VI. CONSIDERATION ITEMS:
1. Consider appointment to fill one vacancy on the Planning Commission with a term expiring March 31, 2017.
2. Consider the lease of the City facility located at 350 South Hillcrest Street to the Community Resource Care Center, 341 South Hillcrest Street to the Gary Center, 215 East La Habra Boulevard to the La Habra Old Settlers Historical Society, and 981 North Euclid Street to Help for Brain Injured Children.
a. Provide direction regarding the lease of the City facility located at 350 South Hillcrest Street to the Community Resource Care Center.
c. Provide direction regarding the lease of the City facility at 215 East La Habra Boulevard to the La Habra Old Settlers Historical Society.
d. Provide direction regarding the lease of the City facility at 981 North Euclid Street to Help for Brain Injured Children.
Motion to Approve :
1. A 5-YEAR LEASE WITH COMMUNITY RESOURCE CARE CENTER (CRCC), THE GARY CENTER, AND HELP FOR BRAIN INJURED CHILDREN (HBIC) WITH THEIR SOLE ABILITY TO EXTEND 5-YEARS, AND AT THE END OF 10 YEARS, ANOTHER 5-YEAR OPTION ON MUTUAL CONSENT, AND AT THAT TIME A DECISION FOR THE CITY OF LA HABRA TO TERMINATE THE LEASE WOULD TAKE A 4/5TH'S VOTE.
2. THE OLD SETTLER'S HISTORICAL MUSEUM, A 5-YEAR LEASE, WITH A 5-YEAR MUTUAL EXTENSION WITH A REQUIREMENT FOR A 4/5TH'S VOTE TO TERMINATE; WITH A CAVIAT THAT THE LEASE CAN BE CANCELED WITH 180 DAY NOTICE DUE TO PENDING VIABLE DEVELOPMENT OF THE CIVIC CENTER COMPLEX. ADDITIONALLY, THAT SPACE OR A FACILITY WOULD BE FOUND THAT THE MUSEUM CAN MOVE TO WITH THE SAME CONDITIONS.
3. THE CITY OF LA HABRA IS DECLINING ON THE BOXING CLUB AT THIS TIME. THE OPTION ON THE BOXING CLUB BY THE GARY CENTER FOR HBIC IS AGREED UPON IF THEY SO CHOSE AS THERE IS ALREADY A 5-YEAR LEASE, WITH A 5-YEAR OPTION AT THEIR OPTION; AND IF THEY SO CHOSE A 5-YEAR MUTUAL OPTION WITH A 4/5TH'S VOTE TO TERMINATE AT THAT TIME.

Beamish - General fund monies pay utilities and property taxes.
Beamish - General fund money pays property taxes and earthquake insurance.
Beamish - Historical museum annexed in with Children's Museum. There will be a Historical Museum.
Blazey - Clarified Kent Roberts has seen leases. Old Settlers Museum has a one-year lease and Kent Roberts signed the September 2005 lease that has a 180-day vacate.
Beamish - If there was a longer lease for Historical Museum with condition if a redevelopment came about the lease could be terminated because the city needs the space.
Beamsih - Potentially due to redevelopment Historical Museum and Veteran's Hall goes away. Uncomfortable with 5-yr lease unless language in lease saying if a redevelopment project comes up and if this is going away, then the lease comes back to the City.
Beamish - HBIC; City paying for operational costs of an organization with General fund money paid for by La Habra residents when there are non-resident clients.
Blazey supports the idea of placing the Old Settlers Museum into a facility that includes City Hall or making it part/wing of the Children's Museum.
Blazey - City pays taxes and insurance costs for non-profit structures without any cost recovery, and is not being required in the proposed leases.
Beamish - General fund money being expended, which is public money, to pay a bill for a non-profit's operational expense is not appropriate public policy.
Beamish - CRCC lease terms
Beamish - CRCC and Gary Center change to its option; from a 5-yr contract to a 10-yr contract. Then, add another 5-years, but at a mutual option.
Beamish - Old Settlers Museum. It would be nice to do an addition to the Children's Museum and have the Children's and History Museum of La Habra. That may not work, but should we redevelop the Civic Center, and the musum goes away, Kent feels it should be in the Civic Center. We both can agree that it needs to exist somewhere in La Habra and centrally located to the Civic Center.
Beamish - the non-profits should pay their operational expenses; property tax and earthquake insurance.
Espinoza - supports the 5-yr lease agreement, with a 5-yr option; with a 5-yr mutual for the non-profits. She agrees with Kent Roberts that we should have a location for the Historical Museum. Not sure she agrees with the non-profits paying the property taxes and all that, but will listen to Kent Roberts before making her decision.
Beamish - 2 other points; Gary Center was asking for the 1st option on the Boxing Club facility if they move out and he respectfully said no on that request as there may be other profits that have a more viable use or the City may want to use that facility. HBIC wanted the same lease as the Gary Center; if it is not better than current lease, assume he does not want to change the lease. Beamish stated to extend the same terms to HBIC.
Beamish restates motion! Approve a 5-year lease with the non-profits sole ability to extend 5-years. At the end of 10 years, another 5-year option on mutual consent - for CRCC & the Gary Center. For Old Settler's 5-year lease with caviat term that it can be canceled with an appropriate notice; 180 days, due to a pending viable redevelopment of the Civic Center Complex. Additionally that space or a facility would be found that the museum can move to with the same conditions, as far as $1 lease and all that stuff.
Beamish - Last part is because the leases have been strengthened and it takes 4/5's of a vote to change these leases, I would also add, because it is an operational expense, the property tax and insurance will be covered by the non-profits.
Blazey - Reseconded the amended motion; Wondering if we want to add that in that 10th year, when the next 5 years is coming up, when mutual renewal comes up, that a decision for the City to terminate would take a 4/5th's vote - for CRCC and the Gary Center, and would apply for HBIC.
Don Hannah reviews the motioned and seconded lease terms. He changes "redevelopment" to "development."
Don - reviews Old Settler's Museum lease terms; 5-year lease with a clause regarding pending development of that facility or of the Civic Center which would then require a 180-day notice along with the requirement that space be found for a future facilty.
Blazey - this only holds the Old Settler's Museum to 5-years. Are you willing to do what we just did for another 5-year mutual agreement with a 4/5th's vote, just in case things drag out for 1- years?
Beamish - As long as we have that clause, yes that would be fine.
Don Hannah - on the Historical Museum, it is a 5-year lease with a 5-year mutual extension with a requirement for 4/5th's vote to terminate. The pending development clause, the 180-day notice, and requirement to find replacement space. Declining on the Boxing Club at this time. The option on the Boxing Club by the Gary Center for HBIC, we would if they so chose there is already a 5-year lease, with a 5-year option at your option. If you so chose, we would add a 5-year mutual option ane he confirmed would be a 5-year mutual option with a 4/5th's vote to terminate.

Beamish - Last part is because the leases have been strengthened and it takes 4/5's of a vote to change these leases, I would also add, because it is an operational expense, the property tax and insurance will be covered by the non-profits.
Blazey - Reseconded the amended motion; Wondering if we want to add that in that 10th year, when the next 5 years is coming up, when mutual renewal comes up, that a decision for the City to terminate would take a 4/5th's vote - for CRCC and the Gary Center, and would apply for HBIC.

Blazey - Clarified Kent Roberts has seen leases. Old Settlers Museum has a one-year lease and Kent Roberts signed the September 2005 lease that has a 180-day vacate.
Beamish - If there was a longer lease for Historical Museum with condition if a redevelopment came about the lease could be terminated because the city needs the space.
Beamsih - Potentially due to redevelopment Historical Museum and Veteran's Hall goes away. Uncomfortable with 5-yr lease unless language in lease saying if a redevelopment project comes up and if this is going away, then the lease comes back to the City.
Beamish - HBIC; City paying for operational costs of an organization with General fund money paid for by La Habra residents when there are non-resident clients.
Blazey supports the idea of placing the Old Settlers Museum into a facility that includes City Hall or making it part/wing of the Children's Museum.
Blazey - City pays taxes and insurance costs for non-profit structures without any cost recovery, and is not being required in the proposed leases.
Beamish - General fund money being expended, which is public money, to pay a bill for a non-profit's operational expense is not appropriate public policy.
Beamish - CRCC lease terms
Beamish - CRCC and Gary Center change to its option; from a 5-yr contract to a 10-yr contract. Then, add another 5-years, but at a mutual option.
Beamish - Old Settlers Museum. It would be nice to do an addition to the Children's Museum and have the Children's and History Museum of La Habra. That may not work, but should we redevelop the Civic Center, and the musum goes away, Kent feels it should be in the Civic Center. We both can agree that it needs to exist somewhere in La Habra and centrally located to the Civic Center.
Beamish - the non-profits should pay their operational expenses; property tax and earthquake insurance.
Espinoza - supports the 5-yr lease agreement, with a 5-yr option; with a 5-yr mutual for the non-profits. She agrees with Kent Roberts that we should have a location for the Historical Museum. Not sure she agrees with the non-profits paying the property taxes and all that, but will listen to Kent Roberts before making her decision.
Beamish - 2 other points; Gary Center was asking for the 1st option on the Boxing Club facility if they move out and he respectfully said no on that request as there may be other profits that have a more viable use or the City may want to use that facility. HBIC wanted the same lease as the Gary Center; if it is not better than current lease, assume he does not want to change the lease. Beamish stated to extend the same terms to HBIC.
Beamish restates motion! Approve a 5-year lease with the non-profits sole ability to extend 5-years. At the end of 10 years, another 5-year option on mutual consent - for CRCC & the Gary Center. For Old Settler's 5-year lease with caviat term that it can be canceled with an appropriate notice; 180 days, due to a pending viable redevelopment of the Civic Center Complex. Additionally that space or a facility would be found that the museum can move to with the same conditions, as far as $1 lease and all that stuff.

Blazey - City pays taxes and insurance costs for non-profit structures without any cost recovery, and is not being required in the proposed leases.
Beamish - General fund money being expended, which is public money, to pay a bill for a non-profit's operational expense is not appropriate public policy.
Beamish - CRCC lease terms
Beamish - CRCC and Gary Center change to its option; from a 5-yr contract to a 10-yr contract. Then, add another 5-years, but at a mutual option.
Beamish - Old Settlers Museum. It would be nice to do an addition to the Children's Museum and have the Children's and History Museum of La Habra. That may not work, but should we redevelop the Civic Center, and the musum goes away, Kent feels it should be in the Civic Center. We both can agree that it needs to exist somewhere in La Habra and centrally located to the Civic Center.
Beamish - the non-profits should pay their operational expenses; property tax and earthquake insurance.
Espinoza - supports the 5-yr lease agreement, with a 5-yr option; with a 5-yr mutual for the non-profits. She agrees with Kent Roberts that we should have a location for the Historical Museum. Not sure she agrees with the non-profits paying the property taxes and all that, but will listen to Kent Roberts before making her decision.
Beamish - 2 other points; Gary Center was asking for the 1st option on the Boxing Club facility if they move out and he respectfully said no on that request as there may be other profits that have a more viable use or the City may want to use that facility. HBIC wanted the same lease as the Gary Center; if it is not better than current lease, assume he does not want to change the lease. Beamish stated to extend the same terms to HBIC.
Beamish restates motion! Approve a 5-year lease with the non-profits sole ability to extend 5-years. At the end of 10 years, another 5-year option on mutual consent - for CRCC & the Gary Center. For Old Settler's 5-year lease with caviat term that it can be canceled with an appropriate notice; 180 days, due to a pending viable redevelopment of the Civic Center Complex. Additionally that space or a facility would be found that the museum can move to with the same conditions, as far as $1 lease and all that stuff.
Beamish - Last part is because the leases have been strengthened and it takes 4/5's of a vote to change these leases, I would also add, because it is an operational expense, the property tax and insurance will be covered by the non-profits.
Blazey - Reseconded the amended motion; Wondering if we want to add that in that 10th year, when the next 5 years is coming up, when mutual renewal comes up, that a decision for the City to terminate would take a 4/5th's vote - for CRCC and the Gary Center, and would apply for HBIC.
Don Hannah reviews the motioned and seconded lease terms. He changes "redevelopment" to "development."
Don - reviews Old Settler's Museum lease terms; 5-year lease with a clause regarding pending development of that facility or of the Civic Center which would then require a 180-day notice along with the requirement that space be found for a future facilty.
Blazey - this only holds the Old Settler's Museum to 5-years. Are you willing to do what we just did for another 5-year mutual agreement with a 4/5th's vote, just in case things drag out for 1- years?
Beamish - As long as we have that clause, yes that would be fine.
Don Hannah - on the Historical Museum, it is a 5-year lease with a 5-year mutual extension with a requirement for 4/5th's vote to terminate. The pending development clause, the 180-day notice, and requirement to find replacement space. Declining on the Boxing Club at this time. The option on the Boxing Club by the Gary Center for HBIC, we would if they so chose there is already a 5-year lease, with a 5-year option at your option. If you so chose, we would add a 5-year mutual option ane he confirmed would be a 5-year mutual option with a 4/5th's vote to terminate.
Beamish - Which also includes the property taxes and insurance.
