WHEN ADDRESSING THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY, PLEASE COMPLETE A SPEAKER'S CARD BEFORE LEAVING THE COUNCIL CHAMBER.

GENERAL PUBLIC COMMENTS SHALL BE RECEIVED AT THE BEGINNING OF THE GOVERNING BODY MEETING AND LIMITED TO THREE MINUTES PER INDIVIDUAL WITH A TOTAL TIME LIMIT OF 30 MINUTES FOR ALL PUBLIC COMMENTS UNLESS OTHERWISE MODIFIED BY THE CHAIR.

Authorize GM Properties, Inc. to list the property commonly known as a portion of the La Habra Marketplace Parking Lot, APN 018-381-64, for sale, to solicit sealed bids to be opened at a public bid opening, and authorize the Executive Director to execute any agreements necessary for this process; or alternatively, B. Authorize GM Properties, Inc. to list the Property on the Ten-X auction platform in an open bid process, and authorize the Executive Director to execute any agreements necessary for this process.]

EVENING, CHAIR GOMEZ, VICE CHAIR ESPINOZA AND DIRECTORS.

I'M SUSAN KIM, DIRECTOR OF COMMUNITY AND ECONOMIC DEVELOPMENT.

THE ITEM, UM, BEFORE YOU TONIGHT IS A REQUEST FOR YOU TO DIRECT STAFF ON WHETHER TO MOVE FORWARD ONE WITH ONE OF TWO OPTIONS TO DISPOSE OF THE PROPERTY COMMONLY KNOWN AS A PORTION OF THE MARKETPLACE PARKING LOT.

AS YOU MAY RECALL, IN OCTOBER, THE THE SUCCESSOR AGENCY WORKING WITH THE AGENCY'S BROKER GM PROPERTIES LISTED THIS PROPERTY FOR SALE AND IN DECEMBER, THE AGENCY APPROVED THE SALE OF THE PROPERTY TO THE CITY OF LAHABRA FOR $57,500.

WELL ABOVE THE APPRAISED VALUE OF THE PROPERTY, WHICH IS $30,000 UNDER STATE LAW, THE ORANGE COUNTY OVERSIGHT BOARD HAS THE AUTHORITY TO APPROVE OR REJECT THE SALE.

IN JANUARY, THEY VOTED TO REJECT IT.

THEREFORE, TONIGHT I'M PRESENTING YOU WITH TWO OPTIONS TO MOVE FORWARD WITH THE SALE IN A TIMELY MANNER.

FOR EITHER OF THESE OPTIONS, THE AGENCY'S BROKER WILL NOTIFY PARTIES THAT HAD PREVIOUSLY INDICATED AN INTEREST IN PURCHASING THE PROPERTY TO ADVISE THEM THAT THAT THE PROPERTY IS ONCE AGAIN BEING MARKETED FOR SALE.

IN ADDITION, BOTH OPTIONS WILL REQUIRE INTERESTED PARTIES TO SUBMIT THEIR BIDS VIA STANDARDIZED PURCHASE AND SALE AGREEMENT PREPARED BY THE AGENCY'S LEGAL COUNSEL.

THE RECOMMENDED OPTION WOULD BE TO UTILIZE THE AGENCY'S BROKER GM PROPERTIES TO LIST THE PROPERTY FOR SALE AND HAVE SEALED BID OFFERS SUBMITTED

TO THE CITY CLERK.

THE BIDS WILL BE DATE AND TIMESTAMPED BY THE CITY CLERK'S OFFICE AND THEN OPENED AT A PUBLIC BID OPENING.

AN ALTERNATIVE OPTION WOULD BE TO USE THE AGENCY'S BROKER TO LIST THE PROPERTY USING THE ONLINE AUCTION PLATFORM, 10 X AT AN ADDITIONAL COST TO THE BUYER OF APPROXIMATELY $12,200 FOLLOWING AN APPROXIMATE TWO MONTH MARKETING PERIOD.

THE ONLINE AUCTION WOULD TAKE PLACE OVER TWO DAYS DURING THE AUCTION.

PROSPECTIVE BIDDERS WILL BE ABLE TO SEE THE HIGHEST SUBMITTED BID, BUT NOT THE NAME OF THE BIDDERS.

MEMBERS OF THE PUBLIC WILL ALSO BE ABLE TO MONITOR BIDS THROUGH 10 X ON A REAL-TIME BASIS AS THEY ARE SUBMITTED.

FOLLOWING THE AUCTION, 10 X WILL PROVIDE A COMPLETE LIST OF BUD BIDDERS WHO PARTICIPATED IN THE AUCTION, RESULTING IN A VERY TRANSPARENT PROCESS.

IN THE EVENT THAT THE SALE TO THE PROPERTY TO THE HIGHEST BIDDER IS NOT APPROVED BY THE AGENCY OR THE OVERSIGHT BOARD, ANY DEPOSITED FUNDS WILL BE RELEASED BACK TO THE BIDDER.

10 X WILL ONLY RECEIVE ITS FEE IF THE PROPERTY CLOSES ESCROW.

THE MAIN DRAWBACKS INCLUDE A MORE COMPLEX BID SALE PROCESS, A POTENTIALLY LONGER MARKETING PERIOD, AND A MARKEDLY HIGHER FEE TO SELL THE PROPERTY AS ADDITIONAL FEES WOULD BE REQUIRED TO BE PAID TO THE TO 10 X HIGHER TRANSACTION FEES COULD ARGUABLY RESULT IN LESS NET PROCEEDS FROM THE SALE OF THE PROPERTY, WHICH COULD POTENTIALLY MEAN LESS NET SALE PROCEEDS AVAILABLE TO BEING DISPERSED TO THE TAXING ENTITIES AND THEREFORE STAFF IS RECOMMENDING OPTION ONE.
