THE FIRST ITEM FOR YOU TONIGHT IS A REQUEST, UM, FROM TARGET TO AMEND THEIR EXISTING AND CONDITIONING PERMIT OH 6 27, UH, WHICH ORIGINALLY ALLOWED THE SALE OF BEER WINE FOR OFFSITE CONSUMPTION UNDER A TYPE 20, UM, A B, C LICENSE TO NOW INCLUDE THE SALE OF DISTILL SPIRITS, UM, UNDER A TYPE 21, A B ABC LICENSE.

SINCE TARGET HAS OPERATED AT 1000 WEST IMPERIAL HIGHWAY SINCE 2006 AND IS LOCATED WITHIN THE IMPERIAL PROMENADE SHOPPING CENTER, SORRY, THERE YOU GO.

THE SIDE IS LOCATED ON THE SOUTHEAST CORNER OF IMPERIAL AND IDAHO.

IT HAS A C TWO S, UH, ZONING WITH A COMMERCIAL SHOPPING CENTER, ONE GENERAL LAND USE, UM, DESIGNATION TO THE, UH, NORTH, UM, ACROSS THE STREET.

UM, THE PROPERTY IS SURROUNDED BY, UH, COMMERCIAL PROPERTIES AND MULTIFAMILY

TARGET OCCUPIES A, AN EXISTING TENANT SPACE SET IS 136,000 SQUARE FEET, UH, AND INCLUDES A VARIETY OF PRODUCTS AND A STARBUCKS, A C V S PHARMACY AND A ULTA BEAUTY, UM, SECTION.

THE APPLICANT'S DESIRE NOW IS TO, UM, PROVIDE A VARIETY OF ALCOHOLIC BEVERAGES TO PROVIDE A ONE-STOP SHOPPING EXPERIENCE FOR EXPERIENCE FOR ITS, UM, CUSTOMERS.

AS YOU CAN SEE ON THE SCREEN, UM, OUTLINED BY A YELLOW BOX, UM, IT SHOWS A LOCATION WHERE THE APPLICANT IS PROPOSING TO DISPLAY THE PRODUCTS.

UM, THEY WILL USE TWO EXISTING, UM, AISLES AND A PORTION OF THE EXISTING REFRIGERATOR.

UH, THIS AREA, UM, COMES OUT TO APPROXIMATELY, UM, 780 SQUARE FEET, UH, WHICH IS LESS THAN 1% OF THE ENTIRE, UM, STORE AREA.

OH, SORRY.

THE, AS PART OF THE PROPOSAL, THE APPLICANT IS NOT PROPOSING ANY MODIFICATIONS TO THE, UM, EXISTING SQUARE FOOTAGE, UH, NOR ARE THEY PROPOSING TO, UM, CHANGE THE HOURS OF OPERATION.

UM, THE, UM, REQUEST DOES NOT REQUIRE ADDITIONAL PARKING.

UH, SO IT ALL OVERALL ENCOMPASSES A CHANGE TO AN EXISTING ANCILLARY USE ON THE SITE.

STAFF ALSO CONFIRMED WITH THE LAHABRA POLICE DEPARTMENT, THEY DID NOT HAVE ANY CONCERNS WITH THE REQUEST, NOR HAVE THEY RECEIVED ANY, UM, CALLS OR COMPLAINTS SINCE 2006 REGARDING THE SALE OF THE ALCOHOLIC BEVERAGES.

THE CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE AND CONTROL, UM, IS THE STATE ENTITY THAT ISSUES RENEWS AND REVOKES, UM, THE LICENSES, AND THEN THEY DETERMINE THE NUMBER OF LICENSES BASED ON THE POPULATION WITHIN, UM, CENSUS TRACKS.

UM, THE SITE IS LOCATED WITHIN, UM, CENSUS TRACK NUMBER 1706, WHICH ALLOWS, UM, UP TO TWO OFF SALE, UH, LICENSES, UH, THE UNCOVERS THE CITY OF LAHABRA AND AS WELL AS A PORTION OF THE CITY OF FULLERTON.

AT THE TIME THAT THE APPLICANT SUBMITTED THE REQUEST, THERE WERE TWO ACTIVE ABC LICENSES, ONE OF WHICH IS OF TARGETS EXISTING BEER AND WINE.

AND, UH, THERE WAS ANOTHER ONE FOR A LIQUOR STORE.

UM, SINCE THEY'VE SUBMITTED THE LIQUOR STORE APPLICATION HAS BEEN WITHDRAWN, UH, BUT SINCE AT THE TIME THAT THEY SUBMITTED, UM, THEY'RE ALREADY TWO AND THIS WOULD BE THE THIRD, UM, IT WOULD, IT'S CONSIDERED A CONCENTRATION, AN UNDUE CONCENTRATION, AND AS A RESULT, A PUBLIC CONVENIENCE OR NECESSITY FINDING IS REQUIRED BY THE PLANNING COMMISSION.

UM, STAFF CONSIDERED, UM, THIS PROPOSAL AND, UM, DETERMINED THAT THE, UM, THE REQUESTS WOULD NOT, UM, OR WOULD BE CONSIDERED, UM, SORRY.

IT COULD BE CONSIDERED AS A, UM, A PUBLIC CONVENIENCE.

UM, SINCE THE BUSINESS ALREADY PROVIDES A VARIETY OF PRODUCTS AND SERVICES, AND THIS IS ONLY ANCILLARY USE TO THE EXISTING BUSINESS STAFF WAS ABLE TO MEET ALL THE REQUIRED FINDINGS FOR THE USE.

UM, THE APPLICANT HAS DEMONSTRATED WITHIN THE LAST 16 YEARS THAT THEY CAN, UM, COMPLY WITH ABC REQUIREMENTS AS WELL AS, UM, COMPLY WITH OTHER CONDITIONS OF APPROVAL AND BE COMPATIBLE WITH THE SURROUNDING PROPERTIES.

UM, ALL OF THE APPLICABLE CONDITIONS OF APPROVAL UNDER, UM, 2000 UNDER THE UM, C P OH SIX DASH 27 HAVE BEEN CARRIED ON INTO THE SIX THIS PROPOSED APPROVAL.

UM, AND THAT INCLUDES, UM, A VARIETY OF THINGS, BUT IT'S NOT LIMITED TO, UM, SURVEILLANCE CAMERA SYSTEM, UH, EMPLOYEE TRAINING CERTIFICATION, UM, IDENTIFICATION CARD SCANNERS.

UH, UNDER THIS PROPOSAL, WE'RE ALSO STANDARDIZING THE LANGUAGE AND REMOVING, UH, CONDITIONS OF APPROVAL THAT ARE NO LONGER APPLICABLE, UM, THAT HAVE TO DO WITH RESTRICTIVE, UM, REQUIREMENTS FOR THE MAXIMUM MINIMUM SIZES OF, UM, THE DRINKS.

I'VE BEEN DOING THE ALCOHOL LICENSING FOR TARGET IN CALIFORNIA SINCE THE EARLY TWO THOUSANDS WHEN THEY FIRST STARTED, UH, ADDING ALCOHOLIC BEVERAGES TO THEIR PRODUCT MIX.

UM, I THINK THOSE STAFF PRESENTATION AND REPORT WERE VERY COMPLETE, SO I'LL KEEP MY COMMENTS BRIEF.

UM, AS WAS INDICATED, UH, TARGET HAS BEEN, UH, PERMITTED FOR BAREN WINE OFF SALE, BAREN WINE SALE SINCE 2006 WHEN THE STORE OPENED.

UM, SINCE THAT TIME TARGETS BUSINESS BUSINESS MODEL HAS CHANGED, UM, IN, IN SO FAR AS, UH, IT HAS A MUCH MORE SIGNIFICANT GROCERY COMPONENT NOW, UH, AS PART OF THE OVERALL STORE, UH, OFFERINGS.

AND SO IN CONNECTION WITH THAT GROCERY, UH, SECTION, TARGET WOULD LIKE TO BE ABLE TO OFFER CUSTOMERS THE FULL, UH, SELECTION OF ALCOHOLIC BEVERAGE PRODUCTS, UH, WHICH I THINK CUSTOMERS EXPECT WHEN THEY'RE BUYING GROCERIES OR ABLE TO BUY GROCERIES.

UM, ABOUT 95% OF THE TARGET STORES IN CALIFORNIA DO SELL, UM, A FULL ARRAY OF ALCOHOLIC BEVERAGE PRODUCTS.

UH, SO IT'S SOMETHING THAT TARRY CUSTOMERS HAVE GOTTEN USED TO.

I KNOW, UH, FROM TALKING TO SOME OF THE TEAM LEADERS AT THIS STORE THAT THEY'VE GOTTEN QUESTIONS FROM CUSTOMERS WHO WOULD LIKE TO BE ABLE TO BUY, UM, DISTILLED SPIRITS AT THIS STORE AS WELL.

UM, AND SO, UH, WE ARE HOPING THAT THE, UH, COMMISSION WILL APPROVE THE MODIFICATION, UH, WITH STAFF SUPPORT.

THE FOUR TRELLISES WERE INSTALLED WITHOUT, UM, CITY'S APPROVAL.

UM, SOMETIME BETWEEN AUGUST AND SEPTEMBER.

THE TRELLISES WERE PLACED, UM, DIRECTLY OUTSIDE OF THE RESTAURANT AREA, UM, WHICH IS THE WESTRIDGE GARDEN BARBECUE RESTAURANT.

THE TRELLISES ARE MADE OUTTA PRE-FABRICATED ALUMINUM FAUX WOOD MATERIAL AND ARE COLORED WHITE.

EACH ONE IS 240, UH, SQUARE FEET IN SIZE AND IS SEVEN FEET AND 10 INCHES IN HEIGHT.

THE APPLICANT IS ALSO PROPOSING TO ATTACH, UH, HEATERS AND FANS TO EACH TRELLIS, AND THE TRELLIS WILL COVER, UM, ABOUT NINE, UM,

UM, SHE WAS NOTIFIED THAT A MODIFICATION TO THE P U D WAS REQUIRED BEFORE SHE CAN PROCEED.

AND, UM, SUBSEQUENTLY AND ON OCTOBER 5TH, UM, OF THIS YEAR, SHE CAME IN TO SUBMIT HER APPLICATION.

STAFF WAS ABLE TO MAKE ALL THE REQUIRED FINDINGS PER THE LAHABRA MUNICIPAL CODE.

UH, THE TRELLISES ARE LOCATED WITHIN AN EXISTING OUTDOOR DINING AREA AND WILL NOT RESULT IN ANY EXPANSIONS TO THE EXISTING CLUBHOUSE, UM, THE RESTAURANT USE, UM, NOR WILL THEY REQUIRE ANY CHANGES TO THE, UM, OUTDOOR SPACE OF THE GOLF COURSE.

AND IN TERMS OF THE DESIGN, THE TRELLIS COMPLEMENT, THE TAN COLOR AND WHITE TRIM AND MOLDING, UM, THAT YOU SEE ON THE BUILDING.

THE FOUR TRELLIS DO NOT CONFLICT WITH THE DEVELOPMENT STANDARDS, UH, WITHIN THE EXISTING LAHABRA SPECIFIC PLAN, WHICH DOES NOT REQUIRE A MINIMUM SETBACK, UM, BETWEEN THE BUILDINGS AS WELL AS A MAXIMUM HEIGHT.

THEREFORE, THE LOCATION DESIGN AND THE PROPOSED USE OF THE TRELLISES ARE COMPATIBLE WITH THE EXISTING CHARACTER OF THE GOLF COURSE AS WELL AS THE SURROUNDING RESIDENTIAL AND COMMERCIAL PROPERTIES.
