18 POINT 14 OFF STREET PARKING REQUIREMENTS, 18 POINT 26 R TWO R THREE R FOUR, R FIVE, R SIX, AND R SEVEN, MULTIPLE FAMILY DWELLING ZONES 18 POINT 30 SPECIAL NEEDS HOUSING 18 POINT 80, AFFORDABLE HOUSING INCENTIVES AND 18 POINT 82 INCLUSIONARY HOUSING UNITS OF TITLE 18 ZONING OF THE LAHABRA MUNICIPAL CODE AND TWO ZONE CHANGE 23 DASH ZERO FOUR TO AT CHAPTER 18.09.

OBJECTIVE DESIGN STANDARDS FOR MULTI-UNIT RESIDENTIAL AND MIXED USE DEVELOPMENT TO TITLE 18 ZONING OF THE LA HARBOR MUNICIPAL CODE TO GUIDE THE DESIGN OF MULTI-UNIT RESIDENTIAL AND MIXED USE DEVELOPMENT.

AND AMEND CHAPTER 18.68 DESIGN REVIEW TO ENSURE THE APPLICATION AND CONSISTENCY WITH THE STANDARDS FOR MULTI-UNIT RESIDENTIAL AND MIXED USE PROJECTS.

AND THREE ZONE CHANGE, 23 DASH ZERO FIVE TO ADD CHAPTER 18.84, MULTI-UNIT RESIDENTIAL AND MIXED USE DEVELOPMENT MINISTERIAL REVIEW PROCESS TO TITLE 18 ZONING OF THE LA HABER MUNICIPAL CO CODE IN ACCORDANCE WITH SENATE BILL 35 OR SSB 35.

THE CITY'S HERE TONIGHT TO PRESENT THREE ZONING CHANGES TO THE LAHABRA ZONING CODE THAT WERE INITIATED AS PART OF THE 20 21 20 29 HOUSING ELEMENT OF THE CITY'S GENERAL PLAN.

AS YOU KNOW, ALL CITIES ARE REQUIRED TO PUT INTO PLAN HOW THEY WILL MEET THEIR SHARE OF HOUSING FOR THE NEXT COUPLE OF YEARS AFTER MULTIPLE YEARS OF PUBLIC PROCESS, THE CITY COUNCIL FOR THE CITY OF LA HARA FOUND THE HOUSING ELEMENT IN SUBSTANTIAL COMPLIANCE WITH STATE LAW AND ADOPTED THE ELEMENT ON SEPTEMBER 19TH, 2022 HCD, UH, LATER CERTIFIED THE ELEMENT ON APRIL 21ST, 2023 FOLLOWING SOME ADMINISTRATIVE CHANGES DUE TO THE SEVERE HOUSING SHORTAGE IN CALIFORNIA.

THE UPDATES, THE UPDATE REQUIREMENTS FOR THIS CYCLE WERE MORE INTENSIVE THAN THE PREVIOUS ONES AND REQUIRED CITIES TO NOT ONLY SHARE, SHOW THEIR HOW THEY'RE GONNA MEET THE REGIONAL, UM, THE REGIONAL SHARE, BUT HOW THEY WILL REMOVE HURDLES TO HOUSING PRODUCTION AND ENSURE HOUSING FOR ALL LEVELS OF INCOME SINCE ITS ADOPTION, CITY STAFF HAS BEEN WORKING TO IMPLEMENT THE HOUSING ELEMENT BY COMPLETING THE HOUSING PROGRAMS THAT ARE REQUIRED TO BE, UM, ADDRESSED, UH, WITHIN CERTAIN UH, DEADLINES.

UH, THE CITY OF LAHABRA HAS, UM, PROPOSED TO IMPLEMENT EIGHT OF THE 29 HOUSING PROGRAMS WITHIN THE FIRST YEAR OF ADOPTION OF THE HOUSING ELEMENT.

THIS IS TO ALSO DEMONSTRATE ITS PROGRESS TO MHCD AS IT IS, UH, ANNUALLY REQUIRED THAT THE CITY PROVIDE A REPORT AND SHOW OUR PROGRESS ON HOW WE MEET THE HOUSING ELEMENTS.

I MEAN THE HOUSING PROGRAMS. NOW, A LOT OF THE UPDATES, AS I MENTIONED TO YOU, UM, ARE MORE EXTENSIVE THAN THE PREVIOUS YEARS AND HAVE BEEN GUIDED BY, UM, STATE HOUSING LAWS, UM, THAT WISH TO FURTHER FACILITATE AND, UM, STREAMLINE THE PROCESS OF HOUSING IN THE STATE OF CALIFORNIA.

SO TO GO OVER THE ZONING CODE AMENDMENTS THAT ARE BEFORE YOU TONIGHT, UM, I'LL START OFF WITH THE ZONE CHANGES UNDER 23 DASH OH THREE, WHICH AMEND VARIOUS CHAPTERS AND SECTIONS OF TITLE 18.

FIRST, WHAT WE DID UNDER THE DEFINITIONS CHAPTER, WE BROUGHT IN THE HOUSING CATEGORIES BY, UM, REPLACING TERMS THAT WERE DEEMED TO BE, UM, SCRUTINIZING, UM, OR MADE REFERENCES TO HOUSEHOLD SIZE, NUMBER OF FAMILIES AND OCCUPANCY.

WE ALSO ALIGNED THE HOUSING DEFINITIONS WITH STATE DEFINITIONS AND ALSO EXPANDED, UH, THE DEFINITION FOR GROUP HOMES, WHICH ENCOMPASSED SIX DIFFERENT TYPES OF HOUSING.

WHAT WE ALSO DID AS PART OF THIS UPDATE IS THAT WE CENTRALIZED ALL OF THE DEFINITIONS, UM, WITHIN OTHER CHAPTERS INTO, UH, THIS CHAPTER AND MOVING FORWARD AS AMENDMENTS COME BEFORE YOU OR THE CITY PROCESS AMENDMENTS, WE WILL CONTINUE TO CENTRALIZE THOSE DEFINITIONS TO REMOVE, UM, DUPLICATES AND THEN ALSO UPDATE THE DEFINITIONS UNDER THE

LAND USE MATRIX.

UH, WHAT WAS DONE IS THAT WE TRY TO INCORPORATE ALL THE USES THAT WERE NOW PERMITTED BY, RIGHT.

UM, AND WE'RE ALSO YOU DEEMED AS USES THAT WERE SIMILAR TO OTHER HOUSING USES, SUCH AS SOME OF THE, UM, HOUSING NEEDS, HOUSING, UM, GROUP HOMES AND OTHER LIKE EMERGENCY SHELTER FACILITIES.

WE ALSO TOOK THIS OPPORTUNITY TO INCORPORATE THE, UM, MX OVERLAY LAND USES THAT WERE NOT INCORPORATED INTO THE, UM, THE TABLE FOR A REASONABLE ACCOMMODATION.

WHAT WE DID WAS TRY TO REMOVE BARRIERS FOR, UM, INDIVIDUALS WITH DISABILITIES BY, UM, ELIMINATING THE UM, FINANCIAL HURDLE THAT THEY MIGHT FACE AND AS WELL AS, UM, STREAMLINING THE REVIEW AS WELL AS THE APPEAL PROCESS.

AND WITH THAT ALSO THAT HELPS TO PROTECT THE PRIVACY OF THE APPLICANTS.

AND THEN WE ALSO, UM, ENSURED UNDER THIS APPROVAL THAT WE WILL MOVING FORWARD, WE WILL, UM, DISPLAY ALL OF THE APPLICATIONS AND INFORMATION AT CITY HALL TO MAKE IT EASIER FOR THESE INDIVIDUALS TO, UM, BE AWARE OF THESE CHANGES UNDER THE, UM, PARKING REQUIREMENTS.

WHAT WE DID IS WE, UM, RELAXED THE PARKING REQUIREMENTS AS REQUIRED BY STATE LAW.

WE ALSO MADE A FEW CLARIFICATIONS AND ALSO ENSURED CONSISTENCY WITH TERMINOLOGY USED IN OTHER CHAPTERS FOR THE SPECIAL NEEDS HOUSING.

WHAT WE DID IS, UM, SIMPLIFIED THE CHAPTER, REORGANIZED IT RE REMOVE, REMOVED CERTAIN HURDLES SUCH AS OPERATIONAL AND DEVELOPMENT CONSTRAINTS, AND THEN ALSO INCORPORATED THE LATEST STATE REQUIREMENTS FOR, UM, LOW BARRIER NAVIGATION CENTERS, SUPPORTIVE HOUSING AND OTHER HOUSING, UM, SPECIAL NEEDS HOUSING, UM, AGAIN, DEEMED TO BE A USE THAT SHOULD BE PERMITTED BY RIDE AND SHOULDN'T BE SCRUTINIZED UNDER THE MX OVERLAY.

UH, WE REMOVED RESTRICTIVE, UM, DEVELOPMENT STANDARDS, UM, SIMPLIFIED THE WORDING, REMOVE REPETITIVE INFORMATION.

THE GOAL WITH THIS WAS TO ENSURE THAT WE PROVIDE MULTIPLE HOUSING OPTIONS AND THEN ALSO ENSURE CONSISTENCY WITH THE GENERAL PLAN AND OTHER CHAPTERS OF THE MUNICIPAL CODE.

FOR THE AFFORDABLE HOUSING DENSITY CHAPTER, WHICH IS OUR A CHAPTER THAT'S RELATED TO THE DENSITY BONUS STATE LAW.

UH, WHAT WE DID IS, UM, UPDATED WITH THE LATEST PROVISIONS UNDER THE GOVERNMENT CODE SECTION, WHICH, UM, ELIMINATES THE REQUIREMENT FOR A, UM, DISCRETIONARY REVIEW PROCESS.

AND THEN ALSO WE, UM, OUTLINED ALL OF THE APPLICATION REQUIREMENTS AND CONDENSED IT TO BE CONSISTENT WITH THE LATEST, UM, STATE LAWS FOR INCLUSIONARY HOUSING.

WE REMOVE REPETITIVE LANGUAGE, UM, ALSO WORKED WITH TERMINOLOGY AND REMOVED, UM, CERTAIN REQUIREMENTS THAT WERE DEEMED, UM, INCONSISTENT WITH STATE LAW FOR MULTI-FAMILY.

UH, WE INCREASED THE MAXIMUM BUILDING HEIGHT, UM, BY 12 FEET TO ALLOW, UM, A MAXIMUM HEIGHT OF THREE SIX FEET, BOTH AT R THREE AND R FOLDS, FOUR ZONES.

AND THIS IS TO PROVIDE, UM, DESIGN FLEXIBILITY AND WHICH CAN ALSO ACCOMMODATE HIGHER DENSITY FOR THE NEXT ZONE CHANGE UNDER 2304.

UM, THIS IS WHERE WE INCORPORATE ANY OBJECTIVE DESIGN STANDARDS TO THE LA HARVARD MUNICIPAL CODE.

THIS IS, UM, ALSO, UM, REQUIRED BY STATE LAW FOR MULTIFAMILY AND MIXED USE DEVELOPMENT PROJECTS.

AND WHAT WE DID UNDER THIS IS THAT WE WANNA ENSURE THAT WE INCORPORATE MEASURABLE AND OBJECTIVE STANDARDS THAT ALSO ENHANCE THE CITY'S CHARACTER, UM, WHILE ALSO ACCOMMODATING A VARIETY OF DESIGNS.

UM, SO WE INCORPORATED GENERAL STANDARDS, UM, A LIST OF DIFFERENT BUILDING TYPES THAT CAN BE ACCOMMODATED AND THEN, UH, NOTED THE ARCHITECTURAL STYLES OF SEVEN OF THEM, WHICH WE ALSO INCLUDED DIAGRAMS THAT SPECIFICALLY LAID OUT, UM, ARCHITECTURAL FEATURES PERTAINING TO THAT STYLE.

UH, I DO WANNA MAKE, UH, THE PLANNING COMMISSION AWARE THAT IT APPEARS THAT WE DO HAVE ADDITIONAL LANGUAGE IN THE ORDINANCE FOR THIS CHAPTER.

UM, SO IF I CAN HAVE YOU LOOK AT THE THIRD ATTACHMENT, THE SECOND TO LAST PAGE, UNDER SECTION 18 68, 0 5 0 FINDINGS UNDER D, WE HAVE INCLUDED ADDITIONAL INFORMATION THAT WAS TO BE REMOVED.

THE PROPOSED PROJECT IS CONSISTENT WITH THE OBJECTIVE DESIGN STANDARDS UNDER CHAPTER 18.09 OF THE LAHA MUNICIPAL CODE FOR THE LAST SEWN CHANGE UNDER 2305.

THIS IS A NEW CHAPTER IN COMPLIANCE WITH, UM, SSB 35, WHICH WILL INCORPORATES A STREAMLINED REVIEW PROCESS, UH, FOR, UH, MIXED USE AND MULTIFAMILY PROJECTS THAT MEET THE CRITERIA OF AFFORDABLE HOUSING AND OTHER STANDARDS.

UH, THIS IS TO BE CONSISTENT WITH THE STATE LAW AND THEN THE CHAPTER ALSO PROVIDES A MINISTERIAL AND PLANNING COMMISSION OVERVIEW PROCESS FOR POTENTIAL PROJECTS FOR DEVELOPERS TO FOLLOW, UM, FOR THEIR PROPOSED PROJECTS.

PLANNING'S RECOMME, I MEAN PLANNING STAFF'S RECOMMENDATION IS THAT THE PLANNING COMMISSION ADOPT THE ORDINANCES TO ADOPT, TO APPROVE ZONE CHANGES, TO APPROVE THE ZONE CHANGES WITH THE, UM, RECOMMENDED CHANGES AND FIND THAT THE REQUESTS ARE EXEMPT FROM CQA UNDER THE COMMON SENSE EXEMPTION SECTION.

HOWEVER, STAFF DOES NEED ADDITIONAL TIME TO CONTINUE WORKING ON BOTH OF THESE UPDATES RATHER THAN REQUESTING THE COMMISSION CONTINUE.

THIS ITEM STAFF WILL BE RE NOTICING THE ITEM FOR YOUR MEETING IN DECEMBER ON DECEMBER 11TH, 2023.
