MY NAME'S DAVID LOPEZ AND I'LL BE, UH, RUNNING THROUGH THE PRESENTATION THIS EVENING.

THE SUBJECT PROPERTY IS LOCATED ON THE CORNER OF WHITTIER AND ELM STREET.

IT IS A C2 COMMERCIAL ZONE.

UM, THE PROPERTY SIZE IS APPROXIMATELY 12,000 SQUARE FEET AND IT CONTAINS A 1500 SQUARE FOOT VACANT COMMERCIAL BUILDING THAT WAS CONSTRUCTED IN 1962.

THE RESTAURANT, UH, GOLDEN STAR CHINESE RESTAURANT WAS IN OPERATION FROM TWO, FROM UH, NINE FROM UH, 1971 TO 2018.

UH, DECEMBER, 2018 IS WHEN THE RESTAURANT CEASES TO OPERATE AND SINCE MORE THAN A YEAR HAS PASSED, SINCE THE PROPERTY HAS RAIN VACANT, ANY REUSE FOR THE PROPERTY FOR RESTAURANT UH ACTIVITIES REQUIRES A C U P OR CONDITIONAL USE PERMIT.

THE SUBJECT, UH, CONDITIONERS PERMIT FOR THE RESTAURANT INVOLVES A BABY BROS PIZZA AND WINGS RESTAURANT.

IT WILL SPECIALIZE IN THE PREPARATION OF VARIETY OF PIZZAS, SANDWICHES, CHICKEN WINGS, PASTAS, POTATOES AND SALADS.

ALSO PROPOSED IS THE ON UH, SITE CONSUMPTION OF BEER AND WINE UNDER THE TYPE 41, UH, LICENSE ISSUED BY THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL OR ABC.

THE PROPOSED HOURS OPERATION ARE FROM 11:00 AM TO 10:00 PM SEVEN DAYS A WEEK, AND, UH, WITH FOUR EMPLOYEES, THE ONSITE IMPROVEMENTS ARE SHOWN ON THE NEXT SLIDE.

STARTING WITH THE ADDITION, THERE'S A 320 SQUARE FOOT ADDITION THAT'S PROPOSED ON THE SOUTH SIDE OF THE BUILDING HIGHLIGHTED IN GRAY FOR A TOTAL BUILDING AREA OF 1,820 SQUARE FEET.

OTHER ONSITE IMPROVEMENTS INCLUDE LANDSCAPING ALONG THE FRONT, ALONG ELM STREET AND ALONG THE SOUTH PROPERTY LINE.

A TOTAL OF 16 PARKING SPACES ARE PROPOSED, INCLUDING ONE OF ACCESSIBLE PARKING SPACE.

THE AMOUNT OF ONSITE LANDSCAPING TOTALS 459 SQUARE FEET.

ALSO PROPOSED IS AN OUTDOOR DINING AREA LOCATED ALONG THE FRONT OF THE PROPERTY, WHICH INCLUDES A COMBINATION OF HARDSCAPE AND LANDSCAPING IMPROVEMENTS.

THIS WOULD CREATE TWO OUTDOOR DINING AREAS, APPROXIMATELY 275 SQUARE FEET EACH, ON BOTH, UH, SIDES OF THE MAIN INTER ENTRYWAY FACING WHITTER BOULEVARD.

UM, OUTDOOR DINING AREAS WILL BE, UH, SECURED WITH A THREE FOOT HIGH METAL FENCE.

ALSO PROPOSED IS A NEW TRASH ENCLOSURE LOCATED ALONG THE SOUTH PROPERTY LINE, AND THE FREESTANDING SIGN THAT'S LOCATED ALONG WHITTIER BOULEVARD, WHICH HAS BEEN ABANDONED AND IN DISCONTINUED FOR OVER A YEAR, DOES NOT COMPLY WITH CURRENT SIGN CODE REQUIREMENTS.

AND AS SUCH, IT IS CONDITIONED TO BE REMOVED.

ALSO PROPOSED IS A TWO AND A HALF FOOT DEDICATION ALONG THE SOUTH

PROPERTY LINE REQUIRED FOR, UH, TO OBTAIN THE ALLEY WIDTH THROUGH THE ENGINEERING DEPARTMENT PURSUANT TO SECTION 18.0 8.070 B.

ANY SITE WHICH IS SUBJECT TO A DISCRETIONARY ACTION BY THE PLANNING COMMISSION OR CITY COUNCIL, SHALL BE BROUGHT INTO CONFORMANCE TO CURRENT CODE STANDARDS TO THE EXTENT PHYSICALLY POSSIBLE AS DETERMINED BY THE PLANNING COMMISSION AS OUTLINED IN THE STAFF REPORT, THERE ARE VARIOUS EXISTING NON-CONFORMING FEATURES, INCLUDING THE BUILDING SETBACK ALONG ELM STREET.

THE PROJECT APPLICANT HAS MADE AN ATTEMPT TO COMPLY WITH BOTH IMPROVING THE PROPERTY, UH, CON CONSTRUCTING LANDSCAPING TO MEET CURRENT STANDARDS, BUT IT'S STILL DEFICIENT.

UM, THE PROPERTY WILL REMAIN, UH, DEFICIENT BY 1% IN TERMS OF THE ONSITE LANDSCAPING AND DEFICIENT BY TWO PARKING SPACES AS REQUIRED BY CODE.

BUT AGAIN, UH, THE APPLICANT HAS MADE AN ATTEMPT TO COMPLY WITH ALL THE STANDARDS TO THE EXTENT PHYSICALLY POSSIBLE.

THE PROPOSED FLOOR PLAN SHOWS THE LAYOUT AND THE PROPOSED USE OF THE ADDITION, WHICH IS ON THE SOUTH SIDE.

BY INCREASING THE BUILDING SIZE, IT ALLOWS THE OPPORTUNITY FOR THE CONSTRUCTION OF TWO ADA RESTROOMS. THE DINING AREA WILL BE IMPROVED WITH 48 SEATS AND A WAITING AREA NEAR THE FRONT OF THE PROPERTY.

UM, ALSO PROPOSED IS A NEW ENTRYWAY ALONG THE SOUTH SIDE OF THE BUILDING AND THE ALCOHOLIC BEVERAGES WILL BE STORED ON SITE WITHIN THE STORAGE AREA.

THE TYPE 41 BEER AND WINE LICENSE IS AN ANCILLARY USE TO THE RESTAURANT FUNCTION, ALLOWING FOR BEER AND WINE TO BE SERVED INSIDE THE RESTAURANT AS WELL AS OUTSIDE WITHIN THE SECURED OUTDOOR SEATING AREA OR DINING AREA.

THE RESTAURANT IS LOCATED WITHIN THE CENSUS, TRACKED 14.01, WHICH HAS BOUNDARIES EXTENDING FROM WALNUT ALL THE WAY TO HARBOR.

THE DEPARTMENT OF ALCOHOL BEVERAGE CONTROL ALLOWS FIVE ON SALE LICENSES.

THERE ARE CURRENTLY SIX, UH, ACTIVE ON SALE LICENSES, SO THE PROPOSED WOULD BE A SEVENTH LICENSE WITHIN THE TRACT.

THE DEPARTMENT OF ALCOHOL BEVERAGE CONTROL WILL REQUIRE THE APPLICANT TO DEMONSTRATE THE PUBLIC CONVENIENCE AND NECESSITY OR THE P C N FINDING, UH, THAT WOULD SERVE, THAT WOULD BE SERVED BY THE ISSUANCE OF THE LICENSE.

SO IN ORDER TO COMPLY, UM, STAFF HAS INCLUDED CONDITIONS THAT ARE SIMILAR TO OTHER RESTAURANTS WITH THE SAME BUSINESS TYPE TO, UH, REMAIN COMPATIBLE WITH OTHER RESTAURANTS IN THE CITY.

AND LASTLY, THE IMPROVEMENTS OF FACADE IMPROVEMENTS AS SHOWN, UH, THE BUILDING WILL BE COMPLETELY REMODELED.

THIS WOULD INCLUDE, UH, NEW CONTEMPORARY LOOK.

UH, THE BUILDING ELEVATIONS INCLUDE STUCCO.

UH, IT ALSO INCLUDES A, A BRICK VENEER AND TEXTURED WALL PANELS.

UM, ALSO PROPOSED ARE BLACK CLOTH AWNINGS ALONG THE OPENINGS AND THE WINDOWS TO ENHANCE THE BUILDING.

SO OVERALL STAFF IS RECOMMENDING APPROVAL OF THE PROJECT.

THE APPLICANT HAS MADE AN ATTEMPT TO COMPLY WITH THE CURRENT CODE STANDARDS.

HOWEVER, THERE ARE STILL SOME NON-CONFORMING ISSUES, BUT WE TRY TO, UM, ADDRESS THOSE AS PART OF THIS ACTION.

THAT CONCLUDES MY PRESENTATION AND I'LL BE HAPPY TO ANSWER ANY QUESTIONS.

THE DESIGN OF THE TRASH ENCLOSURE WAS DESIGNED ON THE SOUTH PROPERTY LINE BASED ON A DIFFERENCE IN GRADE.

IF THE TRASH ENCLOSURE WERE TO BE ON LEVEL GROUND, IT WOULD ELIMINATE MORE PARKING.

SO WE TRY TO HAVE A ADJUSTMENT, UM, TO DESIGN IT TO THE EXTENT PHYSICALLY POSSIBLE TO COMPLY WITH PARKING AND ONSITE LANDSCAPING.

MY ONLY ISSUE IS IT'S LIKE KIND OF A SAFETY ISSUE.

YOU KNOW, YOU CAN HAVE KIDS GO DUMP THE, THE TRASH AND HAVE TO GO ALL THE WAY AROUND AND THEY'RE GONNA HAVE TO GO PAST THE, THE DRIVEWAY.

SO THAT'S WHAT I'M LOOKING AT.

THAT'S MY CONCERN ON THAT, IS THE TRASH AND CLOTHES ARE GONNA BE THE SAME COLOR AS THE BUILDING.

YES, THERE'S A CONDITION THAT REQUIRES

THE WALLS TO BE PAINTED THE SAME WAY, BUT THERE IS A, A RETAINING WALL THAT WILL BE CONSTRUCTED ALONG THE SOUTH PROPERTY LINE IN ORDER TO LEVEL OFF THE REAR SECTION OF THE PARKING LOT.

UM, WE DO HAVE STANDARD CONDITIONS THAT REQUIRE PAINTING OF THE TRASH ENCLOSURE TO, TO BE SIMILAR IN COLOR AS THE MAIN BUILDING.

SO THE DEPARTMENT OF A ALCOHOL, ALCOHOL BEVERAGE CONTROL DIVIDES THE CITY INTO DIFFERENT CENSUS TRACKS.

THIS PARTICULAR RESTAURANT IS LOCATED WITHIN CENSUS TRACT 14.01.

THE BOUNDARIES START FROM, UH, WALNUT STREET ALL THE WAY TO HARBOR.

AND WITHIN THIS CENSUS TRACK THERE ARE, UH, SIX ACTIVE LICENSES.

WE, I KNOW WE DID HAVE A PROJECT THAT, UH, REQUESTED THE SAME IN SIMILAR COLORS THAT WE, IT, IT DIDN'T CONTINUE.

HOW DO WE FEEL ABOUT THAT SINCE IT, IT DOESN'T MATCH ANY OF THE SURROUNDING AREAS.

AND I, AND I GET IT, YOU WANNA STAND OUT? UH, I I TOTALLY GET THAT.

I DO, BUT IT, IT, IT DOESN'T MATCH THE OVERALL LANDSCAPE OF THE COMMUNITY THAT WHAT WE'VE BEEN TRYING TO BUILD.

SO IS THERE ANY, WAS THERE ANY DISCUSSION ON THAT? WE, WE DIDN'T HAVE ANY DISCUSSION ON THE PAINT COLORS, BUT WE DO HAVE THE ABILITY TO RECOMMEND A DIFFERENT, UH, MAIN WALL COLOR IF WE NEED.
