THAT'S WHY YOU MIGHT BE HEARING A VOICE THAT SOUNDS LIKE IT'S COMING FROM HEAVEN.

UM, SO AT THIS TIME, MR. LOPEZ WILL PRESENT THE, UH, STAFF REPORT FOR THIS ITEM.

GOOD EVENING, CHAIRMAN AND COMMISSIONERS.

THE SUBJECT PROPERTY IS A CORNER LOT LOCATED AT THE NORTHEAST CORNER OF HILLSIDE STREET AND LA PRESA DRIVE.

THE PROPERTY HAS A ZONING DESIGNATION OF R ONE B ONE FAMILY DWELLING BASED ON THE ZONING CODE.

THE FRONTAGE OF THE PROPERTY IS DETERMINED BY THE SHORTEST FRONTAGE FOR THIS PARTICULAR CASE, THAT WOULD BE ALONG THE PRESSER DRIVE OR ALONG THE SOUTHERN PROPERTY LINE.

THE PROPOSED SWIMMING POOL AND RETAINING WALL WILL BE CONSTRUCTED NEAR THE SOUTHEAST CORNER OF THE PROPERTY NEAR LOPRESSOR DRIVE FRONTAGE.

THE DWELLING UNIT IS SITUATED AT A HIGHER GRADE THAN THE CITY SIDEWALK ALONG THE FRONT OF THE PROPERTY, UH, WHICH SLOPES DOWN TOWARDS THE CITY SIDEWALK, PHOTOGRAPHS ARE TAKEN.

UH, THIS IS LOOKING, UH, EAST AND WEST ALONG THE PRESA DRIVE WHERE THE PROPOSED RETAINING WALL, UH, WILL BE CONSTRUCTED.

SO THE PROJECT INCLUDES THE CONSTRUCTION OF A RETAINING WALL NEAR THE SOUTHERLY PROPERTY LINE, WHICH WILL BE SET BACK FOUR FEET FROM THE BACK EDGE OF THE SIDEWALK ONTO PRIVATE PROPERTY.

THE RETAINING WALL WILL BE APPROXIMATELY SEVEN AND A HALF FEET TALL WITH A FIVE FOOT VINYL FENCE ON TOP FOR AN OVERALL HEIGHT OF 12 FEET, SIX INCHES.

THE PROPOSAL WALL IS, UH, DESIGNED TO NOT OBSTRUCT ANY VIEWS OR CREATE LINE OF SIGHT ISSUES AS THERE'S NO WALKWAYS OR DRIVEWAYS WITH THE ADJACENT PROPERTY OR ANY OTHER IMPROVEMENTS THAT WOULD CAUSE LINE OF SIGHT ISSUES ALONG THE PRESSER DRIVE THE RETAINING WALL.

WE'LL BEGIN AT THE SOUTHEAST CORNER OF THE PROPERTY, APPROXIMATELY 47 LINEAL FEET.

THE WALL WILL BE SET BACK 38 FEET FROM THE WESTERLY PROPERTY LINE, PROVIDING SUFFICIENT VISIBILITY FOR PEDESTRIAN AND VEHICLE TRAFFIC ALONG HILLSIDE STREET.

THE SWIMMING POOL WILL BE CONSTRUCTED NEAR THE SOUTHEAST CORNER OF THE PROPERTY.

UH, THE POOL IS RECTANGULAR IN SHAPE AND MEASURES 32 FEET LONG BY 16 FEET IN WIDTH.

UM, IT WOULD BE CONSTRUCTED NINE AND A HALF FEET FROM THE SOUTHERLY PROPERTY LINE AND FIVE FEET FROM THE EASTERLY PROPERTY LINE.

THEY PULL EQUIPMENT WILL BE LOCATED AGAINST THE DWELLING UNIT.

THE PROPERTY CONTAINS A SIX FOOT WIDE, UH, SOUTHERN CALIFORNIA EDISON EASEMENT LOCATED ALONG THE EASTERLY PROPERTY LINE.

UH, THE PROPOSED SWIMMING POOL BE ENCROACHING 12 INCHES INTO THE SCE EASEMENT AS WELL AS THE PROPOSED RETAINING WALL.

UM, THE HOMEOWNERS HAVE OBTAINED AN ENCROACHMENT AGREEMENT FROM SOUTHERN CALIFORNIA EDISON AND IT WAS APPROVED AND RECORDED WITH THE COUNTY ON AUGUST 7TH OF 2020.

THE VARIANCES REQUIRED TO ALLOW FOR THE CONSTRUCTION OF THE RETAINING WALL, WHICH WILL EXCEED THE THREE FOOT HEIGHT LIMIT AND FOR THE CONSTRUCTION OF THE SWIMMING POOL WITHIN THE FRONT SETBACK, THE EXTRA ORDINARY CIRCUMSTANCES TO SUPPORT THE VARIANTS INCLUDE THE PROPERTY'S LOCATION, ITS CONFIGURATION AND TOPOGRAPHY.

IT'S A CORNER LOT WITH A GREAT DIFFERENCE OF SEVEN TO EIGHT FEET.

THIS CREATES A HARDSHIP WHEN COMPARED TO A TYPICAL LEVEL INTERIOR LOT, THE PROPOSED IMPROVEMENTS WILL BE CONTAINED ONSITE.

THEY WILL NOT CAUSE ANY, UH, VIEWS, UH, OBSTRUCTIONS OR CREATE LINE OF SIGHT ISSUES.

THEREFORE STAFF RECOMMENDS APPROVAL OF ZONE VARIANTS 2102.

IS THERE GOING TO BE A CURB OR SOMETHING SO WE CAN PREVENT THIS FROM HAPPENING.

WE ACTUALLY INCLUDED A CONDITIONER APPROVAL FOR THE PLANTING OF VINES OR SHRUBS IN FRONT OF THE RETAINING WALL FOR IT TO SUSTAIN SOME OF THE SLOPE AND ALSO PROVIDE A GREEN SCREEN OVER TIME.

UH, THEIR, THEIR SLIP WOULD HAVE TO BE MAINTAINED OR RETAINED TO MAINTAIN THE SIDEWALK CLEAR AT ALL TIMES.

AND FOR THE SEVEN AND A HALF FOOT RETAINING WALL, THAT'S SEVEN AND A HALF FEET ABOVE GRADE.

WE HAVE BEEN LONG TIME RESIDENTS OF LAHABRA, BUT FOR MANY YEARS, WE WERE NEVER IN A POSITION TO BE ABLE TO BUY A HOME.

AND EVENTUALLY WE WERE ABLE TO BUY THAT HOUSE.

AND WE LIVED IN THAT HOUSE MANY YEARS BEFORE WE WERE IN A POSITION TO CONSIDER BEING ABLE TO UPGRADE OUR BACKYARD IN ANY WAY TO MAKE ANY IMPROVEMENTS.

AND WE DIDN'T KNOW ABOUT THE UNIQUE CIRCUMSTANCES OF OUR LOT AND SOME PEOPLE THAT KNOW US THAT KNOW WE'RE LOOKING INTO TRYING TO DO THIS, HAVE ASKED US WHY DON'T WE JUST MOVE TO ANOTHER HOUSE OR MOVE TO A HOUSE THAT ALREADY HAS A POOL OR MOVE TO A HOUSE WHERE WE DON'T HAVE THESE UNIQUE CIRCUMSTANCES.

AND MY ANSWER WAS ALWAYS PRETTY SIMPLE AT THIS POINT THAT ISN'T JUST A HOUSE TO US ANYMORE.

IT'S OUR HOME.

WE'VE LIVED THERE FOR A LONG TIME.

NOW IT'S THE ONLY HOME THAT MY CHILDREN KNOW.

SO WE WOULD JUST LIKE THE OPPORTUNITY TO BE ABLE TO BE GRANTED THE VARIANCE SO THAT WE ARE ALLOWED THE SAME OPPORTUNITY TO MAKE USE OF OUR LAND AND OUR PROPERTY IN THE SAME MANNER THAT OTHER PROPERTY OWNERS IN THE AREA ARE ABLE TO DO.

AND ALSO REGARDING THE, THE SIDEWALK ISSUE.

I DID NOTICE THAT IT IS GOING INTO THE SIDEWALK.

WE TRY TO, UM, EDGE, WE DO THE YARD WORK OURSELF.

MY NAME IS CHRIS JOHANSON AND WORK IN THE PUBLIC WORKS DEPARTMENT HERE AT THE CITY FOR YOUR CONSIDERATION TONIGHT IS TO APPROVE A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ALHAMBRA.

FINDING THAT THE PROPOSED FISCAL YEAR 2021 DASH 2022 SEVEN YEAR CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GOALS AND POLICIES OF THE LITTLE HOMBRE GENERAL PLAN, 2035 PURSUANT TO GOVERNMENT CODE SECTIONS SIX FIVE ONE OH THREE AND SIX FIVE FOUR ONE.

AT THIS TIME, THE PUBLIC WORKS DEPARTMENT IS SUBMITTED THE FISCAL YEAR 2021 DASH 2022 SEVEN YEAR CAPITAL IMPROVEMENT PROGRAM FOR A CONSISTENCY DETERMINATION WITH THE GOALS AND OBJECTIVES OF THE LA HABRA GENERAL PLAN, 2035 GOVERNMENT CODE SECTION 6,503 STATES THAT THE PLANNING COMMISSION MUST REVIEW THE SEVEN YEAR CIP TO MAKE SURE THE PROPOSED PROJECTS ARE CONSISTENT WITH THE POLICIES AND GOALS OF THE GENERAL PLAN.

TWO OF THIS REPORT INCLUDES THE SEVEN YEAR CAPITAL IMPROVEMENT PROGRAM, WHICH INCLUDES THREE CATEGORIES OF PROJECTS.

THE FIRST ONE IS THE FIRST CATEGORY IS THE CAPITAL IMPROVEMENT PROGRAM.

FISCAL YEAR 2021 INCLUDES 24 NEW PROJECTS THAT WE'RE PROPOSING TO START THIS YEAR.

THE SECOND CATEGORY INCLUDES THE DEFERRED CAPITAL IMPROVEMENT PROGRAMS, UM, OUR PROJECTS, AND IT'S A 37 PROJECTS THAT CAN BE CONSTRUCTED WHEN FUNDING BECOMES AVAILABLE.

CURRENTLY, WE DON'T HAVE FUNDING FOR THESE DEFERRED PROJECTS AND THE THIRD CATEGORY WAS IN PROGRESS, CAPITAL IMPROVEMENT PROJECTS.

UM, THIS INCLUDES 41 PROJECTS THAT ARE CURRENTLY UNDERWAY IN DESIGN OR CONSTRUCTION.

IS IT SAFE TO SAY THAT THE FUNDING COULDN'T BE USED FOR THOSE ITEMS? COULD YOU REPEAT THE QUESTION? IF SO, IF, IF THERE'S SOMETHING THAT'S NOT IN HERE AND AS A CITY STAFF, LIKE WE DECIDED TO USE THOSE FUNDS THAT WE RECEIVED OR THAT EVEN THAT WE DIDN'T RECEIVE FOR ITEMS THAT WEREN'T ON HERE, ARE WE ABLE TO DO THAT? WE, WE HAVE PULLED PROJECTS INTO THE CIP MID-YEAR IN THE PAST.

SO THAT'S POSSIBLE TO DO SAY, LIKE FOR INSTANCE, IF WE GET GRANT MONEY, UM, MID YEAR AND WE WOULD PULL THAT IN THE COUNCIL WOULD APPROVE THAT.

SO THAT WOULD BE THE EXCEPTION THERE IS, AS FAR AS HOW WE'RE GOING TO SPEND THAT MONEY THAT WE GET, WE STILL DON'T KNOW IF, YOU KNOW, 10% GOES TO CAPITAL IMPROVEMENT PROJECTS OR THE REVERSE 90% OR, OR IT MIGHT GO TO SOME OTHER PROGRAMS HERE IN THE CITY.

UH, WE JUST DON'T KNOW YET.

IT DEPENDS.

THOSE GUIDELINES SET BY, UM, THE FEDERAL GOVERNMENT, ONE OF THE AUTHORITIES THERE.

I DON'T KNOW IF, I THINK LAST TIME I HEARD, I THOUGHT IT MIGHT'VE BEEN THE HOUSING AUTHORITY, BUT, UM, WE'RE NOT REALLY SURE YET THAT THEY JUST HAVEN'T COME OUT YET.

THEY'RE TALKING ABOUT GIVING MONEY TO THE LOCAL AGENCIES HERE AT GOSH, YOU KNOW, NATIONWIDE.
