT FURTHER.

I'M NOT DESCRIBING IT, BUT WE KNOW THAT YOU'RE, YOU'RE, I'M SURE YOU'RE A GREAT GUY AND WE WISH YOU LUCK.

BUT I THINK THAT THERE'S THIS ISSUE THAT WE WANT IT TO HEAR YOU TALK ABOUT WITH REGARD TO THE CARS YOU SEE.

OKAY.

YEAH.

UH, SO ABOUT THE CARS, DO YOURS, OR TRY AND SAY THAT YOU GUYS DON'T WANT THE CARS TO BE PARKED OUTSIDE IN THE LOT.

WHAT ARE YOU GUYS TRYING TO EXPLAIN TO ME? CAUSE HE WAS SAYING ON CYPRESS STREET, YOU CAN'T HAVE CARS PARKED ON THE SIDE.

RIGHT? I JUST NEED MORE EXPLANATION.

I'M NOT, I'M NOT, I DON'T REALLY COMPREHEND IT.

WELL, JERRY, WHEN YOU BROUGHT THE POINT UP, WHY DON'T YOU OR JASON? YEAH, I THINK THE CONCERN IS ANGEL.

UM, JUST WITH VEHICLES STAIN ON THE LOT FOR, YOU KNOW, SEVERAL DAYS, WEEKS, MONTHS AT A TIME.

AND, AND THOSE VEHICLES, PRESUMABLY BEING REPAIRS, COMPLETED REPAIRS, NEVER STARTED VEHICLES ABANDONED.

AND THOSE VEHICLES JUST KIND OF STAY IN THERE FOR A LONG PERIOD OF TIME.

AND, AND I THINK THAT'S A CONCERN.

UM, I, I KNOW TO THE GENTLEMAN WHO IS A RESIDENT THERE AND THEN TO THE REST OF THE COMMUNITY AS WELL.

SO IF YOU COULD JUST, UH, LET US KNOW WHAT YOUR PLAN IS WITH THOSE VEHICLES GOING FORWARD.

AND CAUSE LIKE MY COLLEAGUE SAID THEY WERE THERE NOW.

IT SEEMS LIKE THEY'RE INSIDE.

IF THE, UH, THE CONDITIONAL USE PERMIT IS APPROVED BY THE COMMISSION, UM, AS SOON AS YOU GUYS TAKE OPERATION OF THAT BUSINESS, ARE THOSE VEHICLES JUST GOING TO REAPPEAR AND BE AN EYESORE FOR THE COMMUNITY FOR THE NEXT SEVERAL WEEKS MONTHS UNTIL THE CITY HAS TO BEGIN ENFORCING THAT? OR DO YOU HAVE A DIFFERENT PLAN? I HAVE A DIFFERENT PLAN ON MY PLAN IS, DO YOU KNOW HOW YOU GUYS WERE SAYING, YOU KNOW, GET IN, GET WHAT I HAVE TO GET DONE.

AND I CALL MY CALL MY CLIENT, COME PICK UP THE CAR.

YOU KNOW, I DON'T WANT TO HAVE NO PROBLEMS WITH NOBODY.

YOU KNOW, LIKE HOW YOU GUYS ARE SAYING, I'M GONNA RESPECT YOU GUYS DECISION AND THE CITY DECISION.

AND THAT'S WHAT I'M TRYING TO DO.

YOU KNOW,

[00:35:01]

I'M TRYING TO WORK WITH YOU GUYS.

SO I DON'T BE ON THE BAD SIDE.

YOU KNOW, I'M JUST TRYING TO GET THE CARS IN AND GET THE CARS OUT.

THAT'S ABOUT IT.

YOU KNOW? SO YOU UNDERSTAND THE CONCERN OF THE COMMISSION THAT THESE CARS NOT LINGER ON THE PROPERTY PAST THE POINT OF THEIR REPAIR.

I MEAN THAT YOU GET KIND OF WHAT THE COMMISSION'S CONCERNED ABOUT, RIGHT.

THAT IN-CAR STORED OUTSIDE FOR LENGTHY PERIODS OF TIME LONG AFTER THE REPAIRS BEEN COMPLETED.

SO AT, UH, AT THE OTHER SHOP RIGHT NOW, WE'RE AT TWO, THAT'S THE MAIN THING ABOUT US.

SO WE, WE CAN'T HAVE CARS OVER LIKE PAST THREE, FOUR NIGHTS THERE.

CAUSE THEY'LL SIT, THEY'LL COME DOWN TO US AND TELL US, OH, YOU HAVE TO GET THOSE OUT OF HERE.

AND WE BUY, THAT'S BEEN THERE FOR 20 YEARS.

SO HE WHAT'S GOING ON WITH THAT, YOU KNOW? UM, I RESPECT AND ALL THAT STUFF.

ALL RIGHT.

IT'S CAN I GO BACK TO MICHELLE REAL QUICK? OR DID YOU WANT TO, I'M GOING TO SEE IF MICHELLE HAS ANY QUESTIONS.

OKAY, CHRIS YOU'RE I'M GOOD.

YEAH, I'M GOOD.

DAN.

I THINK HE, I THINK HE UNDERSTANDS WHAT WE'RE TALKING ABOUT.

MY CONCERN IS LIKE THE RESIDENCE, CYPRESS STREET, THE ALLEYWAY, NO DUMPING.

AND LET'S GET ALL THOSE CARS OFF THAT LOCK AND START OVER.

SO I THINK WE'RE GOOD WHERE HE, HE, I THINK HE HEARD US.

OKAY, GOOD.

THANK YOU.

UH, ANY FINAL FOLLOWUP, VICE VICE-CHAIR, WHICH, WHICH WAY DOES THE REST OF THE COMMISSION WANT TO GO? UH, IN TERMS OF THAT ISSUE? UM, ARE WE COMFORTABLE DAGGY MR. MELENDEZ, BY THE WAY, SORRY, YOU KNOW, WHATEVER THE DECISION IS, IF THE, IF THE PERMIT WAS TO BE APPROVED BY THE COMMISSION THAT TOMORROW THE CITY JUST BEGINS ENFORCING THAT OR MR. CHAIR, POINT OF ORDER.

YEAH.

TH THIS WHATEVER ACTION THE COMMISSION TAKES THIS EVENING DOES NOT BECOME OFFICIAL AND FINAL UNTIL 10 WORKING DAYS, WHICH IS APRIL THE SEVENTH, UNLESS APPROVED THIS PRIOR TO APRIL THE SEVENTH, ANY VIOLATION OF THE CODE THAT'S OUT THERE, YOU KNOW, THEY CAN BE CITED FOR THAT ERROR, REGARDLESS OF THE CONDITIONAL USE PERMIT CONDITION.

IT MIGHT BE HELPFUL FOR ME JUST TO JUMP IN AND SAY THAT FROM, FROM MY POSITION, I'M SATISFIED WITH THE, UH, WITH THE STRENGTH OF THE CUP REQUIREMENTS.

I'M THINKING THAT, UH, UM, STAFF IS ON THIS AND IS GOING TO ENFORCE AND MONITOR THE SITUATION I'M COMFORTABLE WITH EVERY PART OF THE CUP.

SO, I MEAN, I PERSONALLY, WON'T BE MAKING A MOTION TO AMEND IT ANYWAY, SO I'M GOOD WITH THAT AS WELL.

YEAH.

WE'RE ALL GOOD.

ARE YOU DONE? GO AHEAD.

SURE.

GREAT.

THANK YOU.

UH, I, I, UH, CONCUR WITH MY COLLEAGUE, UH, UH, CHAIRMAN ASERION, UH, JUST FROM MY OBSERVATIONS, UH, OF THAT AREA.

AND I'M SPEAKING DIRECTLY TO THE FAMILY, TRASH IN THE ALLEY HAS BEEN AN ISSUE, UH, FOR AS LONG AS I CAN REMEMBER.

THEY'VE BEEN THE VEHICLES PARKED THERE, UH, THAT WERE EITHER ABANDONED OR ARE IN DIFFERENT STATES OF REPAIR AND STORED.

I SEE THEM INSIDE NOW, AS I WENT, LOOKED TODAY MYSELF, JUST TO SEE THEY WEREN'T THERE NOW, THEY'RE, THEY'RE PARKED THERE.

SECONDLY, UH, IF THIS IS AN, UH, A LOCATION FOR A USED CAR, LOT WHERE, WHERE YOU'RE SELLING OTHER THINGS, WHETHER IT BE CARS OR PARTS OR ANYTHING ELSE, AND ALSO OUR COMMUNITY MEMBER THAT SPOKE HERE ABOUT THINGS THAT GO ON AFTER DARK.

THIS IS A LEGITIMATE BUSINESS.

YOU'RE A YOUNG MAN WANTING TO GET STARTED.

UH, I JUST STRONGLY URGE YOU, UH, BECAUSE I'D BE THE FIRST ONE TO LET CODE ENFORCEMENT KNOW MYSELF.

AND, AND IF I SAW IT BECAUSE I LIVE CLOSE BY, I WOULD SIMPLY WITHOUT, WITHOUT QUESTION, UH, SUPPORT, UH, THE NEIGHBORHOOD IN TERMS OF INITIATING A CODE ENFORCEMENT, DOING WHATEVER IT TAKES TO GET THIS INTO COMPLIANCE COMPLETELY.

SO JUST AS LONG AS, YOU KNOW, UH, I CAN SUPPORT WHAT MY COLLEAGUES HAVE SAID.

HOWEVER, I AM, UH, I AM ALL ABOUT SUPPORTING WHAT THE COMMUNITY SAYS ABOUT THE VEHICLES, THE TRASH OTHER THINGS GOING ON, UH, IN THAT PARTICULAR AREA.

SO WITHOUT A YIELD BACK BY TIME, THANK YOU.

UNLESS THERE'S ANYTHING FINAL, UH, I'LL ENTERTAIN A MOTION.

OKAY.

I'LL MAKE A MOTION THAT THE PLANNING COMMISSION APPROVE A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ALHAMBRA APPROVING CONDITIONAL USE PERMIT 20 DASH 21 TO ESTABLISH AN AUTOMOTIVE AUTOMOBILE REPAIR FACILITY AT FOUR OH ONE EAST LA HARBOR BOULEVARD, MAKING THE APPROPRIATE FINDINGS AS PER THE APPROVED PLANS AND SUBJECT TO CONDUCT.

THANK YOU.

I WISH I WAS THERE WITH YOU.

HOPE TO SEE YOU SOON.

ALL RIGHT.

THAT'S YOUR PROBLEM.

IF I SHARE, HEY, I'M HAPPY FOR YOU THAT YOU CAN GROW YOUR BUSINESS IN THIS WAY.

UM, I WOULD ECHO MY COLLEAGUES AND JUST THE EXPECTATIONS THAT I KNOW THE CITY HAS OF IN DOING SO, ESPECIALLY THE PROPERTY OWNER AS WELL.

I DON'T THINK, UH, YOU KNOW, YOU'RE IMMUNE FROM ANY OF THAT AS WELL.

UM, I KNOW THAT IT'S BEEN A, UH, UH, A PROPERTY OF, OF SORE SUBJECT AND SORE EYES FOR, FOR MANY, MANY YEARS.

UM, AND HOPEFULLY THAT, UH, HAS BEEN RESOLVED AND IS ON A GOOD PATH TONIGHT.

AND I'M LOOKING FORWARD TO, UH, THAT OPPORTUNITY FOR YOU.

OKAY.

I'LL SAY GOOD LUCK TO YOU TOO.

JUST DO YOUR VERY BEST TO MAKE SURE YOU STAY COMPLIANT.

THAT'S WHAT WE'RE LOOKING FOR.

SO THANKS FOR THAT IN ADVANCE.
