UH, SO LONG AS THE BODY MAKES CERTAIN SPECIFIED FINDINGS, UM, INITIALLY, WHICH IS THE FIRST RESOLUTION, AND THEN ON AN ONGOING BASIS, WHICH IS THE SECOND RESOLUTION, AND THOSE FINDINGS NEED TO BE RENEWED EVERY 30 DAYS.

BASED ON THE LISTING ON THE PREVIOUS PAGE, STAFF ALSO RECOMMENDS THAT CITY COUNCIL ONCE AGAINST LIKE TWO ALTERNATES TO THE PLANNING COMMISSION, COMMUNITY SERVICES AND BEAUTIFICATION COMMISSION IN THE EVENT OF A VACANCY, I WANT TO KNOW ALSO ON FEBRUARY 21ST, 1989 CITY COUNCIL ADOPTED ORDINANCE 1351 THAT'S SPECIFIED PLANNING, COMMISSIONER TERMS, PLANNING, COMMISSIONS, COMMUNITY SERVICES, TERMS, TERM LIMITS WERE NOT ESTABLISHED BY THIS ORDINANCE.

SO IT'S THE OPINION OF THE CITY ATTORNEY THAT THE CITY COUNCIL HAS THE OPTION TO REAPPOINT AS THEY SO CHOOSE THE BEAUTIFICATION COMMITTEE.

THERE ARE CURRENTLY TWO VACANT SEATS TO BE FILLED ON THE BEAUTIFICATION COMMITTEE, ONE BY THE CITY COUNCIL AND ONE BY THE CHAMBER OF COMMERCE COMMITTEE MEMBER MANUAL MUNOZ, A COUNCIL APPOINTEE AGREED TO SERVE ON BOTH THE PLANNING COMMISSION AND THE BEAUTIFICATION COMMITTEE UNTIL HIS CITY COUNCIL APPOINTED POSITION ON THE BEAUTIFICATION COMMITTEE COULD BE FILLED COMMITTEE MEMBER, GRACE GARCIA, A CHAMBER APPOINTEE SUBMITTED A RESIGNATION EFFECTIVE JANUARY 6TH, 2022.

THE CITY COUNCIL DOES HAVE THE OPTION OF REDUCING THE SIZE OF THE BEAUTIFICATION COMMITTEE FROM SEVEN MEMBERS TO FIVE MEMBERS AND NOT FILL THE TWO VACANCIES.

MAYOR MEMBERS OF COUNCIL, ROBERT FARRIER FROM THE CITY MANAGER'S OFFICE AS COUNSEL AND THE PUBLIC IS AWARE LAST YEAR, THE AMERICAN RESCUE PLAN ACT ALSO KNOWN AS ARPA WAS SIGNED INTO LAW AND PROVIDED ALMOST $2 TRILLION IN FEDERAL STIMULUS AID TO SUPPORT A WIDE VARIETY OF PUBLIC HEALTH AND FINANCIAL ASSISTANCE PROGRAMS MEANT TO ADDRESS THE NEGATIVE ECONOMIC IMPACTS ASSOCIATED WITH THE COVID 19 PANDEMIC.

FOR AN IDEA OF SCALE, $2 TRILLION IS TWO FOLLOWED BY 12 ZEROS.

SO IT'S A SIGNIFICANT AMOUNT OF MONEY.

A PORTION OF ARPA, APPROXIMATELY $350 BILLION WAS SPECIFICALLY ALLOCATED TO STATE LOCAL TERRITORIAL AND TRIBAL GOVERNMENTS FOR THEIR USE.

THIS CARVE-OUT, WHICH WAS KNOWN AS THE CORONA VIRUS, STATE, AND LOCAL FISKER FISCAL RECOVERY FUND INCLUDED A $65 BILLION ALLOCATION THAT WAS DIVIDED AMONG THE ROUGHLY 19,000 CITIES, TOWNS AND VILLAGES SPREAD ACROSS THE COUNTRY.

WELL, HARBOR IS OPERA.

ENTITLEMENT IS ROUGHLY $15.8 MILLION, WHICH IS PAID BY THE TREASURY IN TWO EQUAL ALLOCATIONS, APPROXIMATELY ONE YEAR APART, THE FIRST ALLOCATION OF ABOUT $7.9 MILLION WAS RECEIVED BY THE CITY LAST YEAR.

AND THEN SET ASIDE IN A DEDICATED FUND PENDING TREASURY'S APPROVAL OF ITS FINAL RU RULES.

THOSE FINAL RULES WERE JUST, UH, UH, PROVIDED BY TREASURY EARLIER THIS MONTH,

THE CITY'S SECOND ARPA ALEC ALLOCATION ALSO OF ABOUT $7.9 MILLION WILL BE RECEIVED FROM TREASURY LATER THIS YEAR, CONSISTENT WITH THE FINAL RULE BY TREASURY, WHICH DESCRIBES THE METHOD BY WHICH FUNDS, UH, MAYBE USE AND HOW TREASURY WILL IMPLEMENT ARBA CITIES ARE REQUIRED TO OBLIGATE ALL FUNDS RECEIVED BY DECEMBER 31ST, 2024, AND THEN SPENT BY DECEMBER 31ST, 2026.

SO ONE OF THE KEY THING TAKEAWAYS IN THIS PRESENTATION YOU'LL LEARN IS THERE'S A LOT OF FLEXIBILITY IN HOW YOU CAN USE THE FUND.

AND TREASURY'S GIVE YOU A FAIR AMOUNT OF TIME TO FIGURE OUT HOW YOU WANT TO DO THAT.

SPECIFICS ON BOTH ARPA AND THE STATE AND LOCAL FISCAL YEAR FISCAL RECOVERY FUND CAN BE FOUND ON THE TREASURY'S WEBSITE, WHICH IS HOME.TREASURY.GOV.

NOW PURSUANT TO THE FINAL RULES THAT WERE ATTACHED TO THE STAFF REPORT.

CITIES ENJOY A GREAT DEAL OF FLEXIBILITY ON HOW THESE FUNDS MAY BE PROGRAMMED IN USE SUBJECT TO SOME KEY PROHIBITIONS THAT ARE LAID OUT IN THE LAW.

FOR EXAMPLE, FUNDS MAY BE USED TO SUPPORT PUBLIC HEALTH PROGRAMS AND EXPENDITURES THINGS LIKE COVID-19 MITIGATION EFFORTS, UM, CERTAIN PUBLIC HEALTH AND SAFETY EXPENSES.

THEY MAY ALSO BE USED TO ADDRESS THE NEGATIVE ECONOMIC IMPACTS CAUSED BY THE PUBLIC HEALTH EMERGENCY, INCLUDING ECONOMIC HARM TO WORKERS, HOUSEHOLDS, SMALL BUSINESSES IMPACTED INDUSTRIES AND THE PUBLIC SECTOR.

THEY MAY ALSO BE USED TO REPLACE LOST, UH, LOST PUBLIC SECTOR REVENUES.

UM, ARPA PROVIDED GOVERNMENTS, UM, STRIKE THAT USING ARPA TO PROVIDE GOVERNMENT SERVICES TO THE EXTENT OF THEIR REDUCTION IN THE REVENUE, WHICH WAS CAUSED BY THE, UM, PANDEMIC.

AND THEN FUNDS MAY ALSO BE USED TO INVEST IN INFRASTRUCTURE PROJECTS, THINGS, WATER, SEWER, AND BROADBAND INFRASTRUCTURE IN REGARD TO INELIGIBLE USES AREPAS SPECIFICALLY PROHIBITS DEPOSITS INTO PENSION FUNDS, PAYMENTS TOWARD DEBT SERVICE USE TOWARDS LEGAL SETTLEMENTS OR JUDGMENTS AND OR DEPOSITS INTO RAINY DAY FUNDS OR FINANCIAL RESERVES.

IT'S IMPORTANT TO REMEMBER THE OVERARCHING GOAL OF ARPA AS IT RELATES TO LOCAL GOVERNMENT IS TO PROVIDE AGENCIES WITH RESOURCES NECESSARY TO RESPOND TO THE COVID PUBLIC HEALTH EMERGENCY AND ITS RELATED NEGATIVE ECONOMIC IMPACTS.

ONE KIND OF CAVEAT I WOULD MENTION AS IT RELATES TO THE PROHIBITION ON DEPOSITS AND THE PENSION FUNDS TREASURY INTERPRETS A DEPOSIT AS AN EXTRAORDINARY PAYMENT INTO A PENSION FUND FOR THE PURPOSE OF REDUCING AN ACCRUED UNFUNDED LIABILITY.

THAT'S ESSENTIALLY A NO, NO, YOU CAN'T DO THAT.

HOWEVER, TREASURY ALSO DISTINGUISHES A DEPOSIT FROM A PAYROLL CONTRIBUTION, WHICH OCCURS WHEN EMPLOYERS MAKE PAYMENTS INTO PENSION FUNDS ON A REGULAR INTERVALS WITH CONTRIBUTION AMOUNTS BASED ON A PREDETERMINED PERCENTAGE OF AN EMPLOYEE'S WAGES AND SALARIES.

THAT'S OKAY UNDER THE LAW.

IT'S ALSO IMPORTANT TO NOTE THAT ARPA FUNDS ARE ONE-TIME IN NATURE.

IN OTHER WORDS, THEY'RE NOT A RECURRING SOURCE OF REVENUE SUCH AS PROPERTY TAX OR SALES TAX THAT YOU'RE GOING TO GET EVERY SINGLE YEAR AS SUCH, WHEN IT COMES TO THE QUESTION OF HOW FUNDS SHOULD BE PROGRAMMED OR COULD BE PROGRAMMED HERE IN LA HABRA, IT WOULD BE PRUDENT FOR THE CITY COUNCIL TO CONSIDER FUNDING ELIGIBLE, UH, KIND OF FUNNY ELIGIBLE ONE-TIME, UH, PROGRAMS AND USES THINGS LIKE CAPITAL PROJECTS, EQUIPMENT ACQUISITION, REIMBURSEMENT OF ELIGIBLE INCURRED COSTS, OR TO REPLACE LOST MUNICIPAL REVENUE RATHER THAN PROGRAMMING FUNDING TO SUPPORT RECURRING PROGRAMS OR OTHER OPERATIONAL ACTIVITIES.

ALL RECIPIENT AGENCIES, INCLUDING THE CITY OF LA HABRA ARE REQUIRED TO SUBMIT QUARTERLY PROJECT AND EXPENDITURE REPORTS TO TREASURY TO DEMONSTRATE HOW THESE, THESE FUNDS ARE BEING USED FOR ELIGIBLE PURPOSES IN ACCORDANCE WITH THE LAW USE OF FUNDS FOR INELIGIBLE PURPOSES, COULD RE-TRIGGER EVERY PAYMENT SCENARIO.

UM, UH, AND TREASURY SAID NO, AND RETHINK HOW YOU'RE GOING TO USE THOSE FUNDS.

AND IF YOU DECIDE TO SPEND IT ON WHAT YOU WANT TO SPEND IT ON, YOU'RE GETTING ROLLED UP, WE'RE IN A CALL THEM BACK.

SO IT'S IMPORTANT TO KIND OF BE VERY, UM, PRUDENT IN HOW YOU DECIDE TO USE THE FUNDS IN TERMS OF PROPOSED BUDGET APPROPRIATIONS.

UH, WHEN PREPARING OUR RECOMMENDATIONS FOR A CITY COUNCIL CONSIDERATION STAFF LOOKED FIRST EXISTING COUNCIL APPROVED POLICY DOCUMENTS, THINGS THAT, UM, STATE POLICY THAT CLARIFY THE CITY'S SHORT AND LONGTERM VISION FOR THE COMMUNITY.

THIS INCLUDED A REVIEW OF THE GENERAL PLAN.

IT INCLUDED A REVIEW OF THE FISCAL 2122 BUDGET AND INCLUDED A REVIEW OF THE FISCAL 2122 GOALS AND OBJECTIVES.

EACH OF THESE DOCUMENTS IS INTERCONNECTED TO ONE DEGREE OR ANOTHER, AND THEY PROVIDE GUIDANCE ON HOW CITY RESOURCES, INCLUDING ONE-TIME FUNDS LIKE ARPA-E CA COULD BE PROGRAMMED TO ACHIEVE COUNCILS DIRECTIVES AND THE COMMUNITY'S PRIORITIES AS NOTED IN THE STAFF REPORT, STAFF PROPOSED USE OF THE FUNDS FALL INTO FOUR BROAD CATEGORIES.

AND THESE ARE REVENUE REPLACEMENT SUCH AS, UH, USED TO HELP WITH CYBERSECURITY MODERNIZATION FACILITY UPGRADES AND OTHER GOVERNMENT SERVICES INVESTMENTS IN INFRASTRUCTURE, SPECIFICALLY STORM WATER INFRASTRUCTURE SUPPORT FOR PUBLIC HEALTH EXPENDITURES, SUCH AS THOSE THAT HELP TO CONTAIN AND MITIGATE THREAT OF COVID-19 AND THEN PROGRAMS TO ADDRESS NEGATIVE ECONOMIC IMPACTS CAUSED BY COVID-19 AT THE LOCAL LEVEL, I'M TALKING ABOUT THINGS LIKE HOMELESS OUTREACH AND ASSISTANCE, RENTAL ASSISTANCE AND BUSINESS, NONPROFIT ASSISTANCE OF THESE FOUR CATEGORIES.

REVENUE REPLACEMENT IS THE LARGEST, UH, CONSTITUTING, APPROXIMATELY $10 MILLION OF THE CITY'S ALLOCATION OR THE CITY'S ENTITLEMENT INVESTMENTS IN INFRASTRUCTURE AND PUBLIC HEALTH EXPENDITURES ARE MOUNTED TO ABOUT 2.5 MILLION AND $2 MILLION RESPECTIVELY, AND THEN PROGRAMS TO ADDRESS LOCAL NEGATIVE IMPACTS CAUSED BY COVID ARE TARGETED ABOUT ONE AND A QUARTER MILLION DOLLARS IN REGARD TO THE PROPOSED ALLOCATION OF THIS FUNDS.

IT'S IMPORTANT TO REMEMBER A FEW KEY POINTS VERY QUICKLY.

I'LL TRY TO GO OVER THEM FIRST.

IT'S NOT LIKELY THAT ANY ADDITIONAL FEDERAL ASSISTANCE RESULTING FROM THE COVID PANDEMIC WILL BE FORTHCOMING.

AT LEAST NOT TO CITIES TO BE CANDID.

A FEDERAL ALLOCATION OF THIS MAGNITUDE HAS NEVER HAPPENED BEFORE.

AND TO BE HONEST, FROM A STAFF PERSPECTIVE, I'M KIND OF SURPRISED THAT WE GOT ANYTHING TO BEGIN WITH.

FRANKLY, SECOND WHILE OUR PORT HAS A LARGE PROGRAM, NEARLY $2 TRILLION, IT REPRESENTS JUST ONE ELEMENT AND A LARGER SUITE OF RELIEF PROGRAMS THAT HAVE BEEN CONSIDERED IMPROVED BY THE FEDERAL GOVERNMENT.

SINCE THE PANDEMIC STARTED IN MARCH, 2020, FOR EXAMPLE, MORE THAN $1 TRILLION HAS ALREADY BEEN MADE AVAILABLE TO SMALL BUSINESSES ACROSS THE NATION, AS WELL AS ANOTHER $1 TRILLION IN DIRECT PAYMENT TO INDIVIDUAL.

THESE ARE THE STIMULUS PAYMENTS THAT MANY PEOPLE IN THE COUNTRY RECEIVED LAST YEAR, AS WELL AS ANOTHER $600 BILLION IN UNEMPLOYMENT BENEFITS, ALL TOLD THE FEDERAL GOVERNMENT HAS ALREADY DEDICATED $6 TRILLION IN AID ACROSS TWO PRESIDENTIAL ADMINISTRATIONS, ALMOST NON OF WHICH HAS BEEN EARMARKED FOR LOOKING GOVERNMENT WITH THE EXCEPTION OF ARPA.

IF COUNCIL WISHES TO MODIFY THEM IN SOME WAY THAT'S ITS PREROGATIVE, UM, WITHIN THE PARAMETERS ESTABLISHED BY THE TREASURY, OF COURSE.

AND LASTLY, THIS EVENING STAFF IS REQUESTING ONLY THAT SOME POLICY GUIDANCE FROM THE COUNCIL BE PROVIDED ON THESE APPROPRIATIONS, NOT THE ACTUAL SPENDING OF THE FUNDS, SIMILAR TO THE APPROPRIATION PROCESS THAT COUNCIL GOES THROUGH EVERY YEAR WITH THE BUDGET, UH, STAFF WILL PRESENT SPECIFIC PROGRAMS AND PROJECTS TO THE CITY COUNCIL FOR CONSIDERATION OF FUNDING APPROVAL, AS THEY'RE READY TO MOVE FORWARD.

LIKE I SAID, THIS IS ALMOST IDENTICAL TO THE WAY COUNCIL APPROACHES, UM, FUNDING FOR THINGS LIKE CAPITAL FOR INFRASTRUCTURE PROJECTS AS PART OF THE ANNUAL BUDGET PROCESS, AND THEN APPROVES THE ACTUAL DISBURSEMENT OF FUNDS FOR A PROJECT AT A LATER DATE, STAFF RECOGNIZES THAT A COUNCIL MAY NOT YET READY TO IDENTIFY SPECIFIC PROJECTS OR PROGRAMS TO SUPPORT USING THESE ARPA FUNDS AND BECAUSE OUR REPLACES AN EMPHASIS ON FLEXIBILITY AND A SIGNIFICANT AMOUNT OF TIME TO MAKE THOSE CHOICES, UM, RECIPIENT AGENCIES HAVE UNTIL THE END OF 2024, LIKE I SAID, TO ACTUALLY OBLIGATE THE FUNDS, WE ASKED THE CITY COUNCIL APPROVE THE RECOMMENDED BUDGET ALLOCATION PLAN SET FORTH IN THE STAFF REPORT OR PROVIDE ALTERNATE DIRECTION STAFF FROM BOTH THE CITY MANAGER'S OFFICE AND THE FINANCE DEPARTMENTS ARE HERE THIS EVENING TO ADDRESS QUESTIONS FROM THE COUNCIL THAT CONCLUDES OUR PRESENTATIONS.

UM, I DID LOOK AT THE BUDGET OVERALL AND I LOOKED AT THE, UH, PARTICULAR PART WHERE IT SAYS ADDRESS NEGATIVE ECONOMIC IMPACTS CAUSED BY COVID 19 HOMELESSNESS, OUTREACH

ASSISTANCE, RENTAL BUSINESS ASSISTANCE, AND NONPROFIT.

I REALLY WOULD, UH, WANT THE COUNCIL TO CONSIDER, UM, MAKING IT A 500,000 FOR ALL THE LEVELS, THE HOMELESS OUTREACH ASSISTANT 500,000 RENTAL ASSISTANCE, 500,000 BUSINESS ASSISTANCE, 500,000 NONPROFIT ASSISTANCE, 500,000 AS WELL.

AND TWO TO SEE IF THEY CAN TAKE IT FROM THE OTHER, UH, CATEGORIES THAT WE HAVE A LOT OF THE, THE AMOUNT OF FUNDS THAT WE HAVE BEEN GIVEN.

I KNOW THAT IT'S JUST BEEN A TREMENDOUS FINANCIAL HARDSHIP AND HAS IMPACTED BUSINESSES MORE.

WE HAVE EVER SEEN THE DISPARITY BETWEEN THOSE WHO OWN AND THOSE WHO RENT.

UM, I SEE THE STORIES AND I HEAR THE INDIVIDUALS AND I THINK THAT 250 IS JUST GOING TO GO SO RAPIDLY, UM, THAT I WOULD RECOMMEND $500,000 THERE AND NONPROFITS, THE CARS COULD OFFER YOU THAT AS WELL.

AND SO I WOULD, UM, WHEN THE MOTION IS MADE, I WOULD LIKE TO CONSIDER THAT WE UP ALL THOSE THREE AMOUNTS FOR RENTAL BUSINESS AND NONPROFIT TO 500,000 AS WELL.

MR. MAYOR COUNCIL MEMBER, UH, IT'S BEEN OVER THE W WHERE WE SUGGEST THE, UH, ADJUSTMENT BE MADE AT.

YEAH, I WOULD LEAVE THAT UP TO THE STAFF, BUT I NOTICED THAT, YOU KNOW, IF WE TOOK 5% AWAY FROM EACH ONE AND, AND WHATEVER THE BALANCE WOULD BE REQUIRED, UM, MAYBE TAKING IT, TAKING IT AS WELL FROM A LITTLE BIT MORE FROM THE OTHER GOVERNMENTAL SERVICE GOVERNMENT SERVICES, BUT 5%, UH, I THINK WOULD HELP ALONG THE WAVES.

AND, UH, AS I SAID, ANY LITTLE DIFFERENCE THAT THAT WOULD BE REQUIRED, UH, MAYBE THE, UH, OTHER GOVERNMENT SERVICES WOULD, COULD, COULD ALSO ACCUMULATE TO THE 500, BUT I'LL LEAVE IT UP TO STAFF.

THEY CAN DECIDE HOW TO, WHERE IT'S MORE IMPORTANT, BUT I WOULD, I WOULD MAKE THAT RECOMMENDATION COUNCIL MEMBER, UM, ESPINOSA, IF COUNCIL WOULD CHOOSE TO GO THAT ROUTE THAT YOU'RE RECOMMENDING WITH THE REALLOCATION, I WOULD SUGGEST WE REDUCE CITY FACILITY UPGRADES BY $500,000 AND THE STORM WATER INFRASTRUCTURE INVESTMENT BY $250,000.

AND WE REALLOCATE THAT $750,000 EQUALLY TO THE THREE CATEGORIES THAT YOU IDENTIFIED.

AND HE, UM, POINTED OUT SOMETHING THAT WE ALL I'M SURE ARE AWARE OF, BUT PEOPLE AT HOME MAY NOT BE.

AND I CERTAINLY HAD FORGOTTEN THAT THE FEDERAL GOVERNMENT HAS DIRECTLY FUNDED THOSE ENTITIES, UM, THROUGH THEIR BUDGETS DIRECTLY TO THE STATES AND IN THE TUNE OF BILLIONS OF DOLLARS.

SO THERE IS A TREMENDOUS AMOUNT OF MONEY AVAILABLE THROUGH THE STATE FUNDING.

NOW, HAVING SAID THAT, I AGREE WITH, UM, MY COLLEAGUES ON THE COUNCIL THAT THESE NUMBERS ARE TOO LOW.

UM, MOSTLY BECAUSE SOME OF OUR BUSINESSES ARE NOT NECESSARILY A SOPHISTICATED ENOUGH TO KNOW HOW TO ACCESS THAT MONEY.

AND IT CERTAINLY IS A LOT EASIER FOR THEM TO CONTACT A MEMBER OF COUNCIL OR TO WALK INTO THE CHAMBER OR TO WALK INTO CITY HALL AND SAY, HOW DO I STOP FROM GOING BANKRUPT? I NEED THIS BECAUSE OF THINGS THAT OCCURRED DURING COVID.

SO I WOULD AGREE WITH THE ROSE ON THE NUMBERS, I WOULD AGREE WITH THE CITY MANAGER ON WHERE TO TAKE THAT OUT OF THE BUDGET.

I MAY ADD.

I MEAN, WE HAVE, IF, IF THAT MONEY IS NOT USED, WE HAVE THE OPTION THAT IT CAN BE REALLOCATED TO ANOTHER ONE OF THESE CATEGORIES, RIGHT? YES.

SO I JUST WANTED TO SAY THAT THAT IF ANYBODY THINKS THAT THERE'S ALL THE MONEY THAT, THAT, UH, IS BEING OFFERED TO BUSINESSES, UM, OR RENTAL ASSISTANCE, THAT'S ABSOLUTELY NOT THE CASE.
