APPROVE AND ADOPT RESOLUTION NO. ____ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA APPROVING GENERAL PLAN AMENDMENT 22-01 ADOPTING THE 2021-2029 (6th CYCLE) HOUSING ELEMENT OF THE LA HABRA GENERAL PLAN 2035, AS PER ATTACHMENT A; and B. Authorize staff to forward the City's Revised Draft 2021-2029 Housing Element to the California Department of Housing and Community Development (HCD) for review and certification. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Adoption of the updated Housing Element is exempt under State CEQA Guidelines §15061(b)(3) common sense exemption, because the Housing Element includes updated policies, programs, and actions that advocate for housing at all economic levels and meet the state legal requirements for a Housing Element. A key component of the updated Housing Element is the identification of existing sites in the Land Use Element that are designated for housing. These sites show that the City can meet their Regional Housing Needs Allocation (RHNA) without a general plan amendment or rezoning of property. All future construction must comply with policies in the General Plan, many of which are intended to address potential environmental impacts. Furthermore, all projects are subject to the adopted City ordinances, regulations, and policies that regulate and direct development of individual projects. The updated Housing Element does not change any of the development requirements in the City that are designed to mitigate or avoid environmental impacts. Based on these factors, it can be seen with certainty that there is no possibility that the proposed 6th Cycle Housing Element Update would have a significant effect on the environment; therefore, the 6th Cycle Housing Element is exempt from CEQA under the common sense exemption.] OKAY. WE'VE HAD QUITE A BIT OF PUBLIC OUTREACH. UM, WE'VE HAD GENERAL PLAN ADVISORY COMMITTEES. WE'VE HAD THE DRAFT ELEMENT POSTED ON OUR WEBSITE FOR A COUPLE OF YEARS NOW IN ALL ITS VARIOUS DIFFERENT ITERATIONS. UM, NOTICES FOR OF EVERY HEARING HAVE BEEN SENT OUT TO ALL THE GPAC MEMBERS AND ANY MEMBER OF THE PUBLIC THAT REQUESTED SUCH A NOTIFICATION AND ANYBODY THAT PARTICIPATED IN ANY OF OUR, OUR PREVIOUS MEETING OR GPAC MEETINGS. UH, SO PRIOR TO JULY 26TH, UH, LETTER WAS SENT, WE ALSO RECEIVED FROM THE, THE KENNEDY COMMISSION, UM, WHICH IS A HOUSING ADVOCACY GROUP BASED IN ORANGE COUNTY. SO HERE'S THIS A QUICK TIMELINE OF WHERE WE'VE BEEN THROUGH TO DATE. WE'VE BEEN TO THE PLANNING COMMISSION AND THE CITY COUNCIL A FEW TIMES. UM, THIS REPRESENTS OUR THIRD [00:10:01] DRAFT. UM, EACH TIME WE'VE RESPONDED TO COMMENTS RECEIVED FROM H CD AND TRIED TO REVISE OUR DRAFT TO BETTER MATCH UP WITH THEIR GOALS. UM, A LITTLE BIT MORE CHALLENGING THAN PREVIOUS HOUSING CYCLES. UM, IT WAS A LOT MORE OBJECTIVE BEFORE. UM, SO NOW WE'RE DEALING WITH REVIEWERS THAT HAVE THINGS THEY THINK WE SHOULD BE DOING AND SO WE'VE, WE'RE HAVING TO RESPOND TO THOSE. UM, SO IT'S TAKEN A LITTLE BIT MORE WORK, UM, THAT THIS, THIS TIME AROUND, SO ON THIS LATEST CYCLE, THE THINGS THAT THEY ASKED US TO WORK ON WAS THE INVENTORY OF THE HOUSING SITES, THE ACCESSORY DWELLING UNIT AFFIRMATIVELY FURTHERING FAIR HOUSING AND SELECT CITY CODE REQUIREMENTS TO FACILITATE HOUSING PRODUCTION AND ADDITIONAL DETAILS ON IMPLEMENTATION AND TIMEFRAME. SO TO DO THIS, THE INVENTORY OF SITES, THEIR MAIN CONCERN, UM, WAS DO THE, DO THE SITES THAT WE'VE SELECTED AND PUT IN THE HOUSING ELEMENT REALLY GONNA GET BUILT. ARE WE JUST PICKING LOTS AT RANDOM WHERE THERE'S NO REAL CHANCE OF DEVELOPMENT? WE'RE VERY CONFIDENT BASED ON INQUIRED. WE GET FROM DEVELOPERS, PROPERTY OWNERS AND PEOPLE GENERALLY INTERESTED IN DEVELOPING THEIR PROPERTIES THAT THE PROPERTIES WE'VE SELECTED HAVE A HIGH LIKELIHOOD OF SUCCESS OF BEING DEVELOPED INTO HOUSING UNITS. UH, WE HAD TO PROVIDE A LITTLE BIT MORE INFORMATION TO H CD TO BRING THEM OVER TO OUR WAY OF THINKING AND CONVINCE THEM THAT THAT WAS THE CASE. UM, ACCESSORY DWELLING UNITS. AGAIN, WE DEBATED HOW, HOW MANY THAT WE FELT WERE GONNA BE BUILT. UH, WE HAD A PRETTY HIGH NUMBER TO START WITH. WE DID SOME ADDITIONAL RESEARCH AND BASED ON THE NUMBER OF UNITS THAT HAVE BEEN BUILT DURING THE LAST THREE YEARS, UM, WHICH IS RIGHT AROUND A HUNDRED ALREADY, WE, WE WERE ABLE TO, UH, ADJUST THE NUMBER IN THE HOUSING ELEMENT TO ABOUT 250 OVER A NINE YEAR PERIOD, WHICH WE STILL THINK IS VERY CONSERVATIVE AND THAT WE'RE NOT GONNA HAVE ANY PROBLEM MEETING THAT GOAL. AND WE'RE PROBABLY GONNA EXCEED THAT GOAL. UM, AFFIRMATIVELY FURTHERING FAIR HOUSING, IN ADDITION TO BEING A TONGUE TWISTER IS, IS THE MOST SUBJECTIVE PART OF THE HOUSING ELEMENT. THEY HAVE, THEY HAVE GUIDELINES AND THEY HAVE OBJECTIVES THAT THEY'RE LOOKING FOR, BUT THERE'S NO REAL CODE THAT SAYS YOU WILL DO THIS. YOU WILL DO THAT. SO WE'VE ATTEMPTED TO COMPLY WITH THE GUIDELINES AND MEET THE INTENT OF WHERE THE STATE WAS GOING. UM, WE'VE BEEN IN CONSTANT CONTACT WITH OUR REPRESENTATIVES, BEEN REVIEWING OUR ELEMENT OVER THE LAST MONTH, TRYING TO WORK THROUGH THE DETAILS OF THE LANGUAGE. UH, WE THINK WE'VE GOT IT TO A POINT WHERE THEY'RE GOING TO BE HAPPY WITH IT. AND AGAIN, AND THEN THE OTHER THING IS ABOUT TIMELINES AND IMPLEMENTATIONS. WE'VE HAD TO TIGHTEN UP A FEW OF THE PROGRAMS AND POLICIES, BETTER AUDIENCE ON, OKAY, SORRY ABOUT THAT. I'M USUALLY PRETTY LOUD PEOPLE TO . UM, SO THAT'S KIND OF WHERE WE ARE. AGAIN, WE THINK WE ARE AT A POINT WHERE THE H CD WILL CERTIFY OUR ELEMENT AND EITHER RESPECT THAT THIS TIME AROUND THE DIFFERENCES, WE'RE ASKING THE COUNCIL TO ADOPT IT PREVIOUSLY, WE HAVE NOT ASKED THE COUNCIL TO DO THAT, UH, CUZ WE'VE ANTICIPATED CHANGES AND WE WANTED TO GIVE YOU A COMPLETE DOCUMENT BEFORE WE ASKED YOU TO ADOPT IT. UM, BUT IN THIS EVER CHANGING WORLD, UM, WE THINK IT'S IN THE BEST INTEREST OF THE COUNCIL TO ADOPT IT TONIGHT AND HOPE THAT HCD IS GOING TO SEE THINGS OUR WAY. SO WITH THAT, WE'D BE HAPPY TO ANSWER ANY QUESTIONS YOU HAVE ON QUESTION FROM COUNCIL SPECIFIC COUNCIL MEMBER, ROSE, SPINOZA, JUST, UH, CLARIFICATION THE AD, UH, THEY WILL COUNT TOWARDS THE 304 MANDATED BY THE STATE HCD. THEY DO COUNT TOWARDS, UH, 804, 804 THAT'S RIGHT. AND THEY SPECIFICALLY COUNT IN THE LOW AND VERY LOW CATEGORIES IS WHY IT'S BEEN SUCH A DEBATE. UM, BECAUSE THOSE ARE THE TWO CATEGORIES IT'S VERY HARD TO MEET BECAUSE HOUSING DEVELOPERS DEVELOPED FOR MARKET HOUSING. THEY, THEY DON'T BUILD AFFORDABLE HOUSING UNLESS THEY HAVE ALL KINDS OF INCENTIVES. UM, WE ADOPTED THE INCLUSIONARY ORDINANCE AS YOU RECALL TO INCENTIVIZE DEVELOPERS TO BUILD SOME AFFORDABLE UNITS, BUT WITHOUT THE AUS, WE WOULD NOT BE ABLE TO MEET THE GOAL. THANK YOU. THE FACT THAT YOU'RE ASKING US TO ADOPT TONIGHT INDICATES THAT YOU HAVE A PRETTY HIGH DEGREE OF CONFIDENCE THAT WE'LL MEET THAT CERTIFICATION WITH THIS. AND AT THE WORST CASE, MAYBE ONLY MINOR TWEAKS MIGHT BE REQUIRED. AND AS PART OF THE RESOLUTION BEFORE THE COUNCIL, YOU KNOW, WE'RE ASKING THAT IF THEY HAVE ADDITIONAL CHANGES THAT WE CAN WORK WITH THEM WITHOUT HAVING TO BRING IT BACK TO THE COUNCIL FOR FURTHER REVIEW, IF ANYTHING, IT'S GONNA BE TWEAKING OF SOME LANGUAGE. THE ONE REALLY BIG ISSUE THAT WE'RE CAUGHT UP IN IS OUR REQUIREMENT FOR CONDITIONAL USE PERMITS FOR GROUP HOUSING WITH MORE THAN SIX PEOPLE. OKAY. STATE LAW CLEARLY ALLOWS US TO ASK FOR THOSE CS FOR THOSE TYPES OF UNITS, H CD BELIEVES THAT'S AN IMPEDIMENT TO HOUSING DEVELOPMENT AND, AND THEY WANT US TO MAKE THAT REQUIREMENT GO AWAY. SHAW INDICATED THAT THE CITY WAS, UH, FACING IMMINENT BANKRUPTCY AND THAT IF IT WASN'T IMMINENT, IT WAS SOON FORTHCOMING THROUGH ALL SORTS OF UNFOUNDED ALLEGATIONS AND, AND CONDITIONS. AND THIS CAUSES FOLKS TO THINK THAT WHAT'S GONNA HAPPEN TO MY PROPERTY VALUES. NOW, IF THE CITY BECOMES BANKRUPT, WHAT'S GONNA HAPPEN TO THE CONDITION OF MY STREETS. AND IN POINT OF FACT, THIS CITY, AND THIS COMES FROM INDEPENDENT APPRAISERS AND ASSESSORS HAS A STANDARD IMP POORS CREDIT RATING OF DOUBLE A PLUS, WHICH IS A SOLID GOLD RATING INDICATING AN EXCELLENT FINANCIAL PRESENT AND A MOST SUSTAINABLE, EXCELLENT FISCAL FUTURE. SO THIS NOTION THAT WE ARE IN TROUBLE IS SIMPLY FALSE. THEY TALK, IT WAS MENTIONED THE PENSION REFORM EFFORTS. THIS COUNCIL UNDERTOOK EARLIER, YES, WE HAVE SOLVED OUR PENSION OBLIGATION ISSUES. NOW WE'RE PAYING BOND HOLDERS 3%. THAT'S A HUGE AMOUNT OF MONEY NOW THAT WE ARE SAVING HALF OF WHICH GOES INTO A RAINY DAY FUND, A SAVINGS ACCOUNT. SO IF CALPERS DOWN THE ROAD DOES CHANGE, THE FORMULA DOES CHANGE THE EQUATION. WE'VE GOT THE MONEY TO ADDRESS THAT, WHICH IS SOMETHING NOT A LOT OF CITIES DO, BUT THIS COUNCIL HAD THE FORESIGHT AND THE PRUDENCE TO DO EXACTLY THAT. THIS IS SOMETHING THIS COUNCIL DOES NOT SUPPORT. WE BELIEVE IN LOCAL CONTROL. WE BELIEVE IN REASONABLE ACCOMMODATION, NEW BUILDING REQUESTS, NOT WILLY-NILLY BUILDING THESE CANDIDATES, UH, WOULD APPEAR BELIEVE IN SOMETHING DIFFERENT. AND SO THIS IS THE FIRST PART OF AN EFFORT I BELIEVE, UH, TO BEGIN THIS POLITICAL CAMPAIGN, WHICH WILL END IN MAIL THAT WILL MAKE SPURIOUS ACCUSATIONS AND SAY TERRIBLE THINGS. WE CAN'T PUT A TRADER JOE'S, WE CAN'T PUT A WHATEVER IT IS, AND I'M CONSTANTLY ASKING THEM. AND I KNOW THE OTHER MEMBERS OF COUNSELORS SAYING, PLEASE INCLUDE THE HEIGHTS AS PART OF OUR, UH, DEMOGRAPHIC STUDY, BECAUSE THEY DON'T HAVE A, A PLACE TO SHOP OTHER THAN LAHABRA. UH, IT'S, IT'S A HARD SELL. SO UM, WHAT YOU SAID IS ESPECIALLY PROBLEMATIC, ESPECIALLY PROBLEMATIC TO ME PERSONALLY AND AT, AT AGE 77, UH, UM, IT'S A LITTLE MORE DIFFICULT TO, TO HOLD, UH, THE LINE. SO I WAS JUST, BUT HE WAS OUT THERE AND I'M VERY PROUD OF ALL THE PUBLIC WORKS, ALL THE STAFF THAT WAS OUT THERE, ALL THE GIRL SCOUTS, BOY SCOUTS, UM, EVERYONE THAT WAS OUT THERE AND UH, THEY DID QUITE A JOB CLEANING UP THE POLICE DEPARTMENT AS WELL. SHE WAS PART OF OUR LAJA POLICE FAMILY AND ALWAYS A RADIANT HAD ALWAYS HAD A RADIANT SMILE AND TO EVERYONE THAT SHE KNEW HER ON BEHALF OF THE CITY COUNCIL AND THE COLLEAGUES, WE EXTEND OUR DEEPEST CONDOLENCES TO, UH, CHIEF DAVE HENICK AND THE FAMILY. AND THOSE OF YOU WHO KNEW CAROLYN, SHE JUST FIT IN PERFECTLY. SHE WAS JUST A DEDICATED WIFE. SHE WOULD COME TO ALL OUR, OUR LAHABRA EVENTS, OUR OPEN HOUSES, AND SHE'D BE ALWAYS ALONG, UH, CHIEF HENICK SIDE. AND SHE'S A WONDERFUL LADY. SO, YOU KNOW, WE, WE HAVE 8.3 MILLION IN RESERVES THAT COUNTS FOR ABOUT 18% OF THE BUDGET S AND P RATING. AS YOU SAY, AA PLUS, AND OUR, UH, DIRECTOR OF FINANCES, MEL SHANNON HAS RECEIVED AWARDS. UH, NUMEROUS AWARDS HAS BEEN RECOGNIZED BY SEVERAL INDIVIDUALS IN THE INDUSTRY, UH, FOR THE WORK HE DOES WITH OUR FINANCES. HE'S THE BEST OF THE BEST. UH, AND ADDITION TO THAT, OUR CITY MANAGER, WHO IS A FORMER FINANCE DIRECTOR, UH, IT'S LIKE HAVING A, YOU KNOW, DOUBLE PEOPLE DOWN THERE WHO, WHO RECOGNIZE OUR FINANCES AND KNOW THAT, YOU KNOW, OUR LAST BUDGET. I MEAN, FOR SEVERAL YEARS, WE'VE ALWAYS HAD A CUT CUT, CUT, CUT, CUT. AND FOR THE FIRST YEAR THAT I CAN REMEMBER MANY YEARS, WE, WE FUNDED A FULLY FUNDED BUDGET. WE ADDED MONEY TO THE POLICE DEPARTMENT. WE ADDED MONEY, UH, TO THE RAINY DAY FUND. WE ADDED MONEY TO, FOR CAPITAL IMPROVEMENTS. ALL THE CAPITAL IMPROVEMENTS ARE GONNA BE GOING ON NOW AT LIONVILLE CENTRAL PARK, UH, THERE, THAT WAS ADDED IN, IN THIS LAST BUDGET. UM, WE HAVE AN INDEPENDENT AUDITOR THAT ALWAYS COMES IN AND CHECKS, UH, WHERE OUR FINANCES ARE. UH, SO I INVITE THE PUBLIC. DON'T TAKE DARREN'S WORD FOR IT OR ANY ONE OF THE COUNCIL MEMBERS. WE HAVE AN OPEN DOOR POLICY TO COME IN AND CHECK FOR YOURSELF AND LOOK EXACTLY WHERE WE'RE AT WITH OUR FINANCES. YOU KNOW, I DID, I DID SUPPORT, UH, THE PENSION BOND IN MY HEART OF HEARTS.
