CURRENTLY, TITLE 18 REGULATES PUBLIC NUISANCE CODES UNDER CHAPTER 18.72 AND 18.74. CHAPTER 18.72 WAS ADOPTED IN 1968 AND HAS NOT BEEN SIGNIFICANTLY UPDATED SINCE THEN EXCEPT FOR RENUMBERING FROM CHAPTER 10.2 TO 18.72 IN 2010. CHAPTER 18.74 WAS ADOPTED IN 1994 AND WAS UPDATED IN 2000 TO CLARIFY THE PENALTY FOR NOT MAINTAINING A PROPERTY IN 2003, TO CHANGE THE REQUIREMENTS TO MAINTAIN AND SECURE VACANT PROPERTIES IN 2010 FOR CHANGES IN CHAPTER NUMBERING. AND IN 2011 TO UPDATE THE MAINTENANCE REQUIREMENTS FOR ARTIFICIAL TURF. HERE ARE A FEW EXAMPLES OF PUBLIC NUISANCE VIOLATIONS THAT ARE CURRENTLY REGULATED BY CHAPTER 18.74. PUBLIC NUISANCE REGULATIONS DO NOT BELONG UNDER TITLE 18 BECAUSE IT'S IT'S NOT RELATED TO ZONING AND LAND USE AND IS BETTER SUITED. UNDER TITLE EIGHT, HEALTH AND SAFETY STAFF HAS IDENTIFIED THE NEED FOR A PUBLIC NUISANCE PROCESS IN ORDER TO DECLARE A PROPERTY OF PUBLIC NUISANCE WITH FOLLOW UP STEPS TO ENSURE EFFECTIVE ABATEMENT. IN ADDITION TO MOVING CHAPTER 18.74 TO TITLE EIGHT, THE PROPO, THE PROPOSED ORDINANCE CHANGES THE REVIEW AUTHORITY FROM AN APPEAL OF A PUBLIC NUISANCE DETERMINATION FROM PLANNING COMMISSION TO CITY COUNCIL, WE DID A GLOBAL SEARCH OF CHAPTER 18.74 AND FOUND THIS LIST OF SECTIONS IN TITLE 18 THAT REFERENCE CHAPTER 18.74. THESE SECTIONS WILL ALSO BE AMENDED. THE PLANNING COMMISSION TYPICALLY HAS PURVIEW OVER DISCRETIONARY DECISIONS RELATED TO ZONING CODE.
