Public Comments shall be received at the beginning of the governing body meeting and limited to three (3) minutes per individual, with a total time limit of 30 minutes for all public comments, unless otherwise modified by the Chair.  Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

The general Public Comment portion of the meeting allows the public to address any item of City business not appearing on the scheduled agenda. Per Government Code Section 54954.3(a), such comments shall not be responded to by the governing body during the meeting.
 
 
CONSENT CALENDAR:
 
All matters on Consent Calendar are considered to be routine and will be enacted by one motion unless a Commissioner, City staff member, or member of the audience requests separate action or removal of an item. Removed items will be considered following the Consent Calendar portion of this agenda. Public comment shall be limited to three (3) minutes per individual, with a total time limit of 30 minutes per item that has been removed for separate discussion, unless otherwise modified by the Chair. Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

This project was reviewed pursuant to the guidelines of the California Environmental Quality Act (CEQA) and determined to be Categorically Exempt pursuant to Section 15301, Class 1: "Existing Facilities" of the CEQA Guidelines.
 
 
That the Planning Commission approve:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA APPROVING CONDITIONAL USE PERMIT 22-12 FOR THE OPERATION OF A RESTAURANT AT 1331 WEST IMPERIAL HIGHWAY, SUITES B AND C, AS PER THE APPROVED PLANS, MAKING THE APPROPRIATE FINDINGS AND SUBJECT TO CONDITIONS.

DULY NOTICED PUBLIC HEARING FOR CONSIDERATION OF A PLANNED COMMERCIAL INDUSTRIAL PRECISE PLAN 22-01 FOR THE CONSTRUCTION OF A 6,250 SQUARE FOOT COMMERCIAL BUILDING AT 731 EAST IMPERIAL HIGHWAY AND MAKING A RECOMMENDATION TO THE CITY COUNCIL OF THE CITY OF LA HABRA

On December 3, 2018, the City Council of the City of La Habra approved a Mitigated Negative Declaration of Environmental Impacts 17-02 (SCH2018071057) for a commercial center at 701 through 751 East Imperial Highway, subject to the Mitigation Monitoring and Reporting Program and the Statement of Findings of Facts.  Staff has determined that the subject request, Precise Plan 22-01, is consistent with the project analyzed by the previously-approved Mitigated Negative Declaration; all applicable mitigations measures have been made conditions of approval for the subject request. 
 
 
That the Planning Commission approve:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE APPROVING PLANNED COMMERCIAL-INDUSTRIAL PRECISE PLAN 22-01 FOR THE CONSTRUCTION OF A 6,250 SQUARE FOOT COMMERCIAL BUILDING AT 731 EAST IMPERIAL HIGHWAY, MAKING THE APPROPRIATE FINDINGS, AS PER THE APPROVED PLANS, AND SUBJECT TO CONDITIONS.

DULY NOTICED PUBLIC HEARING FOR CONSIDERATION OF DESIGN REVIEW 22-01 FOR THE VISTA GRANDE PARK IMPROVEMENT PROJECT AT 1101 WEST LAS LOMAS DRIVE

On August 1, 2019, the Planning Commission of the City of La Habra approved Mitigated Negative Declaration (MND) of Environmental Impacts 19-01 (SCH2019069091) for the Vista Grande Park Improvement Project, subject to the Mitigation Monitoring and Reporting Program and the Statement of Findings of Fact. Staff has reviewed Design Review 22-01 (proposed project) against the previously-approved MND and determined that said MND adequately analyzed and addressed all impacts of the proposed project. All applicable mitigation measures have been made conditions of approval of the proposed project.
 
 
That the Planning Commission approve:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA APPROVING DESIGN REVIEW 22-01 TO CONSTRUCT PARK IMPROVEMENTS AT 1101 WEST LAS LOMAS DRIVE, AS PER THE APPROVED PLAN, MAKING THE APPROPRIATE FINDINGS AND SUBJECT TO CONDITIONS.
 
CONSIDERATION ITEMS:
 
Any member of the audience may request to address the Commission on any Consideration Item, prior to the Commission taking a final vote on the item.  Public comment shall be limited to three (3) minutes per individual, with a total time limit of 30 minutes per Consideration Item, unless otherwise modified by the Chair. Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.
 
NOTE: The Planning Commission acts as the Design Review Board for projects within the Specific Plan that involve:
· Front landscaping if hardscape or encroachment is involved,
· Minor exterior changes such as doors and windows,
· Minor exterior or site changes,
· Exterior colors,
· Freestanding signs and neon signs,
· And similar projects shall be considered to ensure architectural compatibility.

The original project was reviewed pursuant to the guidelines of the California Environmental Quality Act (CEQA) and determined to be Categorically Exempt pursuant to Section 15303(C), Class 3: "New Construction or Conversion of Small Structures" of the California Environmental Quality Act Guidelines.
 
 
It is recommended that the Architectural Design Review Board approve the following motion:

A MOTION OF THE ARCHITECTURAL DESIGN REVIEW BOARD APPROVING ARCHITECTURAL DESIGN REVIEW 22-01 FOR THE CONSTRUCTION OF A FREESTANDING SIGN AT 1950 WEST LA HABRA BOULEVARD.
