GOOD EVENING COMMISSIONERS.

THE FIRST ITEM BEFORE YOU TONIGHT IS A REQUEST BY MR. PATEL, THE APPLICANT, UM, TO CONSTRUCT A NEW TWO-UNIT COMMERCIAL, UM, BUILDING AT SEVEN 11 EAST IMPERIAL HIGHWAY AND TO ALSO REQUEST THE OPERATION OF A DRIVE-THROUGH RESTAURANT, UM, UNDER DUNKING DONUTS, UH, WITHIN ONE OF THE TENANT SPACES AND RESERVE THE SECOND TENANT SPACE FOR A FUTURE RETAIL USE.

THE SITE IS LOCATED, UH, NORTH OF IMPERIAL WITH COMMERCIAL USES AND INDUSTRIAL USES TO THE, UM, SIDES AND TO THE NORTH AND RESIDENTIAL TO THE SOUTH.

THE SITE IS PART OF A MASTER PLAN THAT WAS APPROVED IN 2018.

THE MASTER PLAN INCLUDES FOUR PROPERTIES, WHICH INCLUDES A, UH, HOTEL UNDER LA QUINTA INN AND SUITES.

UH, IT INCLUDED TWO DRIVE-THROUGHS, ONE OF WHICH WAS THE SUBJECT SITE.

UM, IT WAS THE POPEYE'S, UH, LOUISIANA KITCHEN.

UH, THE APPLICANT FOR THAT PROJECT DID NOT MOVE FORWARD WITH IT.

AND THE OTHER, UH, DRIVE-THROUGH IS THE TACO BELL, UH, TO THE EAST AND THAT'S BEEN, UM, HAS BEEN CONSTRUCTED AND IS UNDER OPERATION.

AND, UM, THE PROJECT ALSO INCLUDED, UM, A RETAIL SPACE, UH, TO THE NORTH UNDER PARCEL FOUR, WHICH, UM, EVENTUALLY WAS APPROVED FOR A, UM, HALLMARK RETAIL STORE, UM, THAT WAS APPROVED BY THE PLANNING COMMISSION IN 2022.

ALL OF THE SITE IMPROVEMENTS, UM, RELATED TO THE UTILITIES, UM, DRY VIALS AND, UM, ONSITE AND OFFSITE IMPROVEMENTS HAVE BEEN CONSTRUCTED.

THE PROPOSAL BEFORE YOU TODAY IS SIMILAR TO WHAT WAS PREVIOUSLY APPROVED.

THE APPLICANT IS PROPO, IS ORIENTING THE BUILDING IN A SIMILAR LAYOUT AS WHAT WAS PREVIOUSLY APPROVED WITH THE DRIVE-THROUGH, WRAPPED AROUND, UH, THE FRONT OF THE SIDE AND WITH A LARGE LANDSCAPE BUFFER.

THE BUILDING COMPLIES WITH ALL OF THE REQUIRED, UM, DEVELOPMENT STANDARDS.

A TOTAL OF 23 PARKING SPACES ARE PROVIDED, WHICH COMPLY WITH CODE.

A TRAFFIC ASSESSMENT WAS CONDUCTED, WHICH DETERMINED THAT OTHERS LESS THAN SIGNIFICANT, UM, TRAFFIC IMPACTS.

THIS IS THE FLOOR PLAN OF THE BUILDING.

ON THE RIGHT HAND SIDE, YOU SEE DUNKIN DONUTS, WHICH INCLUDES FIVE TABLES THAT CAN ACCOMMODATE UP TO 18 SEATS AND THE VACANT RETAIL SPACE TO THE LEFT.

THE BUILDING WILL HAVE A CONTEMPORARY STYLE, UH, DESIGN AND WE'LL INCLUDE ALSO, UM, BROWN, UH, WOOD AND SIDING AND LIGHT RATES STECCO, UH, TO COME TO BE CONSISTENT AND COMPATIBLE WITH THE ARCHITECTURAL STYLES AND FEATURES, UM, OF THE OTHER BUILDINGS.

UM, ON THE MASTER PLAN N THE DUNKING DONUTS, UH, UNIT ALSO INCLUDES, UM, ACCENT COLORS AND, UM, DARKER SHADES THAT ARE CONSISTENT WITH THE DUNKING DONUTS BRAND DESIGN.

A TOTAL OF THREE, UM, WALL SIGNS ARE PROPOSED WITH TWO, UM, DIRECTIONAL SIGNS AND ALSO THE DRIVE-THROUGH MENU AND CANOPY SIGN.

A Q ANALYSIS WAS CONDUCTED FOR THE DUNKING DONUTS.

THE ANALYSIS DETERMINED THAT, UM, THE SITE HAS MORE THAN SUFFICIENT SPACE TO ACCOMMODATE, UM, THE WORST CASE SCENARIO, WHICH IS NINE VEHICLES, UM, AND ALLOWS, UM, THREE ADDITIONAL, UH, VEHICLES FOR THE ADDITIONAL OVERFLOW.

UH, WITHOUT IMPACTING THE DRY VIALS AND THESE SURROUNDING USES, OVERALL STAFF WAS ABLE TO MAKE THE FINDINGS FOR THE, UM, TWO APPLICATIONS.

THE, UM, PROPOSED THE PROPOSAL WILL INTEGRATE WELL WITH THE MASTER PLAN IN TERMS OF DESIGN, SCALE AND STYLE, AND WILL BE COMPATIBLE WITH THE SURROUNDING USES.

STAFF DID NOT RECEIVE ANY COMMENTS, UH, REGARDING THIS APPLICATION.

IN TERMS OF THE, UM, QUA, UH, THE PROJECT WAS INITIALLY, UM, NOTIF NOTICED, UM, TO BE, UM, IN COMPLIANCE WITH THE CERTIFIED M AND D THAT WAS APPROVED FOR THE MASTER PLAN, BUT WITH FURTHER, UM, STAFF WITH FURTHER ANALYSIS, IT WAS DETERMINED THAT THE PROJECT ACTUALLY QUALIFIES AS A CATEGORICAL EXEMPTION.

AND THIS IS, UM, NOTED IN THE STAFF REPORT AS WELL AS ON THE RESOLUTIONS AND THE DRAFT ORDINANCE.

AND, UM, THE OUR TRAFFIC, UM, ENGINEER, UM, NOTED THAT YOU DIDN'T REALLY HAVE ANY CONCERNS BECAUSE THERE'S ENOUGH SPACE TO ACCOMMODATE THE, UM, CUING OF THE VEHICLES ON THE SIDE WITHOUT SPILLING OVER INTO LIKE THE MAIN DRIVEWAYS OR ONTO THE STREET.

AND UPDATE FOR CONSISTENCY WITH ALL FEDERAL AND STATE LAW REQUIREMENTS.

SO THIS ALSO INCLUDES FREEDOM OF SPEECH UNDER THE FIRST AMENDMENT AND THE FIFTH AMENDMENT RELATED TO PROTECTIONS AGAINST TAKING A PROPERTY DUE PROCESS PROVISIONS

AND REGISTER TRADEMARK PROTECTIONS.

THE SIGN CODE UPDATE INVOLVES REPEALING CHAPTER 15 POINT 40 IN ITS ENTIRETY, ENTIRETY, AND MOVING THOSE SIGN REGULATIONS FROM TITLE 15 BUILDINGS TO TITLE 18 ZONING.

WITHIN TITLE 18 ZONING, A NEW CHAPTER WILL BE CREATED.

THAT'S CHAPTER 18.23.

AND IN GENERAL, THE SIGNED STANDARDS WILL REMAIN IDENTICAL OR SIMILAR TO THE EXISTING CHAPTER 15 POINT 40.

WE ALSO HAVE, UH, COMPLIANCE WITH FEDERAL AND STATE LAW REQUIREMENTS AND SIGN STANDARDS.

WERE FOCUS ON TIME, PLACE, AND MANNER.

LASTLY, NEW SIGN TYPES ARE BEING ADDED, WHICH CURRENTLY DO NOT EXIST IN CHAPTER 15 POINT 40.

THOSE INCLUDE MANY BOARDS REGULATIONS REGARDING CANOPIES AND AWNINGS REGULATIONS FOR THE USE OF PUMP TOP VIDEO DISPLAYS.

THOSE ARE IN CONJUNCTION WITH AUTOMOBILE SERVICE STATIONS, REAL ESTATE SIGNS AND THE IMPLEMENTATION OF SIGNED PROGRAMS TO ALLOW FLEXIBILITY, UM, ATTACHED TO THE STAFF REPORT.

AND, UH, ONE OF THE ATTACHMENTS, WHICH IS ATTACHMENT ONE IS THE DRAFT ORDINANCE, WHICH, UH, OUTLINES ALL THE PROPOSED CHANGES INCLUDING MOVING THE DEFINITIONS FROM CHAPTER, UM, 15 POINT 40 INTO A CENTRALIZED CHAPTER WITHIN THE ZONING CODE.

AND THAT'S CHAPTER 18.04, UM, BEFORE YOU IS A SECTION WHERE THE WINDOW REGULATIONS WERE, UM, DELETED ACCIDENTALLY OR MODIFIED.

AND AT THE SIGN CODE WORKSHOP, STAFF DID RECEIVE COMMENTS REGARDING ELECTRONIC L E D MESSAGE SIGNS, TEMPORARY SIGNS AND NON-CONFORMING SIGNS.

UM, FROM THE PUBLIC OUTREACH STAFF CONTACTED EIGHT ADJACENT CITIES REGARDING THE USE OF ELECTRONIC MESSAGE SIGNS, FEATHERED FLAGS, AND PORTABLE SIGNS.

THE UM, THE CITY'S RECOMMENDATION FOR THE USE OF ELECTRONIC MESSAGE SIGNS IS TO BE CONSISTENT WITH PAST PRACTICES WHERE THE CITY WASN'T ALLOWING THE USE OF ELECTRONIC SIGNS FOR TEMPORARY SIGNS.

THE RECOMMENDATION IS TO CONTINUE WITH THE CITY'S BANNER PERMIT POLICY.

UM, IN ADDITION, CLARIFYING THE USE OF FEATHER FLAGS AS A PROHIBITIVE TYPE, HOWEVER, ALLOWING THE USE OF A-FRAME SIGNS OR SANDWICH BOARD SIGNS, UH, WITHOUT A PERMIT, BUT SETTING PARAMETERS FOR THE USE OF THESE TYPE OF SIGNS.

AND LASTLY, NON-CONFORMING SIGNS.

THE CONCERN WAS ONCE THE SIGN CODE IS ADOPTED, WHETHER NON-CONFORMING SIGNS HAVE TO BE UPDATED AND THE RESPONSES, THE NON PERFORMING SIGNS WILL BE ALLOWED TO BE MAINTAINED.

HOWEVER, IF THESE SIGNS ARE ENLARGED IN THE FUTURE OR MODIFIED OR SIGNAGE AREAS ADDED AT THAT TIME, PERFORMANCE WILL BE REQUIRED.

WE SERVE 22,000 PATIENTS, OF WHICH 70% ARE FROM THE CITY, WITH ALL THE INFORMATION THAT WAS GOING OUT REGARDING COVID.

AND THEY WERE GOING TO THE, TO THE INTERNET AND SOCIAL MEDIA.

THE FACT IS, IS THAT WE WERE GIVING UP TO DATE INFORMATION, BUT WE HAD TO USE ANTIQUATED METHODS TO DO IT.

AND SO PART OF OUR CONCERN IS THAT WE HAVE ALL SORTS OF THINGS THAT WE HAVE TO ANTICIPATE AS A PUBLIC HEALTH CENTER, AND WE FEEL THAT IT WOULD BE BEST TO BE ABLE TO COMMUNICATE THAT THROUGH A DIGITAL PLATFORM.

WE'RE GONNA DO A WHOLE BUNCH OF IMPROVEMENTS.
