UH, THE TENANT SPACE IS IN A MULTI-TENANT SHOPPING CENTER.

UH, GENERAL PLAN HAS IT DESIGNATED AS MIXED USE CENTER ONE, UH, AND THE ZONING IS COMMERCIAL.

TWO WITH A MIXED USE OVERLAY.

UH, ALCOHOL AND BEVERAGE SALES, AS WELL AS THE PROVISION FOR LIVE ENTERTAINMENT ARE PERMITTED IN THE C TWO ZONE AS WELL AS THE, WITH THE, UH, MX OVERLAY, UH, SUBJECT TO THE USE OF A CONDITIONAL USE PERMIT, THE APPROVAL OF A CONDITIONAL USE PERMIT.

TALK A LITTLE BIT ABOUT THE SUITE.

THE SUITE IS ACTUALLY LOCATED ON THE WESTERN PORTION FOR THAT.

UM, THAT ENTIRE BUSINESS SUITE TO THE EAST IS THE FAT BELLY GRILL, I BELIEVE IT'S CALLED.

AND THE HIDEOUT IS THE SUITE TO THE LEFT.

UH, TO THE NORTH.

WE HAVE A COMMERCIAL, UH, SHOPPING, UH, CENTER, SIMILAR TO THE ONE, UH, ACROSS THE STREET TO THE EAST.

AGAIN, ANOTHER COMMERCIAL SHOPPING CENTER ACROSS, UH, MAPLE.

UH, IMMEDIATELY TO THE SOUTH ARE THE MAPLE APARTMENTS.

THAT IS A MULTIFAMILY, UH, DWELLING, UH, AREA.

AND TO THE EAST IS MORE OF THE COMMERCIAL SHOPPING, UH, UH, UH, TENANTS, UH, IN THAT SAME LOCATION.

AND THEN I JUST WANT TO POINT OUT TO THE SOUTHEAST, UH, WHICH IS PRETTY MUCH ADJACENT AS WELL.

THERE ARE ALSO SOME RESIDENTIAL R ONE USES SINGLE FAMILY HOMES.

THIS IS THE SITE PLAN FOR THE, UH, HIDEOUT AREA.

AS YOU CAN SEE, THE SUITE NOTED THERE IN THE RED BOX, UH, SOME OF THE THINGS THAT ARE GONNA OCCUR ON THE EXTERIOR.

THEY ARE PROPOSING TO ADD TWO NEW LIGHT STANDARDS IN THE PARKING LOT AREA.

YOU CAN SEE THOSE DENOTED WITH THE GREEN ARROWS.

AND THERE'S ALSO GOING TO BE THE ADDITION OF ONE, UH, ACCESSIBLE PARKING STALL IMMEDIATELY IN FRONT OF THE, UH, THE HIDEOUT BAR.

IN 1982, THE PLANNING COMMISSION APPROVED THE SALE OF BEER AND WINE, UH, UNDER CONDITIONAL USE PERMIT 82 DASH 31, AS WELL AS A VARIANCE TO REDUCE THE PARKING FROM 12 TO SIX SPACES.

THAT, UH, APPROVAL WAS ALSO, UH, MADE TO GO BACK TO BE REVIEWED, UH, WITHIN SIX MONTHS.

AND THAT WAS DONE IN DECEMBER OF 82, UH, FOR COMPLIANCE REVIEW.

AND, UH, RESOLUTION 82 1 69 MODIFIED THE CONDITIONS OF APPROVAL FOR THAT AT THE TIME.

AND INCLUDED THAT THE APPLICANT REQUIRE, UH, REQUIRED THE APPLICANT TO, UH, GET AN ENTERTAINMENT PERMIT.

UH, THAT WAS FOR THINGS LIKE DARTS AND THE POOL TABLES AND THINGS OF THAT SORT.

THIS IS THE EXISTING FLOOR PLAN FOR THE HIDEOUT.

UH, THEY HAVE SOME NON-LIVE ENTERTAINMENT, THE POOL TABLES, UH, A JUKEBOX AS WELL.

UH, IT'S BEEN A BAR SINCE 1982.

UH, IN 82 TO 86, IT WAS THE CSBA A GOGO FROM 99 TO 2000.

IT WAS CALLED BUSTER'S TAVERN FROM 2002 TO 2008.

IT WAS CALLED ED'S PUB.

AND THEN 2009 TO 2010, IT WAS CALLED EL CANTO NUMBER TWO.

AND FROM 2011 TO 2022, IT WAS THE LAS VEGAS BAR.

AND, UH, THE HIDEOUT WAS ESTABLISHED IN 19 IN, IN 2022.

FORGIVE ME, WHAT THE APPLICANT IS REQUESTING THIS TO UPGRADE THEIR CURRENT TYPE 42 LICENSE, WHICH ALLOWS ON SALE BEER AND WINE TO A TYPE 48 LICENSE.

UH, ALCOHOL AND BEVERAGE CONTROL, THOSE OUT LICENSES BASED ON TYPE AND, AND THE ACTIVITIES UNDER THOSE, THE TYPE 48 ALLOW, UH, LICENSE WOULD ALLOW THEM TO ALSO SELL DISTILLED SPIRITS.

THEY ALSO WANT TO OFFER LIVE ENTERTAINMENT, UH, TO THEIR PATRONS.

UH, THAT INCLUDES DJ PERFORMANCES, KARAOKE, SMALL MUSICAL GROUPS, AS WELL AS SOME STANDUP COMEDY ACTS FROM TIME TO TIME.

ONE OF THE THINGS THAT A BC DOES IS IT ALSO EVALUATES LICENSES IN WITHIN THE CENSUS TRACKS, AND THEY LOOK FOR THINGS, SOMETHING CALLED AN OVER CONCENTRATION.

AND THIS PARTICULAR CENSUS TRACK FOR THAT TYPE OF LICENSE THAT THEY'RE REQUESTING.

THE TYPE 48, UH, THEY'RE ALLOWED UP TO SIX LICENSES.

THERE ARE CURRENTLY THREE THAT ARE ACTIVE.

SO, UH, THE CHANGE TO A TYPE 48 IN THIS CASE DOES NOT, UH, UM, CREATE AN OVER CONCENTRATION OF LICENSES IN THE CENSUS TRACK.

WE'RE GONNA WALK THROUGH THE INTERIOR CHANGES AND WE'LL TALK A LITTLE BIT ABOUT, UH, MOSTLY THE ENTERTAINMENT PERMIT PORTION OF THIS.

UH, AGAIN, THEY WANT TO HAVE, UH, DJ PERFORMANCES,

UH, KARAOKE, SOME STANDUP COMEDY, AS WELL AS, UM, UH, UH, SOME LIVE PERFORMANCES WITH THE ACOUSTICAL GUITARS.

UH, ZONING CODE SECTION, UH, FIVE POINT 32 REQUIRES FOR AN ENTERTAINMENT PERMIT THAT THEY HAVE A DESIGNATED STAGE AREA THAT'S A HUNDRED SQUARE FEET THAT'S, UH, UH, DENOTED BY THE HATCHED AREA.

UM, THEY ARE ALSO MAKING MODIFICATIONS TO MAKE ACCOMMODATIONS FOR, UH, PERSONS WITH DISABILITIES, INCLUDING SEATING AT TABLES AS WELL AS, UH, ACCESSIBLE SEATING AT THE BAR.

THEY'RE ALSO PROPOSING TO REDUCE SOME OF THEIR NON-LIVE ENTERTAINMENT.

YOU CAN SEE THEY'VE REMOVED, UH, ONE OF THE POOL TABLES.

STAGE AREA IS DENOTED HERE IN RED, UH, SECTION FIVE POINT 32 ALSO REQUIRES THAT THERE BE A SIX FOOT SEPARATION FROM PATRONS, UH, THAT'S DENOTED BY THIS T AREA.

ALSO IN RED.

UH, ANOTHER REQUIREMENT IS THAT, UH, ENTERTAINMENT, UH, PERFORMANCES.

AND THOSE PERFORMERS HAVE A SEPARATE DRESSING ROOM THAT THEY CAN ACCESS, UH, THAT'S DENOTED DOWN HERE IN THE GREEN.

WHAT THEY'VE DONE IS THEY'VE TAKEN THE EXISTING OFFICE AND BIFURCATED IT SO THAT THEY CAN CREATE THAT DRESSING ROOM WITH A SEPARATE ENTRANCE.

THE OFFICE REMAINS.

AND ADDITIONAL, UH, A DA UPGRADES THAT ARE REQUIRED WOULD BE BOTH MALE AND FEMALE, UH, RESTROOMS THAT ARE NOW GOING TO BE A DA ACCESSIBLE.

UH, ONE OF THE THINGS THAT, UH, IS ALSO REQUIRED IS THAT THEY MEET THE CITY'S NOISE, AND THAT REQUIRES THAT FROM SEVEN TO 10:00 PM UH, THE DECIBELS NOT EXCEED 55 DECIBELS ON THE INTERIOR AND 45 DECIBELS ON THE EXTERIOR.

SO WE'VE ADDRESSED THAT IN A COUPLE OF DIFFERENT WAYS.

UH, FOR THE INTERIOR, THEY'RE PROPOSING TO DO SOUND ATTENUATION.

UH, THAT'S A PHYSICAL CHANGE AND THAT'S, THAT'S DENOTED BY, MIGHT BE A LITTLE BIT HARD TO SEE, BUT THE YELLOW ALONG THE WALLS ON THE WEST, UM, FLANKING THE BAR ON THE EAST AND THEN BEHIND THE STAGE, AND THEN NEAR THAT REAR ENTRANCE BY THE RESTROOMS. THEY'RE PROPOSING TO USE WHAT'S CALLED A TYPE X FIRE RATED DRYWALL.

IT'S GONNA BE AFFIXED TO THE EXISTING DRYWALL, UH, IS DENSER THAN REGULAR DRYWALL.

AND THE ACOUSTICAL ENGINEER HAS INDICATED THAT THAT WOULD DO ON THE INTERIOR BY AS MUCH AS 50%.

SO IN A LIVE BAR SETTING WITH MUSIC, YOU CAN HAVE SOUND THAT REACHES A HUNDRED TO 110 DECIBELS.

UM, THIS WOULD REDUCE THAT SOUND BY 50%, WHICH WOULD, UH, HAVE IT BE IN COMPLIANCE WITH THE NOISE ORDINANCE.

THE OTHER THING WE'RE PROPOSING IS TO MAKE SOME CHANGES TO THE OPERATIONAL CHARACTERISTICS TO PREVENT SOUND LEAKAGE ON THE OUTSIDE.

SO WHAT THAT WOULD ENTAIL IS THAT THE DOORS, UH, IN THE NORTH, THE FRONT ENTRANCE IS WELL, AS THE ONE IN THE SOUTH WILL REMAIN CLOSED DURING OPERATIONAL HOURS, WITH THE EXCEPTION OF INGRESS AND EGRESS.

UH, THAT'LL HELP PREVENT SOUND LEAKAGE FROM THE OUTSIDE SO THAT THEY CAN MEET THEIR SOUND REQUIREMENT OF 45 DECIBELS.

THEY'RE ALSO PROPOSING TO CHANGE THEIR HOURS OF OPERATION, UM, MONDAY THROUGH THURSDAY.

THEY'RE PROPOSING TO BE OPEN FROM 12 TO 12:00 AM UM, FRIDAY AND SATURDAY FROM 10:00 AM TO 2:00 AM AND SUNDAY FROM 9:00 AM TO 12:00 AM.

UH, THE LIVE ENTERTAINMENT WOULD BE THURSDAY THROUGH FRI, UH, THURSDAY THROUGH SATURDAY.

FORGIVE ME, UH, WITH NOTHING ON SUNDAY.

UM, I DO WANT TO TAKE, UH, A MOMENT TO TALK A LITTLE BIT ABOUT, UM, ANOTHER STEP WE TAKE, WHICH IS TO LOOK AT, UH, CALLS FOR POLICE SERVICE IN THE AREA.

UH, WE LOOKED AT THE LAST FIVE YEARS, WHICH COVERS ALL OF THOSE OTHER BARS THAT WERE THERE AT THE PRIOR, AT THE SAME LOCATION.

UM, AND WE LOOKED AT THE LAST COUPLE OF YEARS WHERE, UH, THE HIDEOUT HAS BEEN THERE.

IN 2004, THERE WERE SEVEN CALLS FOR SERVICE OF THOSE CALLS FOR SERVICE.

THEY ARE GROUPED IN THE FOLLOWING ORDER.

THERE WERE THREE AUDIBLE ALARMS RELATED TO THE SECURITY SYSTEM.

SO THAT MEANS THAT THERE WAS, YOU KNOW, SOMETHING INTERNAL AND, AND IT MADE A CALL FOR SERVICE.

THERE WAS ONE BAR CHECK THAT WAS INITIATED WHERE THE OFFICERS WENT OUT AND CHECKED THE BAR TO SEE HOW IT WAS OPERATING AND EVERYTHING WAS OKAY.

UM, THERE WERE TWO CALLS FOR SERVICE REGARDING LOUD MUSIC, WHICH IS WHY WE PAID, UH, SO MUCH ATTENTION TO ADDRESSING NOISE, BOTH INTERIOR AND EXTERIOR.

AND THERE WAS ONE CALL FROM A CITIZEN THAT OBSERVED A, UH, A PERSON THAT APPEARED TO BE INTOXICATED IN THE PARKING LOT AREA OF THE HIDEOUT IN THAT 6 32, UH, ADDRESSED AREA.

UM, I DON'T HAVE ANY REPORTS THAT THEY WERE RELATED TO THE HIDEOUT OR NOT, SO I, I CAN'T SPEAK TO THAT.

BUT, UM, THOSE WERE THE CALLS FOR SERVICE, UM, IN 2004.

SO WHAT STAFF IS RECOMMENDING IS THAT THE COMMISSION, UH, APPROVE, UH, THE, UH, MODIFICATION AS PRESENTED HERE.

I KNOW THE, UH, DESIGN TEAM AS WELL AS THE, UM, PROPERTY OWNER AND OTHER REPRESENTATIVES

AT THIS TIME, I WILL TURN TO THE PLANNING COMMISSIONERS TO SEE IF THEY DO HAVE ANY QUESTIONS OF YOU OR STAFF COMMISSIONER RAMS. UM, ON THE SOUND MEASURES, YOU SAID THERE WAS AN ACOUSTICAL ENGINEER THAT, SO WAS THERE AN ACTUAL STUDY DONE OF THE PROPOSED MEASURES TO THAT WOULD VERIFY THAT THEY WOULD MEET THOSE REQUIREMENTS? YES.

UM, WHEN WE FIRST STARTED TO TALK ABOUT NOISE, WHAT, UH, WE WERE LOOKING AT ARE SOME OF THOSE THINGS YOU SEE OFTENTIMES IN SOUND STUDIOS WHERE THERE'S SORT OF THIS FOAM, UM, UH, CORRUGATED FOAM THAT'S ON THE WALLS.

THE SOUND ENGINEER LOOKED AT THAT AND DETERMINED THAT IT WOULD IMPROVE SOUND QUALITY WITHIN THE FACILITY, BUT IT WOULDN'T DO MUCH FOR REDUCING SOUND OVERALL.

SO THAT'S WHERE THEY PROPOSED THE TYPE X DRYWALL.

UM, AGAIN, YOU'RE BASICALLY TAKING DRYWALL, WHICH IS ON THE WALL.

YOU ARE FIXING ADDITIONAL DRYWALL TO THAT WITH A, UM, AN ADHESIVE THAT ALSO HAS, UH, SOUND ATTENUATING PROPERTIES.

UH, THAT DENSER DRYWALL REDUCES THE SOUND BY AS MUCH AS 50%.

AND SO WE'LL GET FROM THE ROUGHLY, UH, A HUNDRED DECIBEL RANGE DOWN TO A 50 DECIBEL RANGE ON THE INTERIOR WITH THAT.

AND WE HAVE THE ARCHITECT HERE, THEY CAN SPEAK A LITTLE BIT MORE TO THAT.

OKAY.

YEAH, 'CAUSE I THINK YOU, I THINK YOU SAID A COUPLE MINUTES AGO THAT THE SOUNDS WOULD, WITH A LIVE ENTERTAINMENT WOULD GET IT IN THE RANGE OF 120, UH, BETWEEN A HUNDRED AND BETWEEN A HUNDRED AND 110 IS WHAT WE WERE TOLD FROM THE SOUND ENGINEER.
