THIS EVENING, MAYOR ESPINOSA IS HERE WITH US TONIGHT TO MAKE A PROCLAMATION ON BEHALF OF THE CITY COUNCIL.

UH, GOOD EVENING.

I WAS JUST GOING TO BE PART OF THE PUBLIC COMMENTS, BUT THANK YOU VERY MUCH FOR ALLOWING ME, UM, GOOD EVENING, MR. CHAIR, AND VICE-CHAIR MEMBERS OF THE COMMISSION.

OF COURSE.

MY NAME IS ROSA SPINOZA.

I'M ON THE MAYOR OF LA BARBARA.

UH, WE HAD, WE WERE LOOKING FORWARD TO PRESENTING THIS PROCLAMATION TO JERRY PAUL LAST MONDAY.

UH, BUT I COME TO FIND OUT THAT HE WAS NOT GOING TO BE ATTENDING.

SO I SAID, WELL, I WILL SHOW UP AT THE PLANNING COMMISSION MEETING AND MAKE SURE THAT WE PRESENT THIS TO HIM BECAUSE, UM, IT'S VERY IMPORTANT TO US TO RECOGNIZE THOSE WHO HAVE GIVEN SERVICE TO OUR COMMUNITY.

AND, UH, I HAVE A PROCLAMATION HERE THAT SAYS, UH, WHEREAS JERRY POWELL WAS APPOINTED TO THE PLANNING COMMISSION ON NOVEMBER 25TH, 2013.

UH, JERRY POLLY'S SOLDIERS SERVED AS VICE CHAIR OF THE PLANNING COMMISSION IN 2015, UH, IN 2015.

AND HIS CHAIR IS 2017 AND A LIFELONG RESIDENT OF LA AS A, HE, JERRY POWELL HAS EXPERIENCED THE LIFELONG RESIDENT, A SEVEN YEAR MEMBER OF THE PLANNING COMMISSION ALLOWED HIM TO PROVIDE INVALUABLE REVIEW AND INSIGHT.

AND WHEREAS JERRY POWELL PARTICIPATED IN THE APPROVAL APPROVAL OF THE LANDMARK DEVELOPMENT PROJECT WITHIN THE CITY, INCLUDING THE ROW ON HARBOR, NORTH GATE SHOPPING CENTER, KAISER MEDICAL OFFICE, BUILDING OLSON, RESIDENTIAL DEVELOPMENT, LIKE KINDA IN AND SUITES, ALL D STARBUCKS FARMER'S BOY HOBBY LOBBY, HARBOR FREIGHT, RAISING CANE TOMMY'S BURGER TRADER JOE'S, CVS BURLINGAME, BURLINGTON BURLINGTON COAT FACTORY, AND VALORI RESIDENTIAL DEVELOPMENT AS WHERE.

AND WHEREAS JERRY POWELL PARTICIPATED IN THE APPROVAL OF IMPORTANT LEGISLATION FROM, FROM WHICH TO FURTHER GUIDE DEVELOPMENT IN THE CITY, INCLUDING UPDATES TO THE LA HARBOR BOULEVARD, SPECIFIC PLAN, VARIOUS ZONE CHANGES THROUGHOUT THE CITY AND ZONING CODES UPDATES REGARDING AFFORDABLE HOUSING INCENTIVES, ACCESSORY DWELLING UNIT, AND WIRELESS FACILITY.

AND WHEREAS THESE PROJECTS HAVE ENHANCED THE COMMUNITY INCREASED PROPERTY VALUES AND THEREFORE ENSURED QUALITY DEVELOPMENT IN LA HARBOR FOR YEARS TO COME.

NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF LA HARBOR DOES HERE BY EXPRESS HIS APPRECIATION TO JERRY POWELL FOR HIS SEVEN YEARS OF OUTSTANDING SERVICE AND COMMITMENT TO THE CITY OF LA HARBOR PLANNING COMMISSION, AND WISH THEM SUCCESS IN ALL THE FUTURE ENDEAVORS.

WE WANT TO WISH YOU WELL IN YOUR RETIREMENT, ENJOY YOUR LIFE WITH YOUR WIFE AND YOUR GRANDCHILDREN.

UM, AND A NUMBER OF CITIES HAVE BEEN LOOKING INTO REGULATIONS AND AS WE HAVE A FEW OF THESE THAT DO EXIST IN LAHABRA AND WE'VE BEEN EXPERIENCED PROBLEMS IN ONE WITH

ONE PARTICULAR ONE IN AN, A NEIGHBORHOOD, UM, WHICH CAUSED US TO LOOK INTO THIS ISSUE MORE CLOSELY.

UM, WE'VE PUT TOGETHER SOME INFORMATION FOR THE COMMISSION TO REVIEW TONIGHT AND HOPEFULLY WE'VE PROVIDED ENOUGH INFORMATION.

SO YOU CAN MAKE A DECISION BY THE, BY THE END OF THIS EVENING.

UM, WE'D MAKING A RECOMMENDATION TO THE CITY COUNCIL.

SO THE TWO SIDES TO THIS, OBVIOUSLY THEY'RE THERE.

THE OPPONENTS ARE THAT ARE CONNECTED WITH, WITH, UH, A LOSS OF AFFORDABLE HOUSING, WHICH THEY BELIEVE THESE CAUSE AND CITIES HAVE REGULARLY RECEIVED COMPLAINTS ABOUT NEGATIVE IMPACTS ABOUT PARKING NOISE, UH, DISRUPTION OF THE PIECE, AND JUST KIND OF GENERAL NUISANCES, UM, PROMOTED PROPONENTS ARGUE THAT THEY DESIRE TO SUPPLEMENT THEIR INCOMES FOR SUCH RENTALS FOR A VARIETY OF REASONS, SUCH AS AVOIDING FORECLOSURE AND EARNING MONEY TO PAY THEIR MORTGAGES.

UM, AND THE BUSINESS OPPORTUNITIES ARE ALSO WELCOME AND ACKNOWLEDGE A POSITIVE EFFECTS ON VISITORS WHO FREQUENT THE CITY FOR, WITH OTHER SERVICES, UM, FOR THE VISITORS THEY OFFER SHORT-TERM RENTALS MORE FLEXIBLE THAN A TYPICAL HOTEL WHERE THEY HAVE, ESPECIALLY FOR FAMILIES WHERE THEY HAVE THE ABILITY TO COOK.

AND IF THEY'RE TRAVELING WITH PETS AND LOTS OF CHILDREN, UM, IT'S JUST A LITTLE BIT DIFFERENT ENVIRONMENT.

AND IF THEY'RE SPENDING, YOU KNOW, A LITTLE BIT LONGER TIME, SO THE REGULATORY OPTIONS AVAILABLE TO THE CITY ARE THAT WE CAN PROHIBIT SHORT TERM UNITS, ALLOW THEM WITH A VARIETY OF REGULATIONS DESIGNED TO REDUCE THE NEGATIVE IMPACTS TO NEIGHBORHOODS OR ALLOW THEM BUY RIGHT SUBJECT TO EXISTING CODES CURRENTLY.

UM, THAT IS WHAT'S HAPPENING IN LAHABRA THEY'RE, THEY'RE ALLOWED BY, RIGHT.

UM, AND SUBJECT TO THE NOISE AND NUISANCE ORDINANCES.

AND WHAT HAVE YOU SO SHOULD THE D WISH TO, UM, PRO PARENT ORDINANCE FOR ALLOWING THEM, BUT WITH REGULATIONS TO, TO MITIGATE THE NEGATIVE IMPACT STAFF HAS PREPARED AN ORDINANCE WITH, WITH THOSE TYPES OF THINGS IN IT.

WE'VE ALSO PREPARED A RESOLUTION FOR YOU TONIGHT.

UM, SHOULD YOU WISH TO GO THE ROUTE OF PROHIBITING THEM? SO I'LL, I'LL WALK YOU THROUGH A LITTLE BIT OF WHAT SOME OF THE REGULATIONS PROPOSED IN THE ORDINANCE ARE.

UM, SO THIS SLIDE INDICATES SOME OF THE KEY ONES.

UH, ONE OF THE CONCERNS IS ABOUT LOCATION, UM, IN COMPLYING WITH NOISE STANDARDS, UH, MAINTAINING THE NEIGHBORHOODS, UH, NOT HAVING EXCESSIVE AMOUNTS OF PARKING LIMITING TIMES OF USE, UM, PROVISIONS FOR REVOCATION OF THE PERMIT AND AGAIN, UH, ABILITY TO ENDURE THEIR CITATIONS AND HAVE, HAVE ANNUAL INSPECTIONS.

SO TO KIND OF DRILL DOWN IN SOME OF THESE A LITTLE BIT, UM, FOR EXAMPLE, THE REGULATION WE'VE PROPOSED THAT YOU'VE HAD THE FULL TEXT, THAT YOU'VE HAD A CHANCE TO READ, UM, WOULD LIMIT PEOPLE USING SWIMMING POOLS FROM 10 O'CLOCK AT NIGHT TO EIGHT O'CLOCK IN THE MORNING.

SO IF SOMEBODY IS USING THE POOL AND MAKING NOISE AT, AT TWO O'CLOCK, UH, THE PD WOULD HAVE THE ABILITY TO GO OUT AND WRITE THEM A CITATION FOR THAT, FOR EXAMPLE, UH, UM, MAINTAINING THE RESIDENTIAL NEIGHBORHOOD CHARACTER, UM, WE'RE PROPOSING SUCH THINGS AS LIMITING THE OCCUPANCY, UM, TO TWO PEOPLE PER BEDROOM, UM, WITH THE EXCEPTION OF CHILDREN, CHILDREN UNDER SIX.

SO A TYPICAL, UH, THREE OR FOUR BEDROOM HOUSE, YOU KNOW, IT'D BE SIX TO EIGHT.

PEOPLE WOULD BE THE MACKIE MAXIMUM NUMBER OF PEOPLE THAT COULD BE THERE.

UM, WE GOT REQUIRING THAT ALL THE PARKING BE EITHER IN THE GARAGE OR ON THE DRIVEWAY AND NOT TAKE UP ANY ON-STREET PARKING.

UM, AND AGAIN, WE'VE ADDED PROVISIONS FOR CITATIONS, WHICH COULD ALSO RAISE THIS TO A LEVEL OF A MISDEMEANOR IF THERE'S MULTIPLE, MULTIPLE VIOLATIONS.

SO, AND IT, AND SO IN ADDITION TO THAT, IF SHOULD THE COMMISSION WISH TO GO THAT DIRECTION, THAT'S WHERE A COMPANY COMING IN MODIFYING SECTION 1.0 8.20 COMES INTO PLACE.

AND THIS WOULD BE THE PROVISION THAT GIVES THE, UM, THE CITY, THE EXPERTISE TO TAKE THESE AS MISDEMEANOR TO COURT.

IF THE, IF, IF WE HAVE A REPEAT OFFENDER, UM, AND IN ADDITION, UH, WE HAVE TO MODIFY THE ZONING CODE, UM, TO HAVE A SECTION TO SAY, THEY'RE ALLOWED, CAUSE RIGHT NOW THE ZONING CODE IS SILENT ON THAT.

SO, AND THEN UNDER PUB PUBLIC COMMENT IS THAT I MENTIONED EARLIER, WE, UM, SENT YOU ALL THE CORRESPONDENCE WE RECEIVED PART PART, OR EXCUSE ME, PRIOR

SO IN SUMMARY, UM, STAFF IS ASKING THE COMMISSION TO REVIEW THE INFORMATION PRESENTED AND LISTENED TO ALL THE PUBLIC TESTIMONY AND THEN GIVE STAFF A DIRECTION OF, OF WHAT YOU WISH TO TAKE FORWARD TO THE CITY COUNCIL, EITHER FOR ADOPTING THE ORDINANCE AS IS, OR WITH MODIFICATIONS AS YOU SEE FIT OR FOR AN OUTRIGHT PROHIBITION.

THIS PERSON WHO OWNS 800 TEAKWOOD IS A WEALTHY MAN, AND HE'S MAKING A LOT OF MONEY BECAUSE THE BUSINESS MODEL IS A MINIMUM OF FIVE DAYS OF RENTAL.

IF I'M NOT MISTAKEN IS $500 A DAY AND A MINIMUM, I BELIEVE 14 OR 15 PEOPLE ARE ALLOWED TO BE IN THAT HOUSE.

SO JUST BY DEFINITION, HAVING 15 PEOPLE A DAY FOR FIVE DAYS WILL TURN INTO A VERY NOISY AFFAIR.

SO FOR US IN THIS NEIGHBORHOOD, WERE IT TURNING INTO QUITE A NIGHTMARE? AND I KNOW THE RESIDENT AND THE NEIGHBORS RIGHT NEXT TO THIS HOME, IT MUST BE REALLY A HUGE NIGHTMARE.

BUT THE PROBLEM THAT WE'RE SEEING IS THAT THIS IS NOT A JUST, OH, I NEED SOME INCOME TO JUST SURVIVE AND PAY MY MORTGAGE.

THIS IS TURNED INTO A BUSINESS.

UNDER ANY CIRCUMSTANCES.

I CANNOT SEE ANY VALUE IN TRYING TO REGULATE AN UNREGULAR TYPE OF BEHAVIOR THAT WILL ONLY CONTINUE TO PROSPER ITSELF THROUGH CIRCUMVENTING THE AMENDMENTS, THE OPPORTUNITIES THAT CITIES HAVE TRIED.

I'VE SEEN THAT IN MY OWN CITY, WHERE AS A POLICE OFFICER, TRYING TO ENFORCE NOISE ORDINANCES, IT WAS ALMOST IMPOSSIBLE TO, TO DEAL WITH THESE TYPE OF THINGS.

AND IT WAS EVEN MORE DIFFICULT, UH, TO TRY TO HELP THE COMMUNITY.

I FIND THAT THERE IS NO OTHER OPTION OTHER THAN I STRONGLY RECOMMEND, AND I AM WILLING TO MOVE A RESOLUTION COMPLETELY BANNING THE SHORT-TERM RENTALS WITHIN THE CITY OF ALHAMBRA, IN SUPPORT OF THE RESIDENTS WHO HAVE SPOKEN TONIGHT.

THAT MIGHT BE A DIFFERENT SITUATION, BUT THAT'S NOT LAHABRA.

AND WHAT WE ARE DOING HERE IS EVEN IF WE REGULATE THESE AIRBNBS, WE'RE JUST GOING TO CREATE A WHOLE NEW BUREAUCRATIC OVERLAY.

THEN AT THAT POINT, DEFINITELY SEE IT JUST LIKE CHAIRMAN ASSYRIAN STATED LOOKING AT A COST ANALYSIS AND LOOKING AT IT FROM THAT PERSPECTIVE.

I THINK THE PART, YOU KNOW, FOR THE RECORD THAT IS MOST DISCOURAGING IS REGULATING SOMETHING THAT'S VERY DIFFICULT TO REGULATE.

UM, THE IDEA OF A SHORT-TERM RENTAL OCCUPANTS OWNER PLAYING BY A DIFFERENT SET OF RULES THAN SOMEBODY AT THE HOUSE NEXT DOOR, UM, THAT CAN BE HAVING A PARTY THAT'S LOUDER, MORE DISRUPTIVE WITH MORE DRUGS, WITH WHATEVER.

UM, YOU KNOW, SOME OF THESE RESIDENTS HAVE EXPERIENCED, UM, AS FAR AS THE NOISE GOES, THAT HOUSE NEXT DOOR, IF IT'S NOT A SHORT-TERM RENTAL IS VERY DIFFICULT TO REGULATE.

AND THEN THIS HOUSE WOULD BE, UM, IMPOSSIBLE, UH, VERY, VERY EASILY TO REGULATE WITH, UM, ONE OF THE OPTIONS BEFORE US TONIGHT.

SO THAT, THAT DIDN'T SIT WELL WITH ME.

UM, CAUSE I THINK WE'VE ALL EXPERIENCED BAD NEIGHBORS PERIOD, WHETHER THEY WERE SHORT-TERM RENTERS OR NOT.

UM, SO THAT DIDN'T SEEM LIKE A VERY VIABLE SOLUTION, UM, MYSELF, UM, HEARING WHAT THE REST OF THE COMMISSION HAS SHARED, UM, AND TAKING THAT INTO CONSIDERATION.

UM, I'M PREPARED TO HEAR A RESOLUTION THAT SOMEBODY WOULD LIKE TO MOVE THAT YOU'RE CHAIRMAN MEMBERS OF THE COMMISSION.

UH, I WOULD MOVE A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HARBOR RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE PROHIBITING SHORT-TERM RESIDENTIAL RENTALS IN THE CITY OF ALHAMBRA.

I'VE LIVED IN THE HARBOR SINCE 1965 AND, UH, GREW UP IN THE WHITTIER LA HARBOR AREA.

SO I'VE, I'VE LIVED HERE ALL MY LIFE.

AND I DO REMEMBER 36 YEARS AGO OR LONGER WHEN, WHEN WE ALL STARTED AND THE RISING AND DIFFERENT CITY MANAGERS AND DIFFERENT THINGS GOING ON.

THE FIRST THING I BECAME IN THE CITY, UH, WAS A MEMBER OF THE SCHOOL BOARD.

I WAS APPOINTED TO FILL A TWO-YEAR TERM ON, UH, ON A MEMBER WHO HAD RESIGNED MUCH LIKE, UH, THE PERSON THAT'S GOING TO FILL OUT MY TIME AND WENT ON TO SERVE 16 YEARS, UH, AS A SCHOOL BOARD MEMBER IN THE CITY.

AND THEN FROM THERE SERVED ON A FEW OTHER COMMISSIONS, CITY, WIDE TRAFFIC MANAGEMENT AND PERSONNEL COMMISSION.

AND, AND NOW THE LAST, ALMOST EIGHT YEARS REALLY ON THIS COMMISSION.

I LOVE LAHABRA.

I LOVE THE CITY.

I LOVE HAVING BEEN HERE.

UH, MY KIDS WENT SOUTH THOUGH.

THEY DIDN'T STAY HERE AFTER, AFTER THEY GRADUATED FROM LAHABRA HIGH SCHOOL, THEY MOVED TO SAN CLEMENTE AND SAN DIEGO.

SO OUR DAUGHTER HAS GRACIOUSLY ALLOWED ME AND MY WIFE TO COME AND LIVE WITH THEM FOR A WHILE AND TRY TO FIGURE OUT WHERE WE'LL LAND DOWN SOUTH SOME PLACE,
